U.S. Court of Appeals for the Federal Circuit Grants Pause Over Trade Court Ruling – Tariffs Remain in Force

Posted originally on CTH on May 29, 2025 | Sundance

Like I said last night, the Trump team followed their legal due diligence in several aspects of the tariff/trade deficit reset strategy, and it did not appear the New York trade court looked at any of the supportive material from the USTR and the Dept of Commerce.

Today, a full panel of U.S. Court of Appeals for the Federal Circuit granted a “stay” and paused the lower court ruling pending full appeal outcome and possible Supreme Court intervention.  [Ruling pdf Here]  The President Trump trade tariffs remain in place, and the ridiculous court-ordered refunding of previously collected tariffs is set aside.

The court is suspending the lower court decision until the appeals motions are filed and reviewed.  The multinational corporations have until June 5th to file their responses to the appeal, and the Trump administration has until June 9th to file their full appeal brief.

VIA CNBC – A federal appeals court on Thursday granted the Trump administration’s request to temporarily pause a lower court ruling that struck down most of President Donald Trump’s tariffs.

The Trump administration had earlier told the U.S. Court of Appeals for the Federal Circuit that it would seek “emergency relief” from the Supreme Court as soon as Friday if the tariff ruling was not quickly put on pause.

The judgment issued Wednesday night by the U.S. Court of International Trade is “temporarily stayed until further notice while this court considers the motions papers,” the appeals court said in its order.

The pause gives the Trump administration some breathing room as it prepares to argue that the trade court’s ruling should be halted for the duration of the appeals process.

The appeals court gave the plaintiffs — a group that includes state attorneys general and a handful of domestic businesses — one week to respond to the administration’s bid for a stay pending appeal. The U.S. will be able to reply to that response by June 9.

“This is merely a procedural step as the court considers the government’s request for a longer stay pending appeal,” said Jeffrey Schwab, a lawyer for the business plaintiffs, in a statement.

“We are confident the Federal Circuit will ultimately deny the government’s motion shortly thereafter, recognizing the irreparable harm these tariffs inflict on our clients,” Schwab said. (read more)

NBC is claiming the court, “barred the administration from making any future modifications to the tariffs in question.”  However, I do not see that in the order.  That looks like wishful thinking on behalf of the parent company who owns NBC.

Like I said last night…. Stay Calm. Be angry, but stay calm and frosty. Good, smart people are rapid firing legal analysis, supportive documents and strong ‘standing’ strategic information into the pipeline to assist.

For now, at least, the tariffs remain in place as they were before the trade court intervention.

Deputy FBI Director Dan Bongino Appears on Fox News to Instill Public Confidence in FBI

Posted originally on CTH on May 29, 2025 | Sundance

Deputy FBI Director Dan Bongino appears on Fox and Friends morning show to outline some of the historical events under a re-review.

Triggering the sympathy nerve, Mr Bongino repeatedly notes that work pressure upon him is creating ancillary pressure on his personal life, his wife and family.  Unfortunately, decades of visible corruption within his agency have numbed the public sympathy nerve.  Accepting this, we must elevate beyond our frustration, pray for Dan Bongino, for his ability to remain effectively focused, and for his family.

Regarding the message conveyed by the Deputy Director, he appears to accept there is no longer a public “trust” from which to draw. It is the responsibility within Mr Patel and Mr Bongino’s appointed positions to quench American thirst for truth, righteousness & justice.  Put earnest and honest sunlight upon the agency. Do something about the corruption we all know exists; get out of the box; be creative, be ferocious, color outside of the lines – do whatever it takes.

Sean Hannity’s highly caffeinated girlfriend is very concerned about the FBI being pulled away from safe children initiatives.  Meanwhile Deputy Bongino states the agency under their leadership has discovered a cache of previously hidden information and documents that will shed light on several previously dismissed investigative issues.  WATCH:

Important Note from Chuck Grassley’s Release Yesterday!

The FBI intentionally hid information as to ensure the public never knew about it?

Think about what that indicates about how the institution operates.

REFORM? …Try this.

#1) Send out an email to every field office, agent, division and contractor within the FBI asking every participant in Crossfire Hurricane or the Mueller investigation to report to the auditorium in DC on XXX date.

#2) Have big buffet and coffee set up. Now, with all of them seated in the audience, take their cell phones, laptops and electronic devices away, and give each of them a piece of paper and ask them to write down the names of every single person they interacted with during their investigative duty. Give them one hour to complete the task.

#3) Retrieve their notes. Send them to lunch (provided), as you review the lists. [Cell phones, laptops and electronic devices remain on side of the room where they placed them.]

#4) When they return, tell them all to stand up as you read the names from the lists. As their name is called, they can sit down.

#5) At the conclusion of reading the list, almost everyone should be seated, correct? Those who remain standing are unknown to the FBI investigators in the room. Tell those standing people to leave and assemble in an adjacent room, under watch.

#6) After the small group departs (if any), ask these questions:

A) If you were aware, or if you suspected, you were participating in a fraudulent investigation motivated by politics, please stand up.

=> Announce those people are fired for cause. Fired for violating their oath of office.

Escort them out.

Turn back to those remain seated.

A) If you *DID NOT KNOW* you were participating in a fraudulent FBI investigation, motivated by politics, please stand up.

=> Announce those people are fired for cause. Fired for not being smart enough to carry out their oath of office.

Escort them out.

The room should be empty.

#7) Now… the final detail. Perhaps you now have an adjacent room with a few people that no one in the FBI knows who they are or what they were doing there. These people were not named on any list created by the FBI employees who conducted “Crossfire Hurricane” or the “Mueller probe.”

That’s the CIA plant(s) in the room.

Regards.

Treasury Secretary Scott Bessent Contrasts Ridiculous Intervention of Trade Court Against Congressional Approval of President Trump Tariffs

Posted originally on CTH on May 29, 2025 | Sundance

The President of the United States, representing the executive branch, takes aggressive emergency action on tariffs and trade to protect American fiscal sovereignty and solvency.  Both chambers of the U.S. congress, the house and senate representing the Legislative branch, affirm the action through legislative support.  Yet, a single court in the judicial branch intervenes on behalf of multinational corporate interests to block trade policy.

That is the framework of Treasury Secretary Scott Bessent’s main point in a discussion with Fox News Bret Baier.  WATCH:

On the DOGE issue, listen to how a well-versed professional executive with years of experience in institutional reform discusses taking the DOGE team effort and integrating them into his massive agency as part of an operational efficiency overhaul.

Compare Secretary Bessent’s approach to other cabinet officials who have yet to grasp and execute the efficiency model that has been handed to them by the DOGE effort.  The contrast is remarkable.

Moscow says if Zelensky uses NATO weapons from Germany to Attack Moscow He Attacks Berlin

Posted originally on May 28, 2025 by Martin Armstrong

COMMENT: Marty, I respect that you do not want a Nobel Prize. But this is not about you. Putin just warned Germany that if it allows Zelensky to use NATO weapons to attack Moscow, he will attack Berlin. They said this is plain and simple. Everyone should be writing to nominate you for a Nobel Peace Prize for your model has called every turn in this debacle, and perhaps world leaders will listen to you if you get that Nobel Prize. I know you do not do this for notoriety or money. Hell, you don’t even sell advertising. Yield on this point. Please!

PY

ANSWER: I understand. But I think the Neocons would never allow them to nominate me. Go ahead. Flood them with letters. I bet it will have no impact. The Neocons are in complete control of Europe.

Two days ago, Deputy FBI Director Dan Bongino sought to address frustration by promising things in the background were taking place and that is why both he and Director Kash Patel were not making media appearances.

Tonight, FBI Director Kash Patel appears on Fox News to affirm confidence in the FBI.  Tomorrow Deputy Director Dan Bongino will appear on Fox and Friends to do the same.

Director Patel rejects the notion that the FBI is institutionally corrupt and fraught with malicious actors.  Director Patel says he has been sharing information from the FBI silo with “partners in congress” and more information is going to be released. The extensive interview is in two segments, presented below:
