And that is the question that should be asked.  It boggles the mind and offends the senses that there is EVEN ONE MEMBER OF WESTERN CIVILIZATION who is upset that Israel is pummeling the Palestinian wing of the Muslim Brotherhood. Under Ariel Sharon, Israel forcibly removed its citizens from Gaza and turned the land over to the Arabs. Israel has been rewarded for that gesture of conciliation with the abduction and killing of its citizens and the launching of hundreds of rockets into its territory.

Thursday, July 24, the 17th day of the IDF’s Gaza operation, Israeli ministers were discussing a possible “humanitarian ceasefire” in IDF-Hamas hostilities, which could last up to five days. According to debkafile‘s military sources, it is Hamas which, behind its tough stance, is keen on a pause – and not just out of sudden concern for Gaza’s civilians. Its tacticians are desperate to find a chink in the Chariot-4 tank’s Armored Shield Protection-Active Trophy missile defense system, known as the Windbreaker. The 401st armored brigade is the only IDF unit with this armor.

Hamas has tried to stop these tanks with two kinds of advanced guided anti-tank missiles, the Russian Kornet-E, and the Concord. But Windbreaker repels them and blows them all up.
Wednesday July 23 the IDF deliberately placed brigade commander Col. Sa’ar Tzur, one of the outstanding commanders in Operation Protective Edge, before TV cameras, while standing in front of a Chariot-4 tank.

He spoke at length about the brigade’s unstoppable performance under anti-tank missile fire. Those missiles are blown up without penetrating the tanks’ armor, he said, and are powerless to slow their advance.

Hamas has found no answer for the Active Trophy defense system, any more than it has for the Iron Dome anti-missile defense batteries, which keep Israeli civilian populations safe from its rockets. Both systems are home-made, developed by Rafael advanced armed systems industries.
Hamas is not giving up, which is why it is holding out against a long ceasefire, but aiming for just enough time to come up with new stratagems, debkafile‘s military sources say.
This was the message conveyed in the statement Hamas leader Khaled Meshal made Wednesday July 23 in Qatar: He rejected a long-term ceasefire, but left the door open for a “humanitarian” pause.
While its forces have taken serious punishment, most of Hamas’ underground command and military infrastructure is still far from knocked out. But if the Israeli military decides to go for a decisive coup against those core facilities – defined by the Israeli security cabinet’s euphemism of “expanding the operation” – Hamas chiefs expect it to be spearheaded by a fleet of Chariot-4 tanks hurtling towards them behind the protection of their impenetrable “Windbreakers.”

To maintain any kind of draw with the IDF, Hamas stands in urgent need of two resources: 1) Technology for neutralizing the Windbreaker; and 2) Missiles able to pierce it.
While Khaled Meshal haggles with ceasefire brokers in Qatar, his agents are known to have appealed urgently to Tehran to find the weapons they need and deliver them at top speed to the Gaza Strip – possibly from Libya by the Iranian-terrorists’ arms smuggling route through Egypt.
A reference to this appeal was made in a comment by a senior military intelligence official Wednesday, when he disclosed that Iran had promised to rebuild Hamas’ military machine, including its rocket production and launch systems. Hamas and Tehran also broached the problem of the Chariot-4 armor. Both fully understood that unless it can be solved, Hamas may have no way of defending its high command and arsenal in their elaborately furnished underground bunkers.

US Secretary of State John Kerry has all these facts to hand, fed by a steady stream of intelligence from US informants in and over the battlefield. His efforts for a ceasefire are based on his perception that Israel has so far not managed to inflict a clear defeat on Hamas and needs to expand its operation to tip the scales.

He calculates that if Israel launches its final thrust, which has not yet been approved, it will not accept a ceasefire before achieving its goal, and this may take at least a week to ten days.

But if  Prime Minister Binyamin Netanyahu and Defense Minister Moshe Ya’alon hold off on Israel’s decisive attack, then negotiations can start for a truce of some kind, while both sides size up their respective situations and decide whether or not it is to their advantage.

Lurch promises $47 million to Gaza, which means Hamas. Aiding and abetting the enemy of an ally may not be treasonous, but it is certainly immoral. John Kerry is no stranger to treason….


Lurch and Barry make a good comedy team and that is where they should have stayed, putting them in positions of power puts the entire world in jeopardy. Neither one of those two as a clue — we will never live this down.

Israel buried her war dead while continuing the grim task of destroying Hamas tunnel network.  Meanwhile, the ever-flaccid John Kerry, after griping about Israel on a hot mic in a Fox News studio “We’ve got to get over there. I think we ought to go tonight,” announced $47 million in humanitarian aid for Gaza.

Kerry didn’t fly to Israel.  You see, he wasn’t invited there.  Instead, he flew to Cairo, to insert himself into ongoing ceasefire talks.  So instead of “sitting around” in Washington with no role in the negotiations, he’s sitting around in Cairo, with no role in the negotiations.

Why on earth would anyone expect that this money would be spent differently by Hamas than every other grant, aid, or transfer to Hamas, ever?  Instead of building homes, they build tunnels.  Instead of building bomb shelters for people, they build rockets.  Mr. Kerry…

The 10th Amendment

Most of us know about the 10th Amendment to the constitution but to put it in context as St. George Tucker does in this post shows exactly what the framers intended in the separation of powers between the federal government and the several states.  The politicians have clearly over stepped the bounds that were established. It took them a long time but what he have now is clearly something very different than what we had up until only a few decades ago.

EDITOR’S NOTE: St. George Tucker was one of the most influential legal scholars of the early American republic. His View of the Constitution of the United States was the first extended, systematic commentary on the Constitution after it had been ratified by the people of the several states and amended by the Bill of Rights. And his Blackstone’s Commentaries, from which the following excerpt originates, was the major treatise on American law in the early 19th century. Lawyers arguing before the Supreme Court of the United States would frequently cite to Tucker’s Blackstone – more often than any other commentator until 1827.

The twelfth article of the amendments to the constitution of the United States, declares, that the powers not delegated to the United States by the constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people. This became the 10th amendment as after two amendments were not approved.

The powers absolutely prohibited to the states by the constitution, are, shortly, contained in article 1. section 10. viz.

1. No state shall enter into any treaty, alliance or confederation.

2. Nor grant letters of marque and reprisal.

3. Nor coin money.

4. Nor emit bills of credit.

5. Nor make any thing but gold and silver coin a tender in payment of debts.

6. Nor pass any bill of attainder.

7. Nor any expost facto law.

8. Nor any law impairing the obligation of contracts.

9. Nor grant any title of nobility. . . . Concerning all which, we shall make some few observations hereafter.

All other powers of government whatsoever, except these, and such as fall properly under the first or third heads above-mentioned, consistent with the fundamental laws, nature, and principle of a democratic state, are therefore reserved to the state governments.

From this view of the powers delegated to the federal government, it will clearly appear, that those exclusively granted to it have no relation to the domestic economy of the state. The right of property, with all it’s train of incidents, except in the case of authors, and inventors, seems to have been left exclusively to the state regulations; and the rights of persons appear to be no further subject to the control of the federal government, than may be necessary to support the dignity and faith of the nation in it’s federal or foreign engagements, and obligations; or it’s existence and unity as the depositary and administrator of the political councils and measures of the united republics. . . . Crimes and misdemeanors, if they affect not the existence of the federal government; or those objects to which it’s jurisdiction expressly extends, however heinous in a moral light, are not cognizable by the federal courts; unless committed within certain fixed and determinate territorial limits, to which the exclusive legislative power granted to congress, expressly extends. Their punishment, in all other cases, exclusively, belongs to the state jurisprudence.

The federal government then, appears to be the organ through which the united republics communicate with foreign nations, and with each other. Their submission to it’s operation is voluntary: it’s councils, it’s engagements, it’s authority are theirs, modified, and united. It’s sovereignty is an emanation from theirs, not a flame by which they have been consumed, nor a vortex in which they are swallowed up. Each is still a perfect state, still sovereign, still independent, and still capable, should the occasion require, to resume the exercise of it’s functions, as such, in the most unlimited extent.
