What we know from history is that politics governs everything from what you eat, to what your life will be like, to how it will end. The issue has always been who controls you, you or someone else?
Republicans starting with Thomas Jefferson believed that the Individual citizen could make better choice for the overall good of any country than any central government ever could. That basic view drives the conservative base of the Republican Party yet today. The premise is that left to their own devices the collective actions of the citizens under a constitutional rule of law country not subject to the whims of political factions would best serve the interests of all.
Democrats especially progressive Democrats believe that the people, the citizens, are incapable of governing themselves and they the “elite” need to be given the power to rule so that they can project the common man. 5000 years of history has proven that anyone that really believes that is a fool! Those that desire the ultimate power over our lives have worked very hard to get us to believe in them but it has not worked as they planned since the common man is a lot smarter than they can ever comprehend.
The core premise of our constitution was the people formed the states and the states made the laws to create order and opportunity for all. The states, not the people, created the national government to protect the states and create a system of commerce that favored no one over the other. That was the basis for the US Constitution.
Today we are faced with a political system that has lost its way, to be kind! Progressive democrats and some republicans would like to see a stronger federal government with the purpose to promote their world views. What both fall to see is that central control itself is flawed and can never work except to give those in power the ultimate power. So today we are faced with a lawless President intent in remaking American (which is not debatable since he has campaigned on it twice) however he never explained what he was going to make us into! That is now very clear and it’s an all powerful central government that has total control of its people (citizens no longer exist as they have no power).
Last Thursday November 20, 2014 the president announced a new policy on immigration which was not his to do. Executives Orders are only the means to enforce the laws of the country as passed by the US Congress. The immigration system, itself is not broken, the broken part is selective enforcement and executive orders that are really not executive orders but are rules that are in effect law.
So we have a debate today on what to do? And the general opinion in the media is that we should approve the Immigration reform bill now in the house. However that makes no sense since the November 4, 2014 election, only a few weeks ago, was a reformation on the Administration’s current policies and whether they should be continued or not? The voters agreed with the Republicans’ that they wanted the current direction being implemented by Obama to be stopped and to do that have given the Republicans a solid majority in both the House and the Senate.
Since the President has veto power and since the Senate required 60 votes to overcome objection to new laws the process to making change is not easy, as our founders rightly make so. So in my opinion as a lay person this is what I would do.
Number one is to stop the continuing resolution process and approve the 12 appropriation bills that make up the federal governments operating budget. They should do this with the changes that they would like but after the president veto them they should compromise and get the best deal they can and then pass them. While doing this they should explain to the Citizens what they are doing and why. The president may get his way but he will be made to look like someone that only wants his way and is not willing to compromise.
In addition to the normal budgeting process a separate bill for funding the security of the southern border should be passed in the house and sent to the Senate. Since it is a budget related bill authorizing money it will only need 51 votes to pass not 60. I don’t know the exact means to do this but spending billings are not subject to the 60 vote threshold by Senate rules.
The legislation should be short and concise something like the “entire” southern US Border (no exceptions) will have a physical barrier constructed to eliminate illegal crossing by 2018 and the funding is Herby authorized, further this authorization cannot be changed by future congresses. Work will commence no later than January 31, 2015 and be completed by December 31, 2018. This barrier with be above and below ground and have appropriate electronic and optical sensors as required. The objective is mandated that the southern border is 100 % secure.
At the completion of the border security project and only on completion of the border project congress will address the problem of those have entered the country illegally and are still here. In general those that are here and want to be assimilated into American culture will be allowed to become citizens with one exception and that is they cannot vote for any federal office holder or initiative e.g. constitutional amendments’. If they would agree to go to the back of the line and end up back in the country that limitation would be waved as they would then have entered legally.
This amnesty of sorts would not apply to anyone that had a criminal record (juvenile or not) in the country they came from nor if they acquired a criminal record once in American, traffic infractions could be waved. All in this category would be found and sent back to where they came from.
The provisions of this law would take affect the day it became laws and anyone who entered illegally after that date would be deported no exceptions. Anyone in the Country when the law went into effect would be required to register within 90 days with the INS and at that point their status would be determined. Special work or residences authorizations cards would be issued and anyone that didn’t have one would not be allowed to hold a job or be in this country. It would not be against the law to ask anyone for an ID card or other prove of citizenship in America. And anyone who hired a non citizens without a work card would be fined .01% of their gross revenues per day from the time that person was hired!
The purpose of this law is to secure the border to prevent smuggling and make sure there are jobs for American citizens.
