President Trump Files Urgent Motion to Nullify “Impermissible” Court Order Blocking Treasury Officials from Access to Systems

Lawyers representing President Trump and the office of the presidency have filed an urgent response motion to remove a court order by U.S. District Judge Paul Engelmayer that blocked the Treasury Secretary and “political appointees” from accessing Treasury Department systems. [SEE ADMINISTRATION FILING HERE]

The filing is in response to District Judge Engelmayer’s blatant effort to engage in judicial activism and violate the Article II separation of power.  The Chief executive cannot be limited in scope or activity by the judicial branch, let alone a single circuit court judge within the regional judicial branch who is attempting to block the executive branch nationally.

“Basic democratic accountability requires that every executive agency’s work be supervised by politically accountable leadership, who ultimately answer to the president,” Justice Department attorneys wrote in the 11-page filing, calling the order “impermissible” and “anti-constitutional.”

WASHINGTON DC – […] The attorneys are asking Manhattan-based U.S. District Judge Jeannette Vargas to quickly end or modify the order to ensure Treasury Secretary Scott Bessent and his top leadership can be briefed on the payment system and perform their legally required roles. (more)

From The Twitter – “Donald Trump’s actions since his inauguration have caused public discussion of some questions in Constitutional law.

I’m not a lawyer. But I have more than a passing acquaintance with Constitutional law – I’ve been studying it ever since I was an individual amicus in the Supreme Court case that struck down the Communications Decency Act back in the 1990s.

After 30 years of studying issues around the First and Second amendment and the doctrine of judicial review, I have some thoughts.

There are several intermingled issues here.

First: when JD Vance says that the courts do not have the authority to intervene in the administration of the executive branch, he is probably correct.

The judicial review power is generally considered to extend modifying or striking down laws, not to allowing any judge to interfere in the president’s administrative authority over the executive branch.

Second, any judge that rules that the Treasury of the Secretary may not have unlimited access to Treasury department data is setting himself up for reversal. This has never been litigated because it’s a ridiculous overreach that has never been attempted before.

Third, there are serious questions about the authority of federal judges below the level of the Supreme Court (what the Constitution explicitly calls “inferior” courts) that may now be forced to a resolution.

For purposes of separation of powers, only the Supreme Court itself is considered co-equal to the executive and legislative branches. Inferior judges are not.

One question, therefore, is whether the President may assert separation of powers as a defense against rulings of an inferior judge. Certainly, invoking separation of powers against a ruling of the Supreme Court itself would trigger a constitutional crisis, but that’s not the situation we’re talking about here.

This has not been litigated, but I think the President is likely to prevail on the question.

The fourth question is about the authority of federal circuit court judges to issue injunctions with nationwide effects outside the circuit where they have formal authority.

Until very recently, federal judges were so reluctant to raise this Constitutional issue that they almost never issued such injunctions. They issued injunctions only for their own circuits and left it to the Supreme Court to resolve questions about nationwide application.

But nationwide injunctions in contentious cases have become more common recently, and it is likely that the Supreme Court will be forced to address whether inferior-court federal judges do in fact have nationwide authority.

I think it is quite unlikely that the Supreme Court will affirm this.

I am not addressing here the question of whether I think Trump and DOGE’s authority to block Treasury payments should prevail. I am predicting that it almost certainly will prevail.” ~Eric S Raymond

Biden and Blinken Lose Security Clearances

The Trump Administration has determined that a handful of current and former public servants do not need access to sensitive government information. “JOE, YOU’RE FIRED!” the president posted on Truth Social before removing former President Joe Biden’s security clearances.

“If there are people that we don’t respect, if there are people that we thought that were breaking the law or came very close to it in previous years, we do it,” Trump said. “And we’ve done it with some people, we’ve done it with Biden himself.”

Previously, former presidents would continue receiving intelligence briefings. Though former presidents lose formal security clearances, they would continue to receive select information as a courtesy. Former President Joe Biden derailed that tradition when he took office and denied Trump intelligence briefings due to his “erratic behavior.”

Politico Fake News Hunter Laptop

The other most notable, almost comical, person to have their security clearance revoked is none other than top neocon and former Secretary of State Antony Blinken, who Trump has labeled a “bad guy.” Blinken played a key role in orchestrating the Russian collusion hoax. Blinken and 51 former intelligence officials took it upon themselves to publicize a letter that deemed the Hunter Biden laptop discovery ”a Russian information operation.” His role in hiding the Biden crime family’s activities from the public was blatant 2020 election interference. Let us not forget the nature of the Biden crime family’s role in Ukraine and Blinken’s role in fueling America’s position in that war.

Others, such as Jake Sullivan, the former national security adviser, and Lisa Monaco, former deputy attorney general, also had their security clearances revoked. Monaco played a key role in the Department of Justice’s investigation into January 6.

Corrupt New York DA Alvin Bragg and Attorney General Letitia James lost their clearances. These two went above and beyond to bend the law in an attempt to prevent Trump from seeking reelection. Andrew Weissmann, Mark Zaid, and Norm Eisen, lawyers who have notoriously targeted Trump, have also had their clearances eliminated. Zaid has told the New York Times that he has the right to due process, stating Trump and “his partisan minions” will not deter him from “holding them accountable ot the rule of law.”

Trump is seeking retribution for all those who have wronged him. But in wronging him, these people also wronged the American people by denying their voices and attempting to demonize a favored political candidate and his ideologies. The message is not merely revenge but a signal that these people are no longer welcome in Washington where they once held tremendous power under the Biden-Harris regime.

Do Americans have Buyer’s Remorse?

Trump Drawing 2

Less than a month into his presidency, Donald Trump has received excellent feedback from the American people. YouGov, ActiVote, Emerson College, Quantus Insights, TIPP insights, Gallup and others have found that nearly half of the public sees the new Trump Administration in a favorable light, with certain polls showing up to a 53% favorability rating.

Joe Biden was polling at all-time lows before leaving office. The American people had no confidence in government or progressive policies that drastically derailed the average man’s quality of life in the past four years. The “progressive” woke agenda shoved down our throats FAILED. Bidenomics coupled with soaring inflation, a multiplying public sector, and reckless government spending did not go unnoticed. America was forced to openly fund a proxy war abroad as our own borders were left unprotected. Globalist AMERICA LAST policies failed. The people were not certain if we even had a president with Biden’s barefaced mental decline.

Biden Secon Term

Trump hit the ground running to undo countless policies implemented by Joe and his handlers. During his first term, he signed a total of 220 executive orders. In the past two and a half weeks, Donald Trump pushed through 54 executive orders and revoked 91 of Biden’s issued orders. No president since Truman has signed so many orders in their first 100 days.

Emerson College Polling, for example, found that 52% of Americans believe the US is now on the right track. It is nearly unheard of for over half of the population to be in agreement.

“The shift is rooted in a flip of Republican perception and lessening of independents who say the country is on the wrong track,” Executive Director of Emerson Polling Spencer Kimball said. “Earlier this month, 70% of Republicans felt the country was on the wrong track, now 87% feel it is headed in the right direction. The share of independents who say the country is on the wrong track decreased from 69% to 53%, while Democrats’ perception that the country is on the wrong track intensified from 62% to 79%.”

The silent MAJORITY feels seen and has a voice. The economy is and will always be the biggest factor in government approval. Trump will quickly lose support if his tariff measures lead to inflation and you can forget it if he actually sent Americans back to the Middle East. We are witnessing the beginning of a paradigm shift which occurs when over 40% of the people support change. Our computer models indicated that this paradigm shift would begin in 2025 and shift to an anti-government stance by 2026 until everything comes to a head in 2029 into the Sixth Wave of 2032.
