Another Appeals Court Finds Progressive Consumer Financial Protection Bureau Unconstitutional

The Consumer Financial Protection Bureau (CPFB) was originally created by congress (Elizabeth Warren lead) as a quasi-constitutional watchdog agency to reach into the banking and financial system, under the guise of oversight, and extract money by fining entities for CFPB defined regulatory and/or compliance violations.

Essentially, the CFPB is a congressionally authorized far-left extortion scheme in the banking sector.  The CFPB levies fines; the fines generate income; however, unlike traditional fines that go to the U.S. treasury, the CFBP fines are then redistributed to left-wing organizations to help fund their political activism.

The Consumer Financial Protection Bureau (CFPB) was the brainchild of Senator Elizabeth Warren as an outcome of the Dodd-Frank legislation. Within the CFPB Warren tried to set up the head of the agency, the Director, in a manner that that he/she would operate without oversight. Previously, a federal court found the CFPB Director position held too much power and deemed it unconstitutional. The court decision noted that giving the President power to fire the Director would fix the constitutional problem.  However, a second set of legal challenges targeted the core of the CFPB scheme, the financing.

WASHINGTON DC – An appeals court on Wednesday ruled that the Consumer Financial Protection Bureau’s funding mechanism is unconstitutional, in a victory for lenders that have targeted the agency’s structure in a years-long bid to tamp down regulation.

A three-judge panel of the 5th U.S. Circuit Court of Appeals ruled that the design of the CFPB violated the Constitution because it receives funding through the Federal Reserve, rather than appropriations legislation passed by Congress. Democrats established the structure when they created the CFPB in the 2010 Dodd-Frank law as a way to shield the bureau from political pressures that could impact its oversight of the finance industry.

The judges also vacated a 2017 small-dollar lending rule targeted by the payday lending advocates who brought the case — the Community Financial Services Association of America and the Consumer Service Alliance of Texas.

“Congress’s decision to abdicate its appropriations power under the Constitution, i.e., to cede its power of the purse to the Bureau, violates the Constitution’s structural separation of powers,” the judges wrote.

The appeals court ruling marked the latest victory for the finance industry, which has fought for years in Congress and the courts to blunt the CFPB’s reach and limit its ability to police financial services. Republican lawmakers have also worked for years to stifle the CFPB and revamp its structure, arguing the agency lacks accountability.

“Even among self-funded agencies, the Bureau is unique,” Judge Cory Wilson wrote Wednesday. “The Bureau’s perpetual self-directed, double-insulated funding structure goes a significant step further than that enjoyed by the other agencies on offer.”

The CFPB Wednesday declined to say whether it would appeal the decision to the full 5th Circuit. CFPB spokesperson Sam Gilford said “there is nothing novel or unusual about Congress’s decision to fund the CFPB outside of annual spending bills.” (read more)

Here’s where we remind everyone of the importance of regular budget appropriations. There hasn’t been a standard federal budgetary spending process in place since 2008. Every budget since Obama’s first term has been a series of continuous resolutions, omnibus spending bills and appropriations without regular order.

This has not been an accidental outcome.

Biden received more votes than any president in US history, but not legally. There is documented evidence of people voting numerous times, and the documentary “2000 Mules” shows exactly how people swung the vote in Biden’s favor. Mail-in ballots changed the 2020 US Presidential Election. No ID was required to vote, forms were sent to deceased Americans, and countless forms mysteriously disappeared in transit.

Arizona was a swing state battleground during the last election. The Office of the Arizona Attorney General is now calling upon the compromised FBI and IRS to investigate the damning documentary as they want it to be labeled a conspiracy theory. They do not want the people to know that our elections were rigged.

Elsewhere in Arizona, a sensible judge is cracking down on ballot harvesting. For the first time in the state’s history, a person has been sentenced for ballot harvesting. Again, no one in the state of Arizona has EVER been charged with this serious act. Guillermina Fuentes, former mayor of the city of San Luis, has been sentenced to 30 days in jail and two years of probation.

Yuma County Superior Court Judge Roger Nelson does not believe Fuentes is remorseful. “The defendant acknowledged responsibility for carrying ballots for someone else however, she stated, ‘I’m not a criminal.’ Well, you are a criminal,” Nelson declared. “You committed a criminal offense. I don’t think you recognize that as a criminal offense. That’s the problem that I have.”

We need more judges like Roger Nelson who are willing to rule in favor of the people. Finally, someone is experiencing the consequences for rigging the 2020 US Presidential Election.

COMMENT: Dear Mr. Armstrong – Did you see this at last night’s game in Philadelphia (practically Biden’s backyard right near Delaware)? With the crowd so direct in a public manner, it’ll be tough to believe that Democrats would win in PA … maybe?

REPLY: As someone who grew up in South Jersey, let’s just say that Eagles fans are not afraid to offend anyone. Pennsylvania is a swing state, as we know, but Philadelphia tends to vote blue. Joe Biden was even born and raised in Scranton, PA. This video is clearly an indication that Philadelphia is not happy with the Democrats. For starters, Philadelphia’s mayor, backed by Biden, said on the record that he no longer wishes to hold office. He backtracked and is still hanging on, but has unofficially retired as he is doing absolutely nothing to help the city.

This is Kenney responding to reporters after a shooting over the Fourth of July. He wants to keep the money coming in and hold the lofty title, but he made it clear he has abandoned his responsibilities. People are fleeing Philadelphia because it is no longer safe. Cops are not permitted to arrest criminals for “minor offenses,” which has led to rampant crime throughout the city. Numerous retailers and food establishments, such as Wawa, have announced that they are leaving Philadelphia, where shoplifting is legal. The city had a serious waste management issue where trash simply piled high on the streets. Homelessness is on the rise and certain areas like Kensington are so dangerous and drug-infested that it looks like a scene from “The Walking Dead.” Car thefts, assaults, rape, and violent crime is on the rise. The murder count rises every year, with 562 homicides in the city last year alone.

Pennsylvania Senate candidate John Fetterman (D) does not like to be called a politician and is running on the grounds of being an outsider. Yet, he is a lifelong politician despite not looking the part. He is far less extreme than most Democrats but would like to open prisons and free seemingly remorseful violent offenders. Dr. Oz (R) is not the strongest opponent, and his ties to Oprah and his gimmicky show did not help his cause. Both men are seen as somewhat moderate for their party’s taste, but I guess this is the best they could find.

The people who were able to afford tickets to the most important Eagles game of the year (Eagles v Cowboys) likely have financial interests that do not align with Democratic policies. Philadelphia has become a forgotten city, abandoned by its politicians. The city may remain blue, but the state overall is leaning red.

Cultural Marxism is the modern philosophy to advance political correctness toward the agenda of social change.  Creating fear around speech is a technique for controlling what people are permitted to say and ultimately think.  Cultural Marxism is the merging of political correctness with advanced social pressures, including from the Big Tech social media platforms, from the political left to stop and shun any speech they disagree with.

One of the common ways to understand this is to realize that speech the leftists disagree with, they label as ‘violence’.  However, actual violence that supports the leftist agenda is labeled as speech.  Cultural Marxism is the twisting of words and control of language to advance a far-left agenda.

Igor Danchenko Found Not Guilty on all Four Counts of Lying to the FBI

Igor Danchenko was a well-known fabricator of (dis)information long before the FBI made the purposeful decision to enlist him in their Trump targeting efforts.  Specifically because Danchenko had no moral compass to the truth he was particularly useful for the FBI effort.  This was the big problem for John Durham in prosecuting Danchenko for material lies the FBI knew from the outset were false.

How does the same DOJ who used the lies for their political purposes, then prosecute the liar for the false information?  That was always the structural flaw in any case brought by Durham.  As a result, the trial was not so much about the lying Danchenko as it was about the lying FBI and their use of Danchenko.

A jury found Igor Danchenko not guilty on four counts of lying to the FBI, on four occasions.  (1) Danchenko told FBI agents he received a phone call in late July 2016 Sergei Millian. However, Danchenko knew he had never received a call from Millian. (2) Danchenko gave a false statement to FBI agents that he “was under the impression” that the late July 2016 call was from Millian. (3) Danchenko falsely stated to FBI agents that he believed he spoke to Millian on the phone on more than one occasion. And (4) Danchenko lied that he “believed he has spoken to [Millian] on the telephone,” when Danchenko well knew he had never spoken to Millian.

The FBI didn’t care about the details of the lies that were told to them; the lies served a purpose.  The FBI purpose was to use the Steele Dossier as the foundation for a fraudulent all-encompassing search warrant against the Trump campaign and presidency, using Carter Page.  That construct was always the motive of the DOJ/FBI use of Danchenko, Chris Steele and the infamous dossier that gave the DOJ the patina they needed for the FISA application.

The trial itself showed how corrupt the FBI and DOJ were in this scheme by: A) offering Chris Steele $1 million for proof of the dossier content.  B) By making Danchenko a confidential human source for two years to shield him, “sources and methods”, from investigative inquiry. C) By paying Danchenko $200,000 for his time as a useful tool and confidential human source.

As noted in the summary of the trial by Technofog:

[…] “What is more important is that which informs our understanding of the Trump/Russia investigation and the FBI/DOJ/Mueller misconduct that sparked Crossfire Hurricane and continued through the Mueller investigation. That information was revelatory. The institutions were on trial alongside Danchenko, with Durham recognizing in closing arguments that “the FBI mishandled the investigation at issue.” And the institutions rightly suffered. Danchenko might have been spared, but is there any reasonable doubt as to the FBI’s incompetence – and guilt?  (read more)

As CTH has stated from the outset of the entire scheme, the problem is institutional corruption.  The personnel, administration, leadership and participants, within the DOJ, DOJ-NSD and FBI are corrupt.

Institutions do not become corrupt by themselves.  People within the institutions are the cause of the corruption, and every person attached to the Trump-Russia investigation – including Robert Mueller, are corrupt.  It was a scheme in 2016, which became a coverup operation in 2017, which became an explosive institutional problem in 2019 which Bill Barr was trying to manage.

Institutional Preservation – Bill Barr applied the Bondo to the rusted framework of the DOJ and FBI, and John Durham applied the spray paint by not targeting anyone inside the justice department.

John Durham only focused, perhaps because he was only allowed to focus, on the external participants to the originating schemes.  One thing is clear, John Durham never once mentioned the corrupt nature of the Robert Mueller and Andrew Weissmann coverup operation.

Danchenko was represented by the same lawyers representing Hillary Clinton because at the heart of Danchenko’s intent was an effort to support Hillary Clinton in the 2016 October surprise they were constructing using fabricated claims of Trump colluding with Russia to win the election.

ALEXANDRIA, Virginia — A jury has found Russian national Igor Danchenko not guilty on four false statements charges, declining to convict him for the allegations that the main source of British ex-spy Christopher Steele had lied to the FBI about his sourcing for the discredited anti-Trump dossier.

The jury reached their decision on Tuesday after less than two days of deliberations, delivering John Durham another defeat in his long-running investigation of the Trump-Russia investigators, after the special counsel lost another false statements case against a Clinton campaign lawyer in May.
