Kevin McCarthy Removed as Speaker – It’s Time to Expel California From the Union

Armstrong Economics Blog/Rule of Law Re-Posted Oct 3, 2023 by Martin Armstrong

California has become a foreign country that should be expelled from the Union. There has been much discussion of how a state can secede from the Union. Justice Scalia wrote a letter in 2006 saying the answer was no and that it had been decided by force with the American Civil War. That is not really a constitutional answer.

Interestingly, Rep. Kevin McCarthy (R-Calif. (RINO)) has been removed as House speaker by a vote of the House of Representatives on a motion to vacate the chair brought by Rep. Matt Gaetz of Florida on a 216–210 vote. This unprecedented action now creates a political crisis, plunging the House of Representatives into inevitable confusion and uncertainty, not to mention a highly contentious battle over the speaker position.

This coincides as it simultaneously battles the calendar to complete the appropriations process and continues its impeachment investigation into President Joe Biden.

This raises serious questions about California and whether it should be expelled from the United States, especially as the Democrats want to put up California Governor Newsom to replace Biden – OMG! Is there any way a state could be removed from the US without its consent? All of the worst politicians, from Pelosi, Feinstein, David Valadao, one of 10 House Republicans who voted to impeach President Donald Trump, Adam Schiff, and McCarty to Newsom, have all been outright anti-American core values. Out of 53 politicians from California, only ten voted against impeaching Trump. At the same time, they support Biden and would vote against impeaching him.

A Constitutional amendment could do this job. But that is not so quick of a process. The Constitution provides that Congress may propose an amendment with a two-thirds majority vote in the House of Representatives and the Senate or by a constitutional convention called for by two-thirds of the State legislatures. Perhaps a Constitutional Convention could muster a two-thirds vote to expel California – from my mouth to God’s ears.

However, there is a hitch. “[N]o State, without its Consent, shall be deprived of its equal Suffrage in the Senate.” If a state is removed from the Union, it is not represented in the Senate. This begs the legal question: If a State is expelled at this point in time, is it still a state for the purposes of the Constitution? I would say NO WAY!

The Constitution does not describe such a method, and no one has ever tried to do so in the history of this imperfect union. Therefore, it cannot be prohibited. We know that during and immediately following the U.S. Civil War, some States attempted to secede from the U.S. to join the Confederate States of America. They were treated unconstitutionally for being denied the right to secede; they were still not allowed to be represented in Congress. They were demanded to end their insurrections, and a post-war government had to be approved by the Union forces in the Reconstruction era was in place. They were effectively stripped of all representation and treated themselves as slaves.

The Union States cleverly claimed that being denied Due Process of Law and stripped of representation in Congress, somehow using legal fiction, this was not on the theory that these areas had ceased to be States of the Union. The legal fiction used was based on the idea that there was a vacancy in the positions because these areas had not held elections for the U.S. House of Representatives.

Now comes the 14th Amendment, which was, at best, not Constitutionally valid.  The 14th Amendment to the United States Constitution was adopted on July 9, 1868, as one of the Reconstruction Amendments. It has been hailed as addressing citizenship rights and equal protection under the law for former slaves. However, it is punitive and a denial of Due Process in and of itself, for the defeated Confederacy bitterly contested the amendment. They were denied all representation in Congress and had been defeated militarily. They were given NO CHOICE and were forced to ratify it in order to regain representation in Congress. But if they were not represented, then how could they ratify the Amendment?

It was ratified by duress, and that is fraud under the law. Still, people sometimes sign contracts privately under duress or because of undue influence or coercion. These are all legal terms referring to questionable tactics, and they may invalidate a contract. This is my argument that the 14th Amendment is unconstitutional, for the South was denied representation unless they ratified the Amendment.

They could elect no one and not appoint even a Senator. This is why they are now trying to apply this abuse of process to Trump, claiming anyone who participated in an “insurrection” can not hold office. That was retribution and punitive and stripped the rights of the people denying them to be fairly represented in Congress.

Prior to the 14th Amendment, this denial of U.S. government representation was viewed as a function of practical reality and the war powers of Congress, and perhaps the “invasion or insurrection” and “Republican government” clauses of the U.S. Constitution. There was absolutely no constitutional validity to the actions taken by the Union. It cannot be a free government of the people when the people are not free to elect whomever they desire.

There is precedent for the expulsion of a Member of Congress. The United States Constitution (Article I, Section 5, Clause 2) provides that “Each House [of Congress] may determine the Rules of its proceedings, punish its members for disorderly behavior, and, with the concurrence of two-thirds, expel a member.” There is a legal maxim known as:

Everything which is not forbidden is allowed.

It is the legal concept that any action can be taken unless a law is against it. It is also known in some situations as the “general power of competence,” whereby the body or person being regulated is acknowledged to have a competent judgment of their scope of action. Suppose we apply this to expelling the State of California from the United States. In that case, NO law stands in the way, and the precedent from the Civil War is bogus and unconstitutional, which was railroaded by military force.

Kevin McCarthy Tells Republican Caucus He Will Not Seek Speakership Again – Here’s My Thoughts

Posted originally on the CTH on October 3, 2023 | Sundance

According to multiple DC media sources, a quiet effort is underway by members of the professionally republican mindset to kick Matt Gaetz out of the House Republican caucus.  However, the advocates worry they will be primaried by voters in their district, as the population of Republican voters supports Gaetz.  It is a duplicitous dynamic.

Meanwhile, Kevin McCarthy has told his Republican conference that despite prior statements, he will not attempt to become the House Speaker again and will instead retire to his home district in California.

No one is quite sure what comes next; what is clear is that Gaetz has channeled the frustration of the Republican/MAGA base into an actionable result.  This should not come as a surprise to the GOPe, although many of the cloistered clan continue pretending not to understand the dynamic at play.

Allow me to provide some simple clarity.

♦ In 2009 72% of the country, and an even larger percentage of the Republican voters, did not want Obamacare.  The govt takeover of healthcare was along purely ideological grounds.  For the 2010 midterm election, the professional Republican apparatus campaigned on this single issue – repeal Obamacare.  The voters destroyed the Democrats and flipped 67 seats to Republican control.  The professional Republicans wanted the House, frustrated American voters gave it to them.

The Republicans did nothing.

♦ In 2012, the professional Republicans campaigned on retaining the House and asked to begin a process of taking down the Democrat control of the Senate. Remember, it was a 60/40 Senate when the Obamacare boondoggle was begun.  Keep the House, help us take Senate seats, and we will repeal Obamacare and balance the budget.  That was the call of the 2012 professional Republicans.  The voters delivered.  The GOPe kept the house, took 6 seats in the Senate and introduced a wave of fresh Republican blood.

The Republicans did nothing.

♦ In the 2014 midterm election, the professional Republicans campaigned on retaining the House and now flipping the Senate with more GOP seats.  Keep the House, give us the Senate majority, and we will repeal Obamacare and deliver a balanced budget.  The voters again delivered.  Beginning in January 2015, the Republicans controlled the House and the Senate majorities for Obama’s last two years.

The Republicans did nothing.

Worse still, even with professional Republican control of both chambers of congress, President Obama never had to use his veto pen.

♦ In the 2016 election, after the professional Republicans could no longer stop/block candidate Donald Trump, they said if we get the White House, retain the House and retain the Senate, we will repeal Obamacare, return to regular budgetary order, and balance the budget.   Stunningly, against all the odds, the voters yet again delivered.  President Trump won the election; Republicans now held the White House, the House and the Senate – as requested.

The Republicans did nothing.

Worse still, the professional Republicans acted as if they were the dog that just caught the car.  Now they had no excuses, and as a result there was an exodus of retirements announced from the caucus of the professionally Republican to begin in 2018.

Simultaneously, the professional Republicans passively allowed the targeting of Donald Trump by a fully weaponized intelligence apparatus and justice system to commence.  To say the professionally Republican were willfully blind would be polite and generously honest.

In the background the RNC did nothing.  The California ballot harvesting operation of 2018 reflected a complete lack of action by the RNC or CA GOP.  We all well remember how that operation expanded nationwide in 2020, again with the RNC doing nothing.

This is the reality of what took place between the elections of 2010 and 2020.   Every ask of the professionally rRpublican apparatus was delivered by voters. Every ask of the voters in return was ignored.  Effective January 2021, Obamacare still exists, no budget was ever produced, the borders were unsecured, the economy tanked due to Biden policy, energy and printing presses.  Crises, along with insufferable government mandates, amplified and expanded from coast to coast.

The Green New Deal was passed by Republicans and Democrats, and the collapse of the economy came with it.

Clear enough?

Suddenly, as if there was no background of repeated broken promises and a complete failure to deliver on any key request, Kevin McCarthy and his legion of professionally Republican supporters pretend they cannot fathom why the base voters are more than happy to support Matt Gaetz.

WASHINGTON DC – Kevin McCarthy will not seek the speakership again, marking a devastating end to his time in GOP leadership.

The California Republican informed his members behind closed doors Tuesday night that he will forsake another attempt to win the top job after his ouster on Tuesday, according to seven people familiar with the remarks.

His announcement comes amid intense anger over his ouster by Rep. Matt Gaetz (R-Fla.) and seven other GOP members, who voted with House Democrats to eject him earlier Tuesday. Most Republicans vocally opposed his eviction.

McCarthy told his conference that he would return to California to spend time with his family. In his stead, the House will be run by Rep. Patrick McHenry (R-N.C.), his hand-picked choice as acting speaker. House Republicans have no plans to return to session until next week, scrapping their plans to try to pass party-line spending bills.

The vacancy atop the House is sure to set off a scramble among ambitious Republicans — one that’s likely to get dirty and dragged-out, particularly if McCarthy’s deputies try to ascend. The GOP agrees that the most obvious choices are Majority Leader Steve Scalise (R-La.), House Majority Whip Tom Emmer (R-Minn.) and Conference Chair Elise Stefanik (R-N.Y.), all of whom had publicly backed McCarthy until he bowed out.

“I might have been given a bad break, but I’m still the luckiest man alive,” McCarthy said, according to multiple people in the room when he revealed he would not, as he’d vowed, keep trying to stay speaker.

President Trump “Monumental Leaders” Rally, Rapid City South Dakota – Livestream

South Dakota Governor Kristi Noem Will Possibly Endorse President Donald Trump Today During Event in Rapid City

Posted originally on the CTH on September 8, 2023 | Sundance

In the world of USA politics, the layers of stuff we need to pull apart and review is complex and always uncertain.  However, this one is something I predicted ever since we started to see the collapse of Ron DeSantis and the desperation of the Sea Island group to try and retain control.

According to multiple media sources, originally starting with CNN – which is by itself sketchy, South Dakota Governor Krisi Noem is likely to endorse President Trump for 2024.  This power move was anticipated by me about two weeks ago.  Noem has appeared to be positioning herself for VP consideration over the past couple of months.

The problem, and this is where you really need to apply your suspicious cat instincts, is that Noem has always been a member of the Koch Brothers political outlook.  She has been funded by them, supported strongly by them and the influential network around the Koch group, Americans for Prosperity.  Noem has an immigration position that fits with the agenda of Big Ag, and that multinational enterprise is yet another layer of serious sketch.

The Koch/AfP network is the Paul Ryan coalition of establishment republicans, and Noem has always been in that stable.  The Koch group has pledged to spend $70 million to destroy MAGA and Donald Trump {LINK} and the AfP has been working with Fox News to con the viewing audience as they support DeSantis. {LINK}

So, what the heck is going on here?

I don’t have the direct and data-driven answers,… YET….. but I will tell you with certainty, my gut instinct is that moving Kristi Noem into a position where she would be considered a VP pick for Trump in 2024, looks like an insurance policy against Trump winning 2024.

My suspicions against Noem are driven by two main points.  First, Noem was being positioned by the Sea Island control group as the VP on the DeSantis ticket.   That was clear from prior messaging, organizational alignment and information coming from the control system behind DeSantis.

Second, despite numerous interviews, no one has ever called out Kristi Noem for her relationship with the Kochs as it contrasts against her positive discussion of Donald Trump.  Sometimes the absence of something tells you more about the construct of what you cannot quite put your finger on.

Governor Noem is a frequent guest on Fox News, yet no one ever asks her the main questions that would reveal the agenda.  Big Ag is her tribe; Koch and Americans for Prosperity are her finance network; how does this line up with the spoken support for Donald Trump?  Something is amiss, and my Spidey senses are on full alert.

[VIA NBC] South Dakota Gov. Kristi Noem is expected to endorse Donald Trump for president at his rally in her home state tonight, according to a source familiar with the plans.

Noem is popular in Trump-world, and she has been the subject of significant speculation as a possible vice presidential candidate for Trump in 2024, should he secure the nomination.

Asked on a radio show Thursday about the possibility of her endorsement, Trump praised the 51-year old governor and former House member.

“I don’t know exactly. But … I like her a lot. I think she’s great. Kristi’s done a great job. She’s been — she really, you know, she’s really kept her state open,” Trump told Howie Carr.

A Trump campaign spokesman declined to comment on the possibility of an endorsement tonight, as did Noem’s spokesperson.

The news of Noem’s impending endorsement was first reported by CNN

Noem has supported Trump for years and was floated as a potential presidential candidate before Trump announced his 2024 campaign.

She is term-limited, with her second term as governor of South Dakota running through 2026. (more)

Recapping all of the aligned enterprises against President Trump we find: the entire Wall Street network of hedge funds and billionaires like Ken Griffin, the entire multinational corporate alignment represented by the Sea Island confab, the billionaires and industrialists who need globalism for profit, the lobbyist groups like the Chamber of Commerce and Club for Growth and the Republican Governors Association who receive funding from those groups. Then we can add the social media influencer community, Elon Musk, the network of allied conservative Never Trump punditry and top it off with the RNC as the cherry on the cake.

Yes, this opposition group represents almost the entirety of the Big Club and every control mechanism- all of it aligned against one guy, one man, who is an existential threat to their influence and affluence…. AND this is only from the Republican side of the UniParty equation.  Add the entire Intelligence Apparatus into this equation, and a majority of Republicans in both chambers of Congress, and the scale of opposition takes even more context.

But wait, there’s more…

This doesn’t even include the weaponized use of the judicial branch, the DOJ, the FBI, the NYC Alvin Bragg effort, the Fulton County GA effort and the Special Counsel Jack Smith effort. All of this… ALL OF THIS is against ONE GUY.

Think about what that reality represents when you consider the scale of corruption that infects the body politic.

And yet, stunningly, remarkably and perhaps even divinely protected, President Donald John Trump is still winning against all of this opposition.

Why and how can this be possible?

Because Trump has something none of this can defeat – he has the support of a massive number of Americans who are taking a stand with President Trump as our gloriously imperfect vessel to destroy it all.

It is the most remarkable moment in history as one man stands the gap and fearlessly faces down the combined effort of decades of political corruption.

It truly is inspiring.

President Trump Takes Commanding 50 Point Primary Lead at 62% – Gains Largest Polling Lead Against Biden 42/37

Posted originally on the CTH on September 7, 2023 | Sundance

Premise Polling conducted by 538 Project [DATA HERE] shows President Donald Trump with a commanding 50-point lead over the rest of the field.   President Trump holds 62% of primary voters, while Ron DeSantis shrinks even further to 12%.   This poll, along with all the state polls show a similar trend pattern.  President would win all the delegates in the key primary states.

In a head-to-head matchup with only Trump and DeSantis, President Trump crushes the Florida Governor 67% to 24%.  The demographics are again consistent with Trump dominating every subset of voter and DeSantis holding tepid support from rich white men over 55, with graduate degrees who say they don’t follow politics.

This poll reflects an almost identical outcome to the Wall Street Journal polling released a few days ago.

Additionally, in this poll President Trump is easily beating Joe Biden 42/37, while Joe Biden beats Ron DeSantis 35/33.

There are too many aligned datapoints now showing almost identical outcomes.  This reality is likely why DeSantis PAC senior official Jeff Roe recently said the next 30 to 60 days were do or die for the DeSantis operation.  They are simply running out of money.

Powerful Testimonial – President Trump’s Visit With Afghan Bombing Gold Star Families Described

Posted originally on the CTH on September 5, 2023 | Sundance

This is not going to come as a surprise to most readers here, but this testimonial by Marlon Bateman deserves to be shared. This story reflects what the core of Donald Trump is about.

Marlon Bateman – “Last week, I had the honor to accompany several Gold Star parents to meet with President Trump in Bedminster. These parents lost their children when Abbey Gate was bombed in the disastrous withdrawal from Afghanistan, which was orchestrated by Joe Biden.

While Biden continues to ignore these families’ requests for answers, President Trump listened to them, he mourned with them, and he was genuinely devastated for their loss. But he also mourned for the Country’s loss of these amazing Americans.”

One hour came and went quicker than anticipated. Our time with the President was up — or so I thought. Many families had requested President Trump sign photographs of their sons and daughters. He then proceeded to spend nearly two hours signing hats, books, and even a pair of red, white, and blue bedazzled pair of high heel shoes! He spent time with each individual family celebrating and learning about our 13 brave American heroes.

“After each family was done, they were escorted upstairs to dinner. We did not expect President Trump to join us, but to my surprise, he came up and joined us for dinner.

Everyone erupted in cheers as he walked in. Lee Greenwood’s ‘God Bless The U.S.A’ was blaring on the speakers. He proceeded to spend another couple of hours with us and even busted out an iPad to play songs for couples to slow dance to. He even went into his all-time favorite wrestling intros!

At that moment I could see the anxiety, stress, and anger that these parents had carried for so long disappear from their faces. It was a moment of peace. They were there to celebrate the heroes they raised. Their babies grew up to be the best our country had to offer, and they were getting some of the recognition they deserved.

As the night ended and President Trump gave his farewell, tears and overwhelming emotions could not be held back. He did something for these families that the current administration has refused to do and was incapable of doing — giving an overdue moment of recognition and solidarity for their children.

Not a bullshit statement from the White House, not John Kirby sending his deepest condolences on CNN, not Joe Biden continually glancing at his watch while the bodies of their children were carried off the tarmac. He gave them hope that accountability and justice will be coming. Our country owes it to their children to continue the pursuit for truth and accountability. We must continue to tell their stories and say their names.” (source)

Sunday Talks – Stephanopoulos Crew Flummoxed at Strength of National Support for Donald Trump, Easily Leading Biden in Polls

Posted originally on the CTH on September 3, 2023 | Sundance

The ABC panel is jaw agape at the latest Wall Street Journal polling showing that Donald Trump has not only widened his GOP primary lead, but is also polling ahead of Joe Biden with a diverse core of American voters.

Donna Brazile is very concerned, panicked even, that young Latino and black voters are now turning their back on the Democrat machine, and while they are not supporting Republicans, they are fully supporting Donald Trump.  She won’t admit it, but this is exactly the reason why the Republican and Democrat apparatus are working together to get rid of Trump.

President Donald Trump represents the first modern political opponent to the UniParty, the illusion of distinction between the RNC and DNC.  In essence, the policies and perspectives that Donald Trump represents, form a unique contrast to the almost identical Dem/Rep dynamic.  The MAGA coalition is built of Republicans, Independents and Democrats, which is always highlighted by the largest ever support network for Republican Trump amid Latinos and Blacks.

The panel struggles with the reality of Godzilla Trump destroying the professional political class, while simultaneously the panel tries to promote and defend the customary leftist narratives.  The pearl-clutching is exceeded only by the number of fainting couches provided by the ABC production crew. WATCH:

Murdoch Sad – WSJ Post Debate Poll Shows Support for DeSantis Collapsing, Pre-Debate 24%, Post-Debate 13%

Posted originally on the CTH on September 2, 2023 | Sundance

Rupert Murdoch has big sad as his Wall Street Journal outlet admits their poll looks terrible for Ron DeSantis.  [WSJ HERE] Currently with only 13% support, DeSantis’s position has collapsed since April, when WSJ showed 24% backed him.

Additionally, Chris Christie and Mike Pence are the two candidates with the highest unfavorable rating by Republican voters, -73% and -63% respectively.  Respondents show their opinion worsening mostly due to Christie and Pence position against frontrunner Donald Trump.

It looks like the Wall Street and RNC Big Club donors are now eyeing Nikki “test the wind” Haley, as the best option to try and stop Godzilla Trump. This shift likely explains why DeSantis’s campaign operative Jeff Roe was begging donors for another $50 million last week, as discovered in leaked audio from meetings with them during the high-brow events in Wisconsin.

Wall Street Journal – […] At 13% support, DeSantis’s position has collapsed since April, when 24% backed him in a slightly different field of candidates tested by the Journal.

GOP primary voters believe businessman Vivek Ramaswamy and former Gov. Nikki Haley of South Carolina, far more than any other candidates, exceeded expectations in the televised Aug. 23 GOP debate among eight of Trump’s rivals. But those impressions so far haven’t turned into significant ballot support, with Haley the first choice of 8% and Ramaswamy at 5%.

Sen. Tim Scott of South Carolina, who has cast himself as an affable warrior for conservative causes, has made little headway after three months of campaigning, drawing 2% support.

Republicans nationally are rejecting the candidates who most sharply criticize Trump: Former Govs. Chris Christie of New Jersey and Asa Hutchinson of Arkansas drew 3% and 1% support, respectively. Christie is the most unpopular GOP candidate tested, with 73% holding an unfavorable view of him.

The image of former Vice President Mike Pence, who turned aside Trump’s request to block Congress from certifying the 2020 vote, has tarnished among primary voters. In April, 54% viewed him favorably. Now, 30% view him favorably, and 63% have an unfavorable view. He’s the choice of 2% for the party nomination.

“DeSantis collapsed,” said Bocian. “The one candidate who back in April really seemed to be a potential contender, seemed to have a narrative to tell, has totally collapsed, and those votes went to Trump.” (read more)

Last point… Watch Noem

Originally the Sea Island group had a DeSantis/Noem ticket as their best outcome. Noem now looks to be positioning herself as the 2024 Mike Pence VP option.

Remember, whoever is VP in 2024 will likely be the nominee in 2028. The Big Club always plays the long game.

Stay elevated.

Stay unemotional.

Stay strategic in outlook.

McConnell will not last.  South Dakota Senator John Thune will replace him.

Thune and Noem, compatriots from South Dakota, would have a Koch inspired nudge-nudge/wink-wink outlook to undermine Trump policy agenda 2025 through 2029.

Accept things as they are, not as we would wish them to be. This is a generational battle. We didn’t get into this mess in one election cycle, and we are not going to get ourselves out of this mess in one election cycle.

This is what cozying up looks like:

Trump’s Notoriety Turns into Popularity

Armstrong Economics Blog/Politics Re-Posted Aug 28, 2023 by Martin Armstrong

Donald Trump’s notoriety is turning into increased popularity as he has become a martyr of the corrupt political system. He is receiving around-the-clock news coverage. Rallies are taking place in his favor, with a large group amassing outside the Fulton County jail that is composed of every demographic. His mugshot has been seen throughout the world and has been merchandised and sold. In many way his arrest has made him appear more civilian, instead of an elite business mogul he is now just another American battered by an unjust system.

Trump won the first GOP debate without attending as the most discussed candidate was not present. Former President Donald Trump declined the invitation to debate other GOP candidates and instead appeared on Tucker Carlson for a private interview. Trump’s interview was posted to the internet minutes before Fox aired the official debate. Trump received more views on social media than the entire primary, receiving nearly 11 million views within the first four minutes of going live. Candidates who speak unfavorably on the president lose support, as we have seen the opposite with Ramaswamy who has gained favor after proclaiming Trump was a great president. His interview has become one of the most shared videos on social media, ever, and views have surpassed that of the last Super Bowl.

Some of the most prominent historical figures amassed notoriety and popularity after prison. This has been both negative and positive, with Nelson Mandela or even Adolf Hitler as examples of leaders whose popularity spiked after being jailed. A poll by FiveThirtyEight reported by the BBC shows that Trump’s popularity is on the rise. In February, Trump held a two-point lead over Ron DeSantis (41% v 39%). Now, Trump’s support has skyrocketed to 53% while DeSantis is a distant second at 16%.

The people want Trump. The powers that be will not allow him to retake office, which will only cause increased civil unrest. So brace yourself as all hell is going to break loose come 2024.
