President Trump Lawyers File Motion for Dismissal in DC J6 Case on First Constitutional Grounds – Presidential Immunity

As expected, the first legal motion to dismiss the DC January 6 case is based on the first constitutional application, presidential immunity. [Full Filing pdf HERE]

President Trump’s attorneys John Lauro and Todd Blanche say within their first filing that special prosecutor Jack Smith’s case against President Trump is an attempt to criminalize actions that were well within his White House duties, such as enforcing federal election laws.

“The Constitution, the Supreme Court, and hundreds of years of history and tradition all make clear, the President’s motivations are not for the prosecution or this Court to decide. Rather, where, as here, the President’s actions are within the ambit of his office, he is absolutely immune from prosecution.”

It is a strong and compelling argument, citing numerous prior cases and rulings on the plenary power of the executive and the constitutional establishment of the President as the absolute power within the executive branch.   The argument hits one of three core tenets that Jack Smith has used to establish his case.

Even left-leaning Politico seems to accept the foundation of the DC Smith case weakens when contrast against the executive power of the president.

[The] prosecutors’ case is really about distinct powers that the president has: communicating with the public, organizing his administration, talking to Congress, enforcing election laws and ensuring the Constitution is faithfully executed. Whether Trump genuinely believed that the election was stolen — which his attorneys say he did — is irrelevant in assessing his immunity from prosecution, they argue.

“This conduct is manifestly part of the President’s responsibilities in our constitutional tradition, and the question whether the President has a formal role in the election certification process makes no difference,” the attorneys wrote.

[…] Trump’s attorneys say there’s an even more fundamental problem with the charges against him: He was acquitted by the Senate in an impeachment trial for similar conduct. That acquittal, they say, renders Trump “absolutely immune” from prosecution for related acts.

“The Impeachment Clauses provide that the President may be charged by indictment only in cases where the President has been impeached and convicted by trial in the Senate,” the attorneys wrote. “Here, President Trump was acquitted by the Senate for the same course of conduct.”

The Senate acquitted Trump despite a 57-43 majority favoring his conviction because of a two-thirds requirement in the Constitution. At the time, Trump was charged with one count — inciting insurrection — related to his speech to a rally crowd that later became the mob that stormed the Capitol on Jan. 6, 2021. The impeachment trial came just a month after the attack — and shortly after Trump had left office. (link)

President Trump Responds to Question About Whether He Would Accept Nomination to Be Speaker of House…

Prior to heading into court earlier today, President Donald Trump was asked about whether he would accept a nomination to be Speaker of the House if the Republican caucus requested it.  President Trump’s response is below.  WATCH (prompted):

President Trump said he would do whatever is needed to be of interim benefit to the Republican Party and to the House leadership, as the quest for the White House continues. This guy is literally carrying the hopes of the nation, those who comprehend the status of our tenuous constitutional republic, on his shoulders.  Incredible strength.

President Trump is fighting to defend his businesses, fighting to defend his family, fighting to defend himself from malicious prosecution and lawfare, fighting to defend our nation, and fighting to return to the office of the presidency….. and yet, with all of that placed on his shoulders, he’s willing to stand in as Speaker of the House if that is what is in our nation’s best interest.

Let all of that sink in while you pray for him.  Then think of the insignificance of the gnats who would challenge him for office.

Federal IRS Contractor Arrested for Stealing and Leaking President Trump Tax Returns, Also Stole Thousands of Tax Returns from U.S. Wealthiest People

There is no way you can convince me that a federal contractor unlawfully accessing the tax filings of a sitting U.S. President does not immediately send flags throughout the IRS system.

The amount of pretending needed not to see the background of this story is off the charts.

JUSTICE – An Internal Revenue Service (IRS) consultant was charged today with disclosing tax return information without authorization.

According to court documents, Charles Littlejohn, 38, of Washington, D.C., while working at the IRS as a government contractor, stole tax return information associated with a high-ranking government official (Public Official A) and disclosed it to a news organization (News Organization 1). Littlejohn also stole tax return information for thousands of the nation’s wealthiest individuals, and disclosed this tax return information to another news organization (News Organization 2).

Littlejohn is charged with one count of unauthorized disclosure of tax returns and return information. If convicted, he faces a maximum penalty of five years in prison. (read more)

Donald Trump Is Suing Christopher Steele

News breaking from The Daily Mail reflects that President Donald Trump has filed a civil action against Orbis Business Intelligence and its founder, Christopher Steele. You will likely remember that Chris Steele wrote the infamous “Steele Dossier” that became the underpinning of the Carter Page FISA application, replacing the legally required Woods file.

Interestingly, Trump appears to be using the British court system, and laws around libel actions that are much more beneficial to the plaintiff in the U.K. There is an initial 2-day court hearing scheduled for October 16th.

(Via Daily Mail) Donald Trump is suing a former MI6 officer and the intelligence consultancy he founded, High Court records show.

The former US president is bringing a data protection claim against Orbis Business Intelligence and its founder Christopher Steele, who previously ran the Secret Intelligence Service’s Russia desk.

According to a court order published on Thursday, a two-day hearing in Mr Trump’s legal action is set to start on October 16, which is thought to be the first hearing in the claim. (more)

The layers of possibility within this lawsuit are actually much more remarkable than first review might consider.

Remember, as discovered during the Durham probe, GCHQ refused to assist the CIA and FBI in their construct of the fabricated theory about Trump-Russia.  Additionally, Steele has attempted to distance himself from the ‘dossier’ he created, implying his role was simply to affirm or verify information fed to him from Fusion GPS via Glenn Simpson and Nellie Ohr.

Plausibly, Steele could claim he simply provided information, material that was false, to Fusion GPS, not knowing what would come of it.  However, in order to take that position, he would need to swear and attest to that set of facts.  That opens questions about conversations between Steele and Glenn Simpson/Nellie Ohr about his material representations – as well as conversations between Steele and the DOJ/FBI about the same.   Names and specifics would have to be outlined in order to escape the libel.

Deposing Chris Steele would be a goldmine of information about how the construct of the narrative was put together.  Who was involved from within the U.S. government and Fusion GPS would be the obvious aspect.  Steele was represented by Adam Waldman, who was also used as an intermediary between Steele and other investigative authorities in the USA.  Waldman and former SSCI Vice Chair staffer, Dan Jones, were working together. Piercing those conversations is yet another layer to peel.

In short, in order for Chris Steele to use the defense against libel, he would have to outline who he was delivering information to, and what was the purpose of the delivery. Steele would also need to walk through each of the points made in his email construction and show origination, supportive material, efforts taken to prove or disprove and subsequent findings.  [Think of the Michael Cohen in Prague false claim as only one small example]

There’s a reason why Andrew Weissmann and Robert Mueller never went near Chris Steele during their construct of the Mueller report.  They well understood that Lawfare required plausible deniability.  This, despite the fact that on June 29, 2017, Mueller and Weissmann used the dossier for the final FISA renewal – a point missed by all except for the deepest weed walkers.

POINT missed by EVERYONE:  How could Mueller/Weissmann use the Steele dossier for a FISA renewal, and then say Chris Steele was, “outside their purview“?

I think there would be a lot of pro-bono research aides who would love to work on this lawsuit.  Just sayin’…

President Trump was interviewed by NewsMax at the conclusion of his speech to union and trade workers in Michigan.  {Direct Rumble Link Here} The impromptu interview covers a wide variety of topics and includes Trump’s pragmatic advice to the UAW leadership about their contract request.

As President Trump aptly notes, the Biden Green New Deal vehicle mandate for 100% electric vehicles within ten years, will collapse the U.S. auto industry.  It really doesn’t matter how much the union leadership demands for a pay scale, when the job itself will be wiped out.   Other points of pragmatic common sense are throughout this interview, and it is refreshing to hear Trump talk about optimal solutions to big challenges.  WATCH:

BREAKING: Activist DC District Judge Tanya Chutkan Refuses to Step Down from Trump Case in Washington DC

This was not unexpected.  For Chutkan to recuse herself she would have to admit “bias.”  Judge Chutkan denies she carries bias, ergo she refuses to recuse herself from the Trump prosecution.  [SEE Ruling HERE]

While she worked for Boies Schiller, her firm represented Glenn Simpson and Fusion GPS against Congress.  {Go Deep} Additionally, Boies Schiller was representing Hunter Biden in his legal defense.  Chutkan is enmeshed in the original Russiagate storyline and the later developing Hunter Biden storyline, in addition to her activist work against the J6 defendants.

Eloquence in litigation is an art form.  Court motions and pleading that blend eloquence with deliberate and diplomatic snark are masterpieces.  Thus, the exceptional nature of President Trump’s response motion to the demands of a gag order by Special Counsel Jack Smith is a master class in linguistic evisceration.  I stand impressed.

As some, perhaps more than a few readers here will remember, I have studied the written motions of one specific DC litigator enough to detect his presence, form and style.  Please do yourself a favor and read the 25-page response motion HERE and raise a glass.

I am not a lawyer, and I did not stay at a Holiday Inn last night.  However, I have spent thousands of hours reading court filings, and one specific style of writing is very familiar to me.  If this is not from the ghost pen of Eric Dubelier, then whoever did write it has trained his/her argumentative intellect on the same turf.

President Trump Widens Lead Over Joe Biden – GOP Field Not Even Close

There are a few interesting aspects about this Harris/Messenger poll [DATA HERE] that merit some discussion. First, the poll itself is a large sample size with solid cross tabs and demographics. This is not a media poll.

Second, the sample of independent voters is slightly less than norm. That means the actual reality of the Trump -vs- Biden portion of the poll is better than the result that is reflected. Independants increasingly favor Donald Trump. That said, this poll affirms previous recent polling showing that Trump is widening his lead amid all of the key demographics that matter. All good news for team Trump.

The poll, taken September 13-19 among 3,015 registered voters, found that Trump led Biden, 46%-41%. The margin of error was plus or minus 1.8 percentage points. (link)

On the Republican primary it’s not even close, and even more people are starting to wonder now why any challenger remains in the race.  With a clear party frontrunner this far ahead, all of the gnat challengers are simply hurting themselves. The longer this continues the more diminished their influence.

The donors and billionaires have come to the same conclusion, as shared in a rather lengthy NBC report yesterday. It’s not the campaigns. It’s not the consultants. It’s not the candidates….  It’s the voters.  The formidable scale of the MAGA base voter has just worn down the Republican Party apparatus.

[Via NBC] – […] There is no major anti-Trump super PAC or significant donor financing a push to topple him as the party’s leader, and there is concern that, at this point, spending financial or political capital to undercut Trump is a fool’s errand. 

In fact, the two major outside political organizations running ads urging voters to move away from Trump have so far not lived up to the mass anti-Trump spending campaign that some in the party had hoped for. 

Five months out from the primary here, the anti-Trump effort is fragmented and weakened as no other Republican presidential candidate is able to even come close to the former president in the polls, despite his legal troubles. 

And it’s not just South Carolina. Nationally, the hypothetical anti-Trump cavalry within the Republican Party has yet to materialize, and GOP strategists tell NBC News that it may be too late. 

Even when a conservative group does try to hit Trump, it’s often nothing more than a glancing blow and focused on concerns about his ability to beat President Joe Biden. In fact, one spot this summer from one of those groups started with a voter saying, “I love Donald Trump.” (more)
