I have previously warned that this hatred of Donald Trump is absolutely destroying our nation. Special counsel Jack Smith disclosed in court filings that he retrieved data from former President Donald Trump‘s smartphone and intends to use it in the trial. This is just astonishing. Smith has revealed that he extracted data from Trump‘s smartphone, showing he has no regard for the established precedent of Presidential Immunity in such aspects. This has crossed the Rubicon. Smith has obliterated executive privilege, establishing a precedent that will have an unimaginable chilling effect on future administrations.

Nobody will be willing to provide any candid advice to the President from here on out. Whatever they recommend will now be open to the world, jeopardizing national security. I find it unbelievable that this guy goes after Trump for having classified documents and has reviewed them himself when the whole argument is that unauthorized people could have gotten a hold of them. This sets a very highly destructive precedent for the presidency. This means all private communications between Biden and all his family members can be seized and made public.

This seriously undermines the president’s ability to get his constitutionally protected, confidential, and candid advice from his advisers that threatens National Security. Smith has trashed the very idea of presidential immunity all for allegedly interfering in the 2020 election and inciting the Capitol riot. Smith is destroying the very foundation of the United States, all for his personal vengeance to prevent Trump from ever becoming president. This is the same guy who wanted a gag order on Trump so that he could not “criticize” Biden when he was running against him. Smith is burning down the barn to get Trump as President Herbert Hoover wrote in his memoirs:

High Court Drama – 19 States File Brief With Supreme Court Supporting Donald Trump Immunity Decision, Jack Smith Files Response

President Trump has asked the Supreme Court to allow the legal arguments with presidential immunity to follow the traditional path through the appeals court [pdf court filing].  Special Prosecutor Jack Smith wants to sidestep the appeals court and go directly to the Supreme Court for resolution.

As noted by Politico, President Trump’s lawyers “repeatedly warning the justices to avoid “haste,” Trump’s lawyers skewered Smith for taking extraordinary steps to preserve the March 4, 2024, trial date without detailing why taking the case to a jury just over two months from now is so critical.”  In essence, Jack Smith is trying to force a fast trial on schedule to gain maximum interference with the GOP primary election, while Trump’s lawyers are calling him out for it.

Jack Smith filed a response to the Trump filing, again reasserting, “the public interest in a prompt resolution of this case favors an immediate, definitive decision by this court. The charges here are of the utmost gravity. This case involves — for the first time in our nation’s history — criminal charges against a former president based on his actions while in office. And not just any actions: alleged acts to perpetuate himself in power by frustrating the constitutionally prescribed process for certifying the lawful winner of an election,” wrote Mr. Smith. “The nation has a compelling interest in a decision.”

Smith is worried the appeals court arguments and final decision will extend beyond the 2024 term of the Supreme Court, setting up a lengthy continuation of the DC case against Trump into October and November of 2024.   Trump’s team is saying the issues before the court are unprecedented and careful deliberation is needed.

Until 19 days ago, no court had ever addressed whether immunity from such prosecution exists. To this day, no appellate court has addressed it. The question stands among the most complex, intricate, and momentous issues that this Court will be called on to decide.

This Court’s ordinary review procedures will allow the D.C. Circuit to address this appeal in the first instance, thus granting this Court the benefit of an appellate court’s prior consideration of these historic topics and performing the traditional winnowing function that this Court has long preferred. Indeed, the D.C. Circuit has already granted highly expedited review of President Trump’s appeal over President Trump’s opposition, with briefing to be concluded by January 2, 2024, and oral argument scheduled for January 9, 2024.

The Special Counsel urges this Court to bypass those ordinary procedures, including the longstanding preference for prior consideration by at least one court of appeals, and rush to decide the issues with reckless abandon. Making matters more complex for the high court to review, former Attorney General Edwin Meese III and law professors Steven G Calabresi and Gary S Lawson have filed a briefing as Amici Curiae (friend of the court, not connected to either party), [pdf HERE] challenging the legitimacy of the Biden appointed special counsel, Jack Smith.

Regardless of whether the Supreme Court wants to weigh in on these issues, they are going to have to respond. This is in addition to the Supreme Court ultimately having to determine how the insufferable Colorado lawfare ruling is going to stand.

The Robert’s led supreme court does not like issues involving the political dynamic; however, on these two issues they are likely going to have to choose. If they deny the Jack Smith request, the trial of Donald Trump could be delayed until the resolution of presidential immunity ultimately reaches them (after appellate court review). However, there is a strong possibility the appeals court will side with President Trump, and the appeal to SCOTUS will then come from Jack Smith.

Special Counsel Jack Smith Asks Supreme Court to Decide Trump Immunity – Highest Court Immediately Drops All Business to Comply With Special Counsel Request

After years of assembling datapoints around the potential for the Supreme Court to be compromised, it was the discovery of Mary McCord’s husband Sheldon Snook deep in the office of Chief Justice John Roberts that finally sealed the deal for me personally.  Yes, the Supreme Court is compromised.

Quick Context. Mary McCord was the architect of all Trump targeting efforts. The FISA on Carter Page, the weaponization of the DOJ-NSD, the installation of Michael Atkinson as Intelligence Community Inspector General (ICIG), the companion to Sally Yates in the Flynn targeting, lead staff for the Schiff/Nadler impeachment effort, later appointment by FISA Presiding Judge Boasberg to be amicus to the FISC, in combination with Chief Justice John Roberts holding authority over the FISC, and the discovery that Sheldon Snook, McCord’s husband works in Robert’s office as “special assistant to Chief Justice John G. Roberts Jr.’s counselor. The counselor’s office advises the chief justice not only on the management and budget of the Supreme Court but also on his interactions with the executive and legislative branches, along with numerous other public roles in which Roberts serves.” (link)

Mary McCord is the fulcrum point for all of the above issues.  She connects all of the targeting operations.  Mary McCord is the center of it, and John Robert’s office is compromised by the appointment of her husband Sheldon Snook.  So, this story below does not surprise me.

Special Prosecutor Jack Smith jumped over the appeals court and asked the Supreme Court to decide on President Trump’s position of presidential immunity for his requests to secure the integrity of the 2020 election while in office.   In the fastest turn around time in history, the Supreme Court [Robert’s office] said yes, they will hear the arguments.

WASHINGTON DC – Special counsel Jack Smith is urging the Supreme Court to urgently resolve Donald Trump’s claim that he’s immune from prosecution for charges related to his bid to subvert the 2020 election.

Without the Supreme Court’s swift intervention, Trump’s trial could be indefinitely delayed, the special counsel warned in a petition to the high court on Monday.

That’s because the trial, scheduled to begin March 4, is effectively suspended while Trump pursues his appeal of the trial judge’s ruling rejecting his immunity arguments, Smith wrote. Resolution of the novel legal question is necessary to ensure the case proceeds “promptly,” he argued.

By coming directly to the Supreme Court, Smith is hoping to bypass a federal appeals court and is mounting an aggressive bid to keep the timing of the election-focused trial on track. If the March 4 trial date sticks, it would be the first trial for Trump in the four criminal cases he is facing as he mounts a bid for re-election to the White House.

There’s your inflection point timeframe.

The executive branch wants Trump on trial by Super Tuesday, March 5th the main primary election date.   The legislative branch wants to extend warrantless surveillance, the mechanism to exploit the Trump supporter targeting operation, through April 19th. [Patriots Day ]

There’s the 2024 detonation timeframe, between March and mid-April.
