President Trump Participates in Working Dinner With New Prime Minister of Australia Scott Morrison…

After landing in Osaka, Japan, for the G20 Summit that begins tomorrow (tonight EDT), President Trump and the U.S. delegation have dinner with Australia’s newly elected Prime Minister Scott Morrison.  [Video and Transcript]

[Transcript] PRESIDENT TRUMP: Hello everybody. I hope you all had a nice flight — those that came with me. (Laughter.) It’s very nice to have dinner.

And, really, I want to congratulate the Prime Minister on a tremendous victory. He had a fantastic victory, as you know. He didn’t surprise me, but he surprised a lot of other people. See, I knew him, so I said, “He’s going to do very well.” And he did. He did. They called it an upset, but I don’t call it an upset. You probably didn’t. Your wife didn’t call it an upset. (Laughter.) But I want to congratulate you very much. It’s a fantastic thing you did.

PRIME MINISTER MORRISON: Well, thank you, Mr. President. And thanks for hosting us here tonight. It’s going to be an important few days. But there’s no better or stronger or deeper relationship than the United States and Australia.

As you said, we’ve been together for a very long time — 100 years — as our ambassadors have been involved in that program in the United States of fighting together but working together. And the achievements speak for themselves.

PRESIDENT TRUMP: That’s exactly right.

Q Mr. President, are you coming to Melbourne for the President’s Cup Golf?

PRESIDENT TRUMP: I’ll tell you what: I’d like to. (Laughter.)

PRIME MINISTER MORRISON: There’s a warm invitation. It’s standing.

PRESIDENT TRUMP: It might not be easy, but I’d like to. (Laughter.) That’s a big deal. That’s going to be great. That’s going to be great.

Q Mr. President, you talk about “America first” a lot. Do you recognize that, for many of your allies, sometimes it’s seen as “America alone” because it has adverse impacts on countries like Japan and Australia — like on trade, for example?

PRESIDENT TRUMP: Yeah, well, I think I can say very easily that we’ve been very good to our allies. We work with our allies. We take care of our allies. Generally speaking, I’ve inherited massive trade deficits with our allies. And we even help our allies militarily.

So we do look at ourselves, and we look at ourselves, I think, more positively than ever before. But we also look at our allies. And I think Australia is a good example. We’ve worked together very closely – – just recently, on a big trade situation. We had a little bit of a trade deal going, and it worked out very well for both of us.

And I think especially when it comes to those great allies, and Australia would be right there. We’re very proud of it. It’s one of our oldest and one of our best. We were just talking about the battles that we fought together. These are big-name battles, and they were tough battles, and we won every one of them.

So, it’s great to be with you.

PRIME MINISTER MORRISON: Thank you very much.

Ridiculous – Supreme Court Punts on Census Citizenship Question – Sending Issue Back to Commerce Dept….

The legacy of Supreme Court Chief Justice John Roberts is a legacy of abject shame. Today the Supreme Court ruled 5-4 to send the issue of a citizenship question on the 2020 Census back to the Commerce Department.   The justices did not decide the question was unconstitutional, quite the opposite, they indicated the question was entirely up to the Dept. of Commerce, but disputed the motive behind the Commerce dept. position.

The court holds that addition of question about citizenship to 2020 census does notviolate Constitution’s enumerations clause or the Census Act, but that district court was warranted in remanding case to Department of Commerce to provide a non-pretextual explanation for adding the question.

The majority of the Court, with Roberts concurring, punted the issue back to Commerce by noting esoteric concerns about the motives behind the administrative procedure for adding the question.  In essence, Secretary Wilbur Ross can add the question, but his current motive for adding the question was rebuked.  Yes, this is ridiculous.  Hence, the punt.

“The evidence showed,” Roberts wrote, that Ross “was determined to reinstate a citizenship question from the time he entered office; instructed his staff to make it happen; waited while Commerce officials explored whether another agency would request census-based citizenship data; subsequently contacted the Attorney General himself to ask if DOJ would make the request; and adopted the Voting Rights Act rationale late in the process.”

Roberts acknowledged that courts should be “deferential” when reviewing an agency’s action, but he countered – citing Judge Henry Friendly, for whom he clerked on the U.S. Court of Appeals for the 2nd Circuit – that “we are not required to exhibit a naiveté from which ordinary citizens are free.” And here, when “the evidence tells a story that does not match the explanation the Secretary gave for his decision,” judicial review calls for “something better than the explanation offered for the action taken in this case.” “In these unusual circumstances,” Roberts concluded, the district court was therefore correct to send the case back to the Department of Commerce for it to provide a better explanation. (read more)

President Trump responded with a few tweets, noting how ridiculous the ruling was – And Trump is entirely correct:

Common sense would tell you, if there’s no constitutional issue with adding the citizenship question to the 2020 Census, then the issue of the Commerce Department motive behind the question is moot.   It is constitutionally permissible to ask the question, meaning it is legal, and therefore FULL STOP.

Commerce Secretary Wilbur Ross can have any motive for adding the question, the court only disagreed with the context of the current motive saying there was a disconnect in the commerce department reasoning.

To me it looks like Chief Justice Roberts wanted to split the baby:  yes, the question is constitutional and therefore legally permissible; however, the court will block the actual implementation by running out the clock based on a repudiation of irrelevant motive.

As to why Justice Roberts is a manipulative political weasel within the High Court, consider this:

In the Obamacare decision Roberts dismissed the motive issue where the government claimed the originating legislation for the healthcare mandate was a “Fee” not a tax; and Roberts manufactured the mandate argument into a “Tax” to support the mandate. In essence Roberts completely ignored the motive of the government lying about the architecture of the Obamacare payment mechanism in order for the court to support the unconstitutional mandate.

In Obamacare, the government motive was irrelevant to Roberts, so long as his court could re-write the architecture (an unconstitutional  ‘fee’ became a constitutional ‘tax’) to grant constitutionality for the unconstitutional foundation of Obamacare.

However, in the Census citizenship question… government motives are now, apparently, everything that matters.  In a reverse of his prior Obamacare logic, Roberts is using the motive of the government to thwart a completely constitutional administrative procedure.

See the weasel?

In the previous case Roberts ignored motive so that the court could turn an unconstitutional law into a constitutional court decision. In this case Roberts demands motive to turn a constitutional regulation into a court decision to block implementation.

I’ll bet this jerk is a member of Lawfare.

Secretary Ross Discusses China Issues Ahead of G20 Summit…

In the dynamic of President Trump confronting Chairman Xi over Chinese trade and manufacturing practices there are critical members of the U.S. team, each with a role to play.  Commerce Secretary Wilbur Ross, U.S. Trade Rep. Robert Lighthizer and U.S. Treasury Secretary Steven Mnuchin are the most important members.

Secretary Ross explains the position of the U.S. team as they head to the G20. WATCH:

As we discussed yesterday, Chinese anxiety is off-the-charts.  When China gets into this high-anxiety disposition, they immediately -predictably- drop the Panda mask, and lash-out with Red Dragon antagonisms.  This is happening right now.

“There are some inappropriate activities underway by the Chinese. They must cease. If they do, if we make some redressing of the trade imbalance, then that’s a reasonable deal for both parties.”  ~ Secretary Wilbur Ross

In previous administrations the economic/trade teams were filled with think-tank wonks and esoteric public officials.   Their response to the Red Dragon was always from a position of inherent fear combined with political evaluations.  This is the historic frame-of-reference for Beijing, a view of inherent weakness.  This history also contributes to why China is perplexed by the Trump administration.

In the Trump administration the economic/trade teams are directed by dragon-slayers from the private sector.  Business giants, billionaires, who are familiar with the granular details of negotiation and comfortable with adversarial battles where billions of dollars can make or break a deal.  There is no position of structural fear or political ramification at the apex level of business dealing.  The fights are on the merits of the position(s).

As President Trump has moved from negotiation to confrontation, Beijing’s leadership is starting to realize their opponent isn’t their typical weak U.S. government negotiators; nor is it the U.S. Chamber of Commerce who will cut the ‘deal’ for their Wall Street clients and DC lobbyists regardless of Main Street’s best interests.

As a direct consequence, the team around Chairman Xi have a much more difficult time trying to outwit the U.S. delegation.   President Trump has brought “killers” from the U.S. corporate and business community, into the battle – to fight on behalf of America.

Brilliant Play – President Trump Invites U.S. Women’s Soccer Team to White House “Win or Lose”…

Megan Rapinoe is the co-captain of the U.S. women’s national soccer team and a rabid hater of President Trump.  Ms. Rapinoe refuses to sing the U.S. national anthem; kneels during ceremonies to make her hatred for America visible; and grabs every microphone to tell the media about her politics in an effort to increase her resistance credentials.

The age-old axiom is: ‘be careful what you wish for, because you just might get it”. Today, President Trump brilliantly responded to Ms. Rapinoe.  First, by calling out her arrogance in declaring victory before she even played the World Cup matches; and secondly, by inviting the entire team to the White House “win or lose”.

The pressure is now upon Ms. Rapinoe. That pressure overlays a preexisting, unstable and tenuous psychological condition related to her tribal self-identification and commercial aspirations. This dynamic is a recipe for implosion. It will not end well for her.

President Trump calls in to Maria Bartiromo for an extensive interview on multiple subjects.  The president discusses his perspective on Mueller testifying; the state of the economy; the upcoming G20 talks with Chinese Chairman Xi Jinping and the status of the trade negotiations; the status of tariffs; and the U.S-Mexico border issues.

On China, President Trump doesn’t sound like he’s willing to make any concessions or retreat on any tariffs.  “They want to make a deal more than I do”, he said.
