Jack Smith Lawfare Strategist, Andrew Weissmann, Apoplectic at Immunity Decision – The President IS The Executive Branch

The tip of the Lawfare spear consists of a small group of former DOJ attorneys and Main Justice leftists who helped AG Eric Holder create the DOJ National Security Division (DOJ-NSD) when it was formed on behalf of President Obama.

Lawfare, writ large, are a tribe of leftists who strategically weaponize the justice systems within the DOJ.  They are also the main guides, strategists and legal analysts who previously used Robert Mueller and currently use Jack Smith.

The tribe is led by a trio of fellow travelers: Mary McCord, Norm Eisen and Andrew Weissmann.

If you research the group, you will discover that Mary McCord sits at the center of every attack approach deployed against President Trump {CITATION}.  The influence of McCord cannot be overstated, while gender fluid leftists like Eisen, Weissmann (and others), wax philosophically about which statutes can be twisted and interpreted to assist their Lawfare strategy du jour.

Everything we have watched unfold, from using “The Logan Act” against Michael Flynn, to using “The Insurrection Act” against President Trump and the J-6 targets, comes from this small crew of effeminate leftists.

The similarity of the Lawfare behavioral proclivities is an outcome of their tribal synchronicity.  Much like the McClintock or Wellesley effect, when you isolate Lawfare individuals into a small tribe, their collective behaviors replicate.

This crew of Brookings funded Lawfare ideologues was also described by Christine Blasey-Ford as her “Beach Friends.”  Since leaving official government positions, the key trio of leadership congregate professionally on MSNBC and feed the leftists in media and politics from their primary cable outlet.

I noted, during a recent flight filled with DC bureaucrats and IC officials (United Airlines), how they all watched MSNBC on their seat monitors as if it was a religious service that needed to be attended.  It really was a sight to see.  Every bureaucrat, active or retired, seated with their laptop under the headrest monitor while typing, texting and DM’ing in unison like synchronized swimmers.

That experience was the first time I realized how the term “NPC’s” or non-Player Characters might have originated as a meme, but the label was eerily accurate.

The alarming aspect to the tribal Lawfare approach, is to realize how this essentially very small group of former DOJ-NSD lawyers commands such an oversized influence on our national politics.

In reality, this crew is likely less than 20 full-time characters with about a half-dozen lawyers used as spokespeople.  Essentially, the public voice to keep the hardcore leftists on the optimal message.  However, this group also writes the legal strategies for all of the attack approaches used in Atlanta, Georgia (Fani Willis), New York (Alvin Bragg) and DC/FL with Special Counsel Jack Smith.

Within Main Justice, it is Deputy AG Lisa Monaco who takes the Lawfare instructions from the outside group and funnels them back into actionable work within the DOJ (ie to Jack Smith).  It’s a similar process as to how the inside and outside group coordinated and used Robert Mueller.

Andrew Weissmann, Mary McCord and Norm Eisen (with occasional guests), can be seen daily watching very closely how their legal briefs, citations and structured legal motions are being used.   Yes, it is their written words, their legal briefs, and their filings that are signed by the government officials and submitted into multiple judicial venues.

[NOTE: FOIA or subpoena the Lawfare communication pipeline, and you end up with 15 iPhones that mysteriously and identically have the wrong password entered 10 times, and that deletes all the content – just like the last time someone tried with the Lawfare group around Mueller {citation}.]

♦ Well, that’s who they are…. So, we cannot say we don’t know the exact names of the people at the epicenter of the operation, and you do not need to read the proverbial overuse of the word “they” without knowing exactly who they are.

With the Supreme Court ruling yesterday on presidential immunity, the Lawfare group is absolutely apoplectic and fraught with anxiety about it.

Why?

Why this much extreme vitriol?

The answer is very simple.  Andrew Weissmann speaks about the exact reason in this soundbite.  Listen at the 01:37 point, when Weissmann says the ruling now puts the President in charge of the DOJ-NSD.  THAT reality is beyond alarming to a group who have lived in a world where they were untouchable.  WATCH:

What exactly is the background here?

This is where CTH readers are miles ahead, at least a year ahead, of where the reality of this story will eventually end up.  Andrew Weissmann is concerned because the Supreme Court just put the DOJ-NSD back into a box where they are accountable within the Executive Branch.

Remember, Barack Obama and Eric Holder created the DOJ-NSD using the authorities granted to the administrative state by the bureaucracy following 9/11.  Specifically, because the Dept of Homeland Security (DHS) was created, and within that dynamic the Office of the Director of National Intelligence (DNI) was established.   DHS would now be the weaponized umbrella organization, and the power granted to the DNI would establish the need for the DOJ-NSD.

In the era shortly after 9/11, the DC national security apparatus was constructed to preserve continuity of government and simultaneously view all Americans as potential threats.  The Department of Homeland Security (DHS) and the Office of the Director of National Intelligence (ODNI) were created specifically for this purpose.

What Barack Obama and Eric Holder did with that new construct was refine the internal targeting mechanisms, so that only their ideological opposition became the target of the new national security system.  This is very important to understand as you dig deeper.

Washington DC created the modern national security apparatus immediately and hurriedly after 9/11/01.  DHS came along in 2002, and within the Intelligence Reform and Terrorism Prevention Act of 2004 the ODNI was formed.  When Barack Obama and Eric Holder arrived a few years later, those newly formed institutions were viewed as opportunities to create a very specific national security apparatus that would focus almost exclusively against their political opposition.

Eric Holder created the DOJ-National Security Division for exactly the purpose of weaponizing the DOJ to target their political opposition.  This is what the DOJ-NSD does under the auspices of “National Security.”  The FARA violation monitoring is one of the more well-known operations within the DOJ-NSD, and from that construct you find the original justification for the NSA database monitoring.

The surveillance of Americans shifted around the roles and responsibilities within Main Justice after the DOJ-NSD was created.  The National Security Division took over Foreign Agent Registration Act monitoring as well as FISA.  Both FARA and FISA required some form of downstream surveillance within the authority of the NSD.

The FBI counterintelligence division became the investigative offshoot to assist the NSD, and due to the tightrope of legal compliance issues, lawyers from the NSD were dispatched into the FBI to give legal assistance on the surveillance side.  This is how NSD lawyers like Lisa Page, Tashina Guahar and Kevin Clinesmith end up encircling FBI officials like Peter Strzok and Andrew McCabe.

Within this newly created DOJ-NSD, there was no inspector general oversight, so the internal officials were unaccountable, had no reason to worry about anyone looking at them, and they were generally running amok. In 2015 the Office of the DOJ Inspector General requested oversight, and it was Deputy AG Sally Yates who responded with a lengthy 58-page legal explanation saying, essentially, ‘nope – not allowed.’ (PDF HERE) All of the DOJ is subject to oversight, except the NSD.

We discover just how ridiculous and partisan the NSD became through the outcomes of the Hillary Clinton investigation.  The Clinton investigation was operated by the FBI and the unaccountable DOJ-NSD.

Yesterday, in a stunning opinion that destabilized the Lawfare ideologues, the Supreme Court affirmed the Unitary Executive principle around the constitution.

The 6-3 opinion held that the President is “a person alone who comprises a branch of government.”  This is important to understand. The Executive Branch is the President.

To start, the court wrote about powers that carry with them core, absolute immunity, the exercise of which cannot come under question in any forum. It specifically identified:

Pardons

Recognition of foreign governments

Removal of executive branch officials.

If it can’t be questioned . . . It also cannot be the grounds for impeachment, can it?

Let’s repeat: If it’s a core power, the exercise of the core power cannot be grounds for impeachment (*except if done in connection with taking a bribe).

In his first term, there was the threat that if President Trump fired . . .

That he would be prosecuted for obstruction of justice or impeached.

That threat is forever off the table now.

He can fire anyone he likes in the executive branch. The straightjacket is gone.

On that point, further, the majority opinion uses strong language consistent with the Unitary Executive theory of the Constitution. The President is “a person alone who comprises a branch of government.”

While there are areas of shared constitutional responsibility, the core powers of the Executive Branch, including personnel, are the President’s alone.

While impeachment is a political process within the Legislative Branch, and the Supreme Court is extremely hesitant to overstep their role therein, they did put this sentiment clearly into the opinion about immunity: …“The President is not above the law. But Congress may not criminalize the President’s conduct in carrying out the responsibilities of the Executive Branch under the Constitution.”…

Congress may not criminalize the conduct of the President simply for carrying out his core executive branch duties.  Removal of Executive Branch officials is a core duty, an official act, carrying absolute immunity.

That newly affirmed reality is exactly why Andrew Weissmann and the Lawfare crowd are very alarmed.

There is rising speculation over whether prosecutors in Donald Trump’s classified documents case, Jack Smith, will attempt to have presiding Judge Aileen Cannon recused (removed) from the trial after she granted the defense access to certain unredacted classified papers. Smith wants to deny Trump any knowledge of who will testify against him. This is typical of an unethical prosecutor who manipulates judges and courts to ensure they always win and keep the highest conviction rate in the world, along with the 500% greater chance you will go to prison in the USA rather than China.

In my case, after Republic National Bank pled guilty with a deal to return all the money they stole and make all my clients whole with the promise nobody in the bank would ever go to prison, as always in New York, I filed a motion before Judge McKenna which was to compel the government to explain what were the charges since in a reverse proffer session they finally admitted I stole no money. I represented myself because they had taken my lawyers away with another parallel civil court. I filed this motion to compel the government to explain just the theory of the case. They argued this was a pro se brief, and the court could not expect them to answer because I did not know the law to defend myself. I then moved to dismiss the case since if I did not know the law to defend myself; then I could not have knowingly violated the law. Judge McKenna smiled and asked the government if they would not answer my motion now.

Since they had no answer, they went to the Chief Judge, had my case removed from Judge McKenna, and reassigned it to Judge Keenan, who instantly denied that motion. This is how these prosecutors act. The Constitution, law, due process, nothing matters to them. They MUST retain their perfect conviction rate. Jack Smith is now widely expected to pull the same maneuver. We will see if the Florida Federal Court is as corrupt as New York. Just for the record, they should have made a motion to recuse before Judge McKenna, to which I should have had the due process right to object. That was denied by the back-room deal with the Chief Judge, and then, as you can see, they sealed the records, so I cannot even see how they removed the judge.

Judge Keenan, a former prosecutor, should also have had a hearing to allow me to object to this back-room deal – he did not.  The bankers told the government I had to be shut down because they were losing money in their manipulations. I had forecast that Russia would collapse in June 1998 within about 30 days. That was the collapse of the Long-Term Capital Management.

Even Edmond Safra, the owner of Republic National Bank, lost over $1 billion, so I believe he stole the funds from me and told the government he had no idea where the money was. All you had to do was go down the list of all the big players who lost billions, for they assumed if they ganged up together, they could manipulate the world. Just look at who had all loses on the same trade, and that is the evidence that they are “the club,” as I call it; they do not compete against each other but join together. If they were manufacturing cars, they would be charged under the Sherman Anti-Trust Act statutes and broken up like AT&T, etc.

When I asked a NY Lawyer why bankers are never charged? He said: “You don’t shit where you eat.“The prosecutors were so bought that no rational person would ever believe $1 billion left a bank, and they had no idea where it was. There would be a wire transfer, a check written – something! There was nothing. They could not be that stupid. This was all about shutting down my First Amendment rights and stopping the forecasting.

It became obvious when Judge Keenan dared to publicly claim I stole the idea for the ECM from the 1998 Movie Pi. They could care less about even facts when they alleged I was dealing in Japan back in 1992. I suppose I used a time machine as well. It was the forecasting they were desperately trying to discredit at all costs to support the bankers manipulating the markets and blowing up the world economy every time.

The Southern District of NY court is beyond all hope – it’s too corrupt. Judges commit felonies all the time, and they alter the transcripts, changing the very words spoken in court. The Second Circuit Court of Appeals dared to claim they lacked the power to order judges to obey the law – see US v ZICHETTELLO id/97. I argued since time means nothing and they can change the words spoken in court, they might as well say I confessed to killing JFK while they were at it and just order the death penalty since trials are a nuisance anyway. Stalin executed Kondratieff because he said there was a cycle and communism would collapse as well. He was taken from court when they ran out of reasons to imprison him and just shot him in the parking lot.

Trump does not stand a chance of winning in New York City. I have never seen the courts there EVER provide a fair trial to anyone! There is a higher probability that it will snow in Hell before Trump ever gets a fair trial in New York City. We are NOW about to see if the Florida courts are as corrupt as New York. Jack Smith will try a backroom deal and say the President needs this. Tuesday, Judge Cannon ruled in favor of Trump, stating the filing from Jack Smith:

fails to identify the information at issue, provide any explanation about the nature of the investigation, or explain how disclosure of the code name would prejudice or jeopardize the integrity of the separate investigation (assuming it remains ongoing).

With each passing day, this corruption is becoming so bad that the only solution becomes separation of the United States, particularly in light of the Biden Administration seeking a total dictatorship over Texas, tearing up the constitution and nullifying all State’s rights, which the Founding Fathers swore that day would NEVER come – see Federalist #46.

The Most Ridiculous Lawfare Narrative Pushed by Special Counsel Jack Smith Portends the Weakness of the Mar-a-Lago Case

I did not think it would be possible for those who deploy Lawfare to ever exceed the scale of fakery around Witness #8, Rachel Jeantel.  However, there is an irony in this latest Lawfare deployment being pushed by Jonathan Karl and ABC news; because it was also ABC News, via Matt Gutman, who originally pushed the completely fabricated Trayvon Martin ‘ear witness’.

Before getting to the details of the construct, I must point out two issues.  First, this specific narrative, as pushed by a supposed leak from Special Counsel Jack Smith’s prosecution unit, just highlights the insane weakness of the Mar-a-Lago document case and how much they will rely on legal fraud and pretense to maintain it.  This is where Judge Cannon will hopefully play a major role.

Second, I must emphasize that Lawfare in its most obvious construct is not a legal approach per se’, it is the intentional manipulation of the legal system to create the optics around information that is intended to be used by media to influence public opinion.

Just like Rachel Jeantel was never any form of witness to the events around Travon Martin and George Zimmerman, so too is this latest deployment entirely fabricated – ABC News pushing both.

As the story is pushed by ABC News, again based on leaks from Special Counsel Jack Smith, supposedly former President Trump’s Chief of Staff has told prosecutors that he does not remember any effort by President Trump about a standing objective to declassify documents.

The transparent fabrication of the story is crystal clear.  Whether ABC is playing a role of willful blind idiocy in their effort to support Jack Smith, or whether this is entirely fabricated by the news organization itself is unknown.  What is stunningly clear is that ABC is pushing a storyline that is entirely false, fake and fabricated.

Everyone -including every media outlet, pundit and journalist- knows that for four solid years President Trump intended to, tried to, and demanded the declassification of, tens of thousands of documents.  There are thousands of pundit hours and hundreds of articles written about the fight between President Trump and various agencies of government to declassify and release documents.  This is not a debatable issue.

Just type “declassify” or “declassification” into the search bar of CTH, and you will find hundreds of citations and examples of our discussion as this information and classification battle was waged.  In fact, the transparency of the ABC fraud is so clear, even Axios -while pushing another angle- would not stand with ABC in the specific framework of their lies.  As noted, “Axios has not yet verified ABC News’ reporting on Meadows.”

Much like Bill Barr, Mark Meadows is a self-interested shallow shell of a DC man, steeped in swamp life and preservation therein. We all accept this.  Yet, even with that at the forefront, there’s no way Meadows is going to be stupid enough to say he has no idea about the broad scope of President Trump’s declassification intentions.  Therefore, if this leak to ABC is legitimately based on information from Jack Smith’s team, then the Florida assembled prosecutors are big time desperate.

Additionally, and very importantly, if this is the Jack Smith prosecution approach, then we were 100% correct in our analysis and research of what the documents were in Mar-a-Lago that Main Justice was so desperate to retrieve {Go Deep}.

In broad terms, there are two sets of documents that intermingle and are directly related. First, documents that highlight the activity of Hillary Clinton’s team in creating the false Trump-Russia conspiracy theory (2015/2016).  Second, documents that highlight the activity of government officials targeting Donald Trump within the same timeframe (Crossfire Hurricane), that continued into 2017, 2018 and 2019 (Robert Mueller).

Think of the two sets of documents as evidence against two teams working in synergy.  Team one (Clinton) was outside government. Team two (DOJ/FBI) was inside government.  The documents pertain to both groups but are also divided.  That helps to explain the wording of the memo above. (more)

Also, keep in mind former DNI John Ratcliffe was at the center of the latter part of the effort to get those documents released to the public.  Deep State institutional preservation manager Bill Barr was obstructing the release and used Deep State institutional preservation manager John Durham as the investigative block.  To further protect the institutions, the FBI went on a mission to retrieve the documents. Consequently, as soon as the Durham block was going to be removed, the Jack Smith block was put into place.

James Comey, then Robert Mueller, then John Durham, now Jack Smith… these are all institutional silos -that’s one long continuum- created by the DC need to throw a bag over any document releases that would reveal the scale and scope of government corruption.

Keep in mind, as the DNI during 2020, Ratcliffe saw the documents that eventually became the material President Trump declassified and left with the DOJ to release after the Durham investigation was complete.  If Ratcliffe’s suspicions are correct, and there is more valid reason to support his suspicions than oppose them, then the entire construct of the DOJ-NSD operation was to retrieve those documents from Mar-a-Lago and maintain one big cover-up operation.

Ratcliffe suspects the documents are essentially the DOJ and FBI work products, including interviews with ‘sources’ like Igor Danchenko, from their fabricated case against President Trump.  If accurate, the objective of the DOJ/FBI would be to avoid sunlight on their political targeting operation.  This viewpoint makes sense when you consider the DOJ/FBI position was/is that no one should ever be allowed to look at those documents, including the previously appointed Special Master in the original document case, Judge Raymond Dearie.

For ABC to claim that Mark Meadows is unaware of the declassification effort, and for Axios to claim that Mike Pence says he was unaware of any effort by Trump to declassify the documents, is just abject absurdity.

If the special counsel is going to go to court and use this framework as their counter-position to President Trump claiming he declassified all the documents, then the special counsel is stunningly desperate.

Recusal? – Kash Patel Reveals Stunning Background of DC Judge Chutkan in Cases Against President Trump

Appearing with Sebastian Gorka, Kash Patel puts some excellent context on the issue of Dircuit Court Judge Chutkan presiding over the special counsel case against President Trump.  {Direct Rumble Link Here}

I was unaware of the detail where Judge Chutkan originally presided over the case when Fusion GPS tried to block Devin Nunes and Kash Patel from revealing the source of the payments for the Chriss Steele dossier.  This is a big datapoint. WATCH:

TRANSCRIPT – Kash Patel: “Judge Chutkan, for those who don’t know, represented Burisma, Hunter Biden’s fraudulent consulting firm, she was a lawyer at the same law firm with Hunter Biden. But Seb, let’s put that aside. What other matters are there for her recusal? In 2017 when Devin Nunes and I were running the Russiagate investigation, we figured out who paid for the Steele dossier. Fusion GPS, the DNC, and the Hillary Clinton campaign paid Christopher Steele millions of dollars and they laundered it through the FBI and the FISA court to unlawfully surveil Donald Trump.  That’s big-time stuff.

On the eve of us winning that disclosure, before the world knew, Fusion GPS took us to federal court and that case landed in JUDGE CHUTKAN’S COURT ROOM. … After a month of heavy litigation where Judge Chutkan knew the ins and outs of Fusion GPS, our proceedings, all possible witnesses, etc., when she could not prevent us from prevailing, she recused -on her own- from that case. Why?”

“We found out her law firm, Boies Schiller, represented Fusion GPS.  The very client that was in front of her in federal court was one of her former clients. That is rule #1 for disqualification.”

GORKA: “Boies Schiller Flexner is the same company where Chutkan and Hunter Biden worked!”

PATEL: “You gotta ask yourself, Seb, how come it took Chutkan a month [to recuse herself]? … She wanted to block the bank records.

Imagine if we never found out who paid for the dossier. … She set the precedent. She cannot neutrally and arbitrarily preside over Donald Trump’s criminal trial when she recused herself from the very representation of the Democratic entrenchment: the DNC, the Hillary Clinton campaign, Fusion GPS, because she was so biased because of her prior representation from Boies Schiller.

How could she possibly be allowed to stay on this case? And it wasn’t us, Seb. We got her off because of her own history. That precedent is what Donald Trump’s lawyers must apply this week.”

Perhaps this recusal issue is why four other district court judges including Boasberg sat in the back of the courtroom for President Trump’s appearance last week.  Perhaps the judges were proactively contemplating who would meet the DC recusal threshold.

Jack Smith Asks Court for Protection After Trump Tells Political Lobby Group and SuperPAC He Will “Go After Them” for Lying

Like most typical leftist communities, the Lawfare team are full of pearl-clutching victim lawyers once you push back against their bullying.

In the latest example, the special prosecution team of Jack Smith are typical Karen’s, asking to see the manager because the free ketchup is no longer available.

Jack Smith is asking activist U.S. District Court Judge Tanya Chutka for a protective order that would keep all the fabricated Lawfare evidence hidden from public scrutiny, review and/or ridicule.  The DOJ justification for the protective order ridiculously centers around Donald Trump snarking at the Club for Growth lobbying group and Koch Brother’s PAC about his intent to hit back at them for lying.

The Trump post to Truth Social triggered the DOJ, because projection is part of their ideology.  Lawfare is centered around lies, fabrications and false constructs – essentially the manipulation of events using Lawfare tactics.   The citation they reference has nothing to do with the DOJ case, but like typical leftist weasels, the bullies, cry foul at the slightest hint of even implied pushback.

The Trump campaign released the following statement: “The Truth post cited is the definition of political speech, and was in response to the RINO, China-loving, dishonest special interest groups and Super PACs, like the ones funded by the Koch brothers and the Club for No Growth.”

In life, I have always found the people who want to keep the conversation secret are usually not the people who are trustworthy.

Speak in private as you would speak in public, applying grandma’s rules for politeness of course, and generally speaking what follows is more genuine.

The people who need to hide evidence are not the good people.

Special Counsel Jack Smith Unseals Criminal Indictment of President Trump for Protesting Results of 2020 Election

Special Counsel Jack Smith held a press conference today following the unsealing of a federal criminal indictment alleging four counts against President Donald J Trump. [Full Indictment pdf Link]

The four alleged criminal counts are: (1) Conspiracy to defraud the U.S Government; (2) Conspiracy to Obstruct an Official Proceeding; (3) Obstruction of and Attempt to Obstruct an Official Proceeding; and (4) Conspiracy against Rights.

Interestingly, nowhere in the indictment is anything criminally alleged relating to the January 6, 2021, events at the U.S. Capitol building in Washington DC.  However, you will notice in the Lawfare delivery of the remarks, Special Counsel Jack Smith factually speaks almost exclusively of the January 6th events.

The absence of a criminal charge (ie. seditious conspiracy or insurrection) when contrast against the extreme verbal emphasis of the event as outlined by Smith in the presser, will be missed by most.  Speaking of the non-criminal event as the context for a fabricated/stretched criminal allegation, is Lawfare in action.  Why emphasize but not charge?  Because the DOJ/FBI does not want the risk of litigated discovery and evidence of coordinated government activity therein, that’s why.

Jack Smith knows he is out on a limb with his Lawfare effort to criminalize the legal and constitutional challenge to an election outcome. He is nervous, WATCH:

The brighter the sunlight falling upon government corruption and weaponization, the more those who perpetrate corruption and weaponization will have to shield against it.

At this point in history these attacks against President Donald Trump are Lawfare members sticking fingers and toes into the cracks of a justice dam that is increasingly unstable and about to collapse.  The pressure on the other side is the dam is the collective anger of We The People, and when that dam breaks no pre-positioned scuba gear is going to protect them.

Trump Superseding Indictment

This is the man who will tear the United States apart at the seams – Special Counsel Jack Smith who has filed a superseding indictment against Donald J. Trump (see above). This is not a big deal. It is simply more charges on the same theories to interfere with the 2024 election. Smith is actually violating the civil rights of everyone in the country by trying to prevent Trump from running for office.

No person, whether acting under color of law or otherwise, shall intimidate, threaten, coerce, or attempt to intimidate, threaten, or coerce any other person for the purpose of interfering with the right of such other person to vote or to vote as he may choose, or of causing such other person to vote for, or not to …

Even this aside, the real purpose of this superseding indictment is not more charges. That is just to make the headlines and hide the real purpose.  He has indicted a new defendant: Mar-a-Lago property manager Carlos De Oliveira. They cannot win a case without a co-defendant. They need someone to take the stand and perjure themselves as the prosecutor, then will rehearse them on what to say in return for no time. This is how they win CONSPIRACY cases. They desperately need a co-defendant. They threaten them with 20 years to life unless they testify for the government. They need that to prove “intent,” for otherwise, they can just infer from something. The co-defendant will get on the stand and say Trump told him x, y, z, and the jury would have to find him guilty.

For virtually every crime in this country, you are charged with CONSPIRACY, and then they threaten someone to testify against you. This is the law of tyrants. They always go for the conspiracy charge if they cannot prove a direct crime.

By doing this to Trump while ignoring everything done by Biden and his son, it is a slap in the face to all Americans, proving that there is no rule of law. It is as Thrasymacus warned Socrates who they sentenced to death – there is no justice – it is always the self-interest of those in power. Nothing has ever changed in 6,000 years.

Judge Aileen Cannon Sets DOJ Trial Date -vs- Donald Trump for May 20, 2024

There are buckets and buckets of legal contingencies in the fabricated case created by Special Counsel Jack Smith, acting on behalf of Andrew Weissmann, Barry Berke, Norm Eisen and Mary McCord, and the DOJ case against Donald J. Trump.

So many contingencies, there is almost no reason to look at any procedural process with any inclination the date will have consequence.  However, that said, Judge Aileen Cannon has smartly delayed the trial portion of the case until May 20, 2024.  [Full Legal Outline pdf]

I say smartly, because by Mid-May 2024, President Trump will likely have wrapped up the GOP nomination, and that structural reality itself will punt the rest of the gibberish into a time ever more distant.   Smart base-covering and no room for appeal move by Judge Cannon.

Some may see this as a loss or a gain for either side.  Personally, I view this as a structural and procedural win for President Trump, a wrongly targeted American citizen within a process weaponized by a comprehensively corrupt government.

Judge Cannon is no dummy. She knows the stakes, sees the transparency of the effort, and is not an ideologue.  Her earlier rulings, in the document side of the FBI raid, reflected her awareness the system was being manipulated by agents of Lawfare intent.  May 20th, which will never happen, is a good target all things considered.

President Trump Reveals Jack Smith Targeting Letter Delivered to Attorneys Sunday Night

Using twisted legal theories as advanced by the Lawfare agents behind him, special counsel Jack Smith is reportedly trying to construct criminal charges around a conspiracy to defraud the United States and obstruction of an official proceeding.

Under this stretched legal theory, President Donald Trump simply by contesting the 2020 election, is responsible for efforts to stop Congress’ certification of President Joe Biden’s presumed electoral victory.  According to the criminal approach, contesting an election result is an effort to defraud the US Government.

It seems rather odd because it is nuts.

CBS Report, Mysterious DoD Iran Attack Memo Does Not Exist and Is Not Part of Jack Smith Case Against Trump

I’m not going to say I toldyaso; I’m just smiling.

After a full media cycle of apoplexy and pearl-clutching, which included Andrew Weissmann appearing on MSNBC to declare “It’s the end of Trump,” CBS is now reporting there is no Defense Department memo about attacking Iran – the foundation of the media claims surrounding the leaked audio tapes from Special Counsel Jack Smith.

Worse still, and exactly as CTH previously outlined, despite the claims by CNN about how this audio would be used as the “central element” by the prosecution of Trump, the audio and mysterious memo are not part of the Special Counsel case.

So, why was the transcript of the audio recording used by Jack Smith in the indictment if the audio and nonexistent memo were never going to be used?  Because it’s Lawfare, that’s why.  Everything, yes including the specific language being deployed (ie “documents containing classification markings“), is hype for public consumption.

(Via CBS) – The Defense Department memo on Iran — at the heart of the now-public audio recording that captured a July 2021 meeting with former President Donald Trump — is not part of the 31 counts of willful retention of national defense information charged in special counsel Jack Smith’s indictment of the former president, a source familiar with the matter confirmed to CBS News. 

[…] The document and recording are described in the indictment Smith’s team secured against Trump earlier this month, recounted as an alleged meeting with “a writer, a publisher, and two members of” Trump’s staff, “none of whom possessed a security clearance.”  But according to a source familiar with the matter, Trump was not charged with unlawfully holding onto the Iran-related document discussed in the recording.

There never was an Iran memo document.   President Trump was discussing newspaper reports, “newspapers” and stacks of “papers”, as he originally told Brett Baier. Duh.

Reminder, in an interview with Fox News’ Bret Baier on June 19, Trump said that at the meeting with the book’s publisher, he was not referring to the document itself, but newspaper articles:

“There was no document… That was a massive amount of papers and everything else talking about Iran and other things. And it may have been held up or may not, but that was not a document. I didn’t have a document per se. There was nothing to declassify. These were newspaper stories, magazine stories and articles.”
