DHS Suspends “All Actions” On Trump Travel Ban, Reverses Visa Cancelation; Vows To Fight

In what is an almost complete reversal of Trump’s immigration executive order, which temporarily banned the entry of refugees and citizens from seven mostly Muslim nations into the US, moments ago the Department of Homeland Security announced that “in accordance with the judge’s ruling, DHS has suspended any and all actions implementing the affected sections of the Executive Order entitled, “Protecting the Nation from Foreign Terrorist Entry into the United States.” 

“This includes actions to suspend passenger system rules that flag travelers for operational action subject to the Executive Order. DHS personnel will resume inspection of travelers in accordance with standard policy procedure.”

However, keeping the defiant tone, the DHS also said that “at the earliest possible time, the Department of Justice intends to file an emergency stay of this order and defend the President’s Executive Order, which is lawful and appropriate. The Order is intended to protect the homeland and the American people, and the President has no higher duty and responsibility than to do so.”

That may be true, although at this point an “epic court battle”, including a Supreme Court showdown now appears inevitable.

Furthermore, as Reuters adds, the State Department issued a statement in which it said that the DOJ informed it of the Washington state court ruling barring the U.S. government from enforcing certain provisions of Executive Order 13769, and thus “we have reversed the provisional revocation of visas under Executive Order 13769.  Those individuals with visas that were not physically cancelled may now travel if the visa is otherwise valid.”

In other words, any travelers from the seven countries who have active visas, can once again enter the US. The department adds that it is “working closely with the Department of Homeland Security and our legal teams” and will provide “further updates as soon as information is available.”

This means that entry for citizens from the seven formerly banned nations are once again permitted, and thus they can resume boarding U.S.-bound flights, major airlines said on Saturday, after a Seattle judge blocked the executive order. As Reuters adds, the ruling gave hope to some Middle East travelers but left them unclear how long the new travel window might last. Trump denounced the judge on Twitter and said the decision would be quashed.

In the wake of Friday’s ruling, Qatar Airways was the first to say it would allow passengers from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen to resume flying to U.S. cities if they had valid documents.

Fellow Gulf carriers Etihad and Emirates said they would do the same, as did Air France, Spain’s Iberia and Germany’s Lufthansa. Officials in Lebanon and Jordan said they had received no new instructions on the issue.

U.S. Customs and Border Protection told airlines they could board travelers affected within hours of Friday’s ruling, but budget airline Norwegian, which operates transatlantic flights including from London and Oslo, said many uncertainties remained about the legal position. “It’s still very unclear,” spokeswoman Charlotte Holmbergh Jacobsson said. “We advise passengers to contact the U.S. embassy … We have to follow the U.S. rules.”

In Cairo, aviation sources said Egypt Air and other airlines had told their sales offices of Friday’s ruling and would allow people previously affected by the ban to book flights.

As a result, following the Friday ruling, travelers from affected countries are delighted, and rushing to get to the US: “Ibrahim Ghaith, a Syrian barber who fled Damascus in 2013, told Reuters in Jordan: “Today we heard that the measures may have been abolished but we are not sure if this is just talk. If they go back on the decision, people will be overjoyed.” Iraqi refugee Nizar al-Qassab told Reuters in Lebanon: “If it really has been frozen, I thank God, because my wife and children should have been in America by now.” The 52-year-old said his family had been due to travel to the United States for resettlement on Jan. 31. The trip was cancelled two days before that, and he was now waiting for a phone call from U.N. officials overseeing their case. “It’s in God’s hands,” he said.”

Two Sudanese travellers told Reuters they were trying to travel as soon as possible, fearing the ban might be reinstated.

“I’m in a race against time,” said a 31-year-old female academic who declined to be named for fear of any consequences.

“Today I face a real problem in Khartoum because the international airlines are refusing to sell me a ticket to travel for fear of contradicting the President’s decision. Now I am going from one airline company to another to convince them about the court’s decision,” she said.

A 34-year-old Sudanese engineer, who also did not want to be named, said: “After the court’s decision I am now trying to leave as fast as possible before the situation changes once more.”

The State Department said on Friday that almost 60,000 visas were suspended following Trump’s order. It was not clear whether that suspension was automatically revoked or what reception travelers with such visas might get at U.S. airports, although according to today’s State Department clarification it appears that virtually all travelers who previously had an active visa will once again be allowed into the US.

Following the latest dramatic twist in the ordeal surrounding Trump’s Immigration Executive Order, when on Friday night Seattle Federal Judge Robart (appointed by George W. Bush in 2003) blocked Trump’s travel ban from seven Muslim countries, the White House promptly responded by stating that it intends to file an emergency stay of this “outrageous order and defend the executive order of the President, which we believe is lawful and appropriate.”

Earlier, on Friday night, Washington Attorney General Bob Ferguson disagreed when he greeted Robart’s ruling saying “It is not the loudest voice that prevails on the Constitution,” and added “we are a nation of laws, not even the president can violate the Constitution. It’s our president’s duty to honor this ruling and I’ll make sure he does.”

And so, with Trump’s Executive Order now a constitutional matter and almost certainly headed to the Supreme Court, where the judicial opinion of Trump’s recent appointment Neil Gorsuch will soon be tested, on Saturday morning Trump wasted no time to attack “the opinion of so-called Judge” Robart, which Trump said “essentially takes law-enforcement away from our country” and warned the ruling “is ridiculous and will be overturned!”

He prefaced this warning for a showdown by saying that “when a country is no longer able to say who can, and who cannot , come in & out, especially for reasons of safety &.security – big trouble!” and defending his decision by invoking other Middle-eastern nations who allegedly “agree with the ban” (using a word which Sean Spicer would have preferred he did not as he will be brutalized by the press corps for it on Monday).

As expected, Trump himself was immediately attacked on social media for his “so-called” hint he disagrees with the separation of powers as per article III, section 1 of the Constitution which, as a reminder, reads: “Judicial power of the US shall be vested in the Courts.” Others have asked, rhetorically, what would happen if the situation was reversed:

Trump has lashed out at judges he disagreed with in the past as well: during last year’s presidential campaign, Trump slammed the “Mexican heritage” of Indiana-born Judge Gonzalo Curiel as a reason he should recuse himself from lawsuits regarding Trump University, a legal matter which he eventually ended up settling.

So get ready for the dramatic showdown, as the fate of Trump’s executive order is soon set to play out inside the Supreme Court of the United States.

COMMENT: Hi Marty,
I am in San Francisco (though trying to move out)….and attended WEC Orlando. In reading the blog recently there is a lot of talk about Civil War and the US breaking up. I have to tell you that the election in San Francisco was pretty much devoid of Clinton or Trump signs anywhere. There was an eerie feeling in the air – we all felt it and people commented on it. After Trump won, pretty much every democrat I spoke to told me they really wanted Bernie anyway. I even heard this walking the sidewalks and hearing bits of conversations of passersby or people speaking on cell phones. So I don’t think there was a lot of true support for Hillary, rather people voted democrat because they had always been democrats but really wanted Bernie and to vote against Trump.
Now there is San Francisco stating in the press they will sue the Federal Government and remain a sanctuary city. There is not much support for that either. The support I think comes from the employers (e.g. restaurants paying cash under the table to back of the house help etc…) but not the citizens overall here. Kate Steinle was shot and killed here which horrified everyone. That Sheriff who let the felon illegal immigrant go instead of turning him over to ICE for deportation actually tried to run again for Sheriff and was obviously defeated.
Most Californians don’t support sanctuary cities…again I think it is an alliance between employers seeking cheap labor and corrupt politicians more than anything. (See Berkley Poll). In the SF Chronicle, the articles about the City Mayor standing up to the Feds and supporting sanctuary have a Comments Section. I monitored it on and off all day yesterday. It was 99.9% negative comments against Mayor Lee for doing this.
This surprised me and I have lived here 20 years. I thought there would be at least some support – nope – zero.
My question to you is, could the coming break up of the US be similar to the rise of the third party wave that Trump rode to win inside the Republican party? Could it be the toppling of the current political establishment inside the US vs a break up of the country itself? Even the millennials here are questioning things… remember a lot of them wanted Bernie. No one really believes the press anymore… though one millennial teacher told me the left in Berkeley were the worst “control freaks” there were because she worked in a school there. So maybe the high achieving leftist are the issue and then some brainwashable young people they can whip into a frenzy… but that is not enough to do much politically.

He was also the teacher of Frederick the Great of Prussia (b 1712; 1740–1786) who he shaped into a brilliant military strategist.

Nonetheless, jealousy attached to his accomplishments and he was plagued by a rumor that he was really the illegitimate son of King Louis XIV of France, which he perpetually denied. Indeed, there is a tremendous risk of standing armies and building huge defense systems. These people naturally want to play with the toys they create. It would give them such pleasure as if this were some video game for children. Therefore, on the one hand we have the rising trend of international war. On the other hand, we have ever rising civil unrest. The treat of civil war emerges if the left were to actually topple government and attempt to usurp power. Then you will really see blood in the streets. The police and army may split and take sides. This is often how such events unfold.

In California, there has been a serious question of voter fraud with respect to Hillary. They stole a lot of votes to prevent Bernie from beating Hillary in that State. There are proposals to split the State even into 6 parts. The press is stirring up the left and ignore the supporters of Trump all over the place. The Press is conspiring against the country. They are owned by big corporations who get their marching orders to the political agenda of the owner. Once the Fairness Doctrine was repealed, the entire objectivity of the press has collapsed. You have MSNBC on one hand opposing FOX. The ratings of MSNBC crashed and now the talk is that Andy Lack wants NBC to become “the next Fox News” after he took cable stars  Greta Van Susteren and Megyn Kelly. It seems that the NBC network wants to take a more conservative tone after MSNBC ratings collapsed along with CNN. Fox News finished in first place, securing its place as the number one news network on cable, beating out CNN and MSNBC combined in both the number of total viewers and primetime viewers.

The people are fed up with media. To see CNN crash and burn demonstrates that they have become so biased and one-sided, they have lost the trust of the MAJORITY of people. The press is still fighting for the left. They also peaked. Only NBC seems to see the handwriting on the wall – things have changed!

The anti-left in California are NOT alone. The media champions only the left and that is the danger that can lead to outright civil war. Our model shows that the likelihood of civil war peaks in 2044. The risk turns up in 2020 for domestic civil war. The Democrats are rapidly becoming the party of session. Let’s be real here. It was the Democrats who were founded by Andrew Jackson and were the party for slavery and thus was the party to move to secede. Secession from the United States was accepted in eleven states and the order of secession was: South Carolina (seceded December 20, 1860), Mississippi (seceded January 9, 1861), Florida (seceded January 10, 1861), Alabama (seceded January 11, 1861), Georgia (seceded January 19, 1861), Louisiana (seceded January 26, 1861), Texas (seceded February 1, 1861), Virginia (seceded April 17, 1861), Arkansas (seceded May 6, 1861), North Carolina (seceded May 20, 1861), and Tennessee (seceded June 8, 1861).

Therefore, secession began 1860.969 and the next target would appear to be 2036.312. The would be just after the major high in 2032. This turns up in 2020 and we can see that the left is fighting for survival. Their economic dreams are collapsing exactly as did communism in 1989. Is Christianity in Decline?

Pope Francis is rather concerned about what he calls a “hemorrhage” of priests and nuns from the Catholic church. Indeed, the loss of clergy is weakening the church over the past decades. The Pope commented on how nuns and priests have just quit claiming that modern society discourages lifelong commitments as in the soaring divorce rate. He further said that people conduct their lives based on “a la carte” choices.

The decline in people attending church services is not just engulfing the Catholic church. This is a trend which is infecting Christianity as a whole, and is reflected in the Podesta emails revealed the Democrats disliked Catholics and Evangelical Christians. Hillary’s staff said Catholics are “severely backwards” and further demeaned them saying they don’t know “what the hell they’re talking about.” Then you have Democratic leader Nancy Pelosi who recently said: “They pray in church on Sunday and then prey on people the rest of the week.”

The decline of Rome coincided with the collapse in their religious beliefs during the 3rd century. Once the Emperor Valerian I was captured by the Persians from Iran in 260AD, confidence began to collapsed in the survival of the Empire. Other barbarians realized they could invade Rome for it was now weak. People turned to their gods and prayed, but nothing happened. Pagans then blamed the Christians saying the gods were offended by them and were punishing Rome because of the Christians. That led to the widespread Christian persecutions under Diocletian.

The Edict of Milan legalized Christianity in 313AD, and it later became the state religion in 380AD. These decrees ended Christian of persecution, but they also eroded the traditional Roman values system. Constantine the Great (307-337AD) championed Christianity, but for political purposes. The polytheistic Roman religion did not truly create a divine status of the Emperor as was the case in Asian culture while living. Constantine defeated the Tetrarchy set up by Diocletian arguing one God, one emperor. We can see this gold medallion pictures Constantine with the sun god Sol who was being portrayed as the invincible supreme god among pagans who always appeared each morning. This medallion demonstrates how Constantine was using religion to support there should be a single emperor not four.

Constantine began to merge religion with the emperor for political purposes. In declaring Christianity the state religion he enabled himself to rob the temples of the Pagans. That was very profitable using the funds to build his new capitol – Constantinople. Christianity by no means played any role in curbing Roman civic virtue nor did it create some religious state. The night Constantine died, his son, Constantine II was perhaps the main instigator in what has become known as the “palace massacre” during which most family members born of his step-grandmother Theodora were murdered. Christian values certainly did not change the morals of the elite within the Roman Empire.

In 212AD, universal citizenship had been granted to all freeborn inhabitants of the empire. As the economy imploded following the reign of Maximinus I (235-238AD) who simply declared all wealth belonged to the State, it was Trajan Decius (249-251AD) who enacted measures intended to restore stability and unity. Decius included a requirement that Roman citizens affirm their loyalty through religious ceremonies in 250AD. Christian citizens faced prosecution since any citizen who refused to participate in the empire-wide supplicatio was subject to the death penalty. Decius was killed in battle the following year. Therefore, this decree was short-lived and was a significant departure from previous imperial policy that Christians were not to be sought out and prosecuted as inherently disloyal. There had been freedom religion at the core of the Roman Empire. Nevertheless, even under Decius, orthodox Christians were subject to arrest only for their refusal to participate in Roman civic religion. They were not arrested for assembling to worship their own religion. This was the very beginning of the religious persecution post-Nero.

Contrary to popular belief, Christianity flourished because of the religious freedom within the Roman Empire. There were so many gods only because Rome allowed each country it conquered to retain their own religion. Following the edict of Decius, Christianity actually grew for the following four decades. This period became known among Christian scholars as the “Little Peace of the Church”, which ended when Diocletian launched the final and “Great” Persecution in 303AD.

Whether this is coincidence of not is hard to say for we do not have enough changes in religion to verify multiple turning points. Yet from the Edict of Milan in 313AD, we come to the American Civil War in 1861, which was sparked by religion. That was  5 waves of 309.6 years. The next half cycle lined up with the peak in the government 2015.8. Muhammad (c. 570–632 AD) began preaching in 610AD, which was one cycle 309.6 years from the rise of Christianity toward a major religion, which led to the start of the persecution in 303AD. Even the English Civil War, which was Protestant v Catholic, began in 1642. That was 4.3 cycles of 309.6 from 313AD or the Edit of Milan.

There appears to be a fair number of events in religion that do line up cyclically. The turn in 2015 appears to be on target for a rise in religious tensions as well.
