If you ever needed a good point to highlight the nature of political Lawfare, this is a great example.
Julie Kelly essentially notes that Special Prosecutor Jack Smith is asking DC Judge James Boasberg to decide what evidence should be given to Florida Judge Aileen Cannon.

Recall that almost the entire investigation into the classified docs matter took place in Washington DC–not southern FLA even though it is the controlling jurisdiction since the alleged “crime” of retaining classified records/national defense info happened at Mar-a-Lago in Palm Beach.
DOJ then Jack Smith kept the case in Trump-hating DC courthouse so they could get favorable rulings from then-chief judge Beryl Howell–which they did. For example, Howell cited the crime fraud exception to justify piercing atty-client privilege between Trump and his lawyer, Evan Corcoran, to force Corcoran to turn over his records to DOJ.
Highly unlikely that would have happened in FLA especially before Judge Cannon. But right before indictment, Jack Smith moved the case to Florida. Reports at the time indicated DOJ read summaries of its grand jury evidence to a FLA grand jury in order to secure the indictment.
So, how is it almost nine months post-indictment that trove of evidence remains under seal? When the issue was raised, David Harbach said DOJ was “in the process” of asking the current DC chief judge James Boasberg to review the file, add redactions if needed, and transmit to FLA court. (link)

Boasberg, an ally of SSCI Chairman Mark Warner, has intercepted several cases that brought sunlight upon the corrupt DC system. In each case Boasberg ruled in favor of maintaining the corruption, including his willfully blind support of the FBI searching NSA databases to conduct illegal surveillance of Americans, and including Boasberg’s personal appointment of Mary McCord to run defense on behalf of the corrupt DOJ main office.

QUESTION: You have been the only analyst who has been correct that there would be no recession that just about everyone had forecast for the last two years. A friend turned me on to you and said mainstream media will never quote you because you do not play by their rules.
I had to present to our board and explain why we needed to switch to your services. They were impressed with your track record. The number one question that arose was that you said there is no recession until after May 7th. The latest statistics from the Atlanta Federal Reserve’s real-time GDP tracker have climbed back up to 3.1% for February, confirming your model has been correct all along. There has been no retreat in consumer confidence in February.
Will consumer confidence contract because of war, which appears to be inevitable? I assume this will be the topic at your London conference in May.

They think this will not be nuclear, but I fear the darker forces are looking at war as the means to reduce the population by 50% to save their precious planet and reduce CO2. With the prospect of war, UNCERTAINTY enters the equation. That results in consumer spending being reduced and savings increasing. I have warned that these people are desperate to create war to influence the 2024 election. The media is all on board, cheering war just as they did with COVID-19. You have Victoria Nuland calling anyone who is against war is now a Putin supporter. She has labeled the Republicans who are against war a “Putin’s wing of the Republican Party.” She is on a mission to create World War III before Trump might become president, who is anti-war and will fire her ASAP.
The mainstream media is all pushing for war. Just look at the stats. World War I saw 9 to 11 million military personnel dead, with civilian deaths of about 6 to 13 million. World War II was by far the deadliest military conflict in human history, with a total estimated death total of 70–85 million people. The civilian deaths totaled 50–55 million. Because you cannot grow food during such events, there were an additional estimated 19–28 million deaths from famine. That was 3% of the 2.3 billion at the time. Today, the world population is 8.1 billion. They used the COVID-19 vaccines to alter the herd. But war is always the best means to reduce the population. If they eliminate just 3%, that would be nearly 250 million. They want to reduce a lot more than that.

This entire conflict was manufactured by the American Neocons led by John McCain and Victoria Nuland.
It was McCain who started the Climate Change agenda on Capital Hill, and it had nothing to do with the planet. He was arguing against fossil fuels to cut off Russia’s energy sales. It was never about the climate, but they tell a lie often enough; as Hitler’s head of propaganda asserted, it will soon become the truth.
That strategy is working well in every aspect. They used it against Trump as well. Victoria Nuland is using it against anyone who is against war. She is running around calling them “Putin’s wing of the Republican Party.” The Democrats always start the wars, and the Republicans have to end them. That was Nixon’s pledge to end Vietnam; he was elected with over 60%. The exception was when Dick Chaney ran the White House and put his company, Haliburton, in charge; he invaded Iraq on the lie that he had weapons of mass destruction when the object was to seize the oil wells. His daughter is so against Trump and pro-war it must be a family tradition.
McCain and Lindsey Graham were caught on video preaching war with Russia.
Then you had Lindsey Graham boasting that sending all this money to Ukraine was the best Congress ever spent to kill Russians if he said that in the USA, it would be a hate crime.
When Zelensky was elected, he promised to reduce the tensions with Russia, even CNN said back in 2019. Ukrainian sources have long maintained that the election was rigged. Whatever the truth is behind that is almost irrelevant. This war was started by the interim UNELECTED government installed by Victoria Nuland.
Victoria Nuland masterminded the interim government for Ukraine to start this civil war. She made international headlines back then if the EU disagreed, her leaked phone call “FUCK THE EU” made global headlines. It showed who was really in charge. This war began with the installed UNELECTED government, and the platform of Zelensky was supposed to end the war and seek peace, which got him elected. That is what the people voted for, but the Neocons have been working hard to create World War III, and Zelensky has betrayed his own people from the start.
Back in 2022, Macron met with Putin to preserve peace. For a split second, Macron seemed to be the only reasonable European leader at the time when they were all cheering for World War III. Now Macron has switched sides and is pushing for World War III, perhaps to cancel a future French election like Zelensky and convert France into a dictatorship as Zelensky has done to Ukraine.
Ukraine had more nukes than China. It agreed to return them to Russia in return for their neutrality. NATO agreed not to invade, and so did Russia. Saying he would rearm with nuclear weapons the day before Putin came to the rescue of the Donbas was to ensure Putin would respond since he was then violating the Budapest Memorandum of Security Assurances.
Even the pro-Ukraine Washington Post, which can’t wait to start World War III to sell more papers, reported that Zelensky knew when Russia would invade and did not warn his people because of money. “If we had communicated that … then I would have been losing $7 billion a month since last October, and at the moment when the Russians did attack, they would have taken us in three days,”Zelensky said. They always want civilians to die so they can blame the other side and get support. That is an old trick and we see that with Hammas against Israel.
All of a sudden, Macron has switched sides and is outright proposing to send NATO troops into Ukraine because Ukraine is about to fall. He knows that has been the plan all along – NATO to invade Russia. The propaganda is so bad that we are drowning in lies. Zelensky is lying to the world, claiming only 31,000of his troops had died when the number was 100,000, even Ursula said in her speech, and Zelensky made her take that out to hide that Ukraine is losing badly. By pretending Ukraine is winning, he keeps the hopes up and the money flowing into his pockets.
I had reported that 100,000 Ukrainians had been killed in the first few months back in 2022. People said I was spreading Russian propaganda, confirming to me that they were being successfully brainwashed. My info was coming from the Ukrainian sources – not Russia. Then Ursula stood up and said 100,000 Ukrainians had died in battle, and Zelensky made her take that out, saying it was classified information. He has lied to the world and his own people all along, for he is promised a golden parachute when he has destroyed Ukraine and will escorted to live in Miami, trying to wash all the blood from his hands. Zelensky has destroyed his own country, and there are many Ukrainians who want him dead. If he is assassinated, it will be by a Ukrainian for destroying his own country. There are even anti-Semitic rumblings that it was Lazar Kaganovich, who was Stalein’s right-hand man, who suggested taking the food from Ukraine. He was a Ukrainian who also destroyed his own country.
Here is Zelensky before being President, says his salary is small and he is joking about confiscating money from Russians and Jews. Kaganovich was Jewish, and only after being elected did Zelensky claim to be Jewish. Some now think he is destroying Ukraine like Kaganovich, and the motive was that they joined Hitler in killing Jews, for they, too, were Nazis. This is the rising sentiment in Ukraine as the nation is on the brink of collapse.
Ukraine has been cannon fodder, and the West was using Ukraine just to kill as many Russians as possible BEFORE then NATO intended to invade Russia. Zelensky has finally admitted, “They have a great superiority.” Absolutely NOBODY ever expected Ukraine to defeat Russia. This has been a major propaganda operation from the very beginning. Let’s knock off the bullshit here. This is like Cuba trying to conquer the United States.
Zelensky has staged news in full production to keep the money flowing to Ukraine, as he is a good puppet of Victoria Nuland.
Putin even tried to explain the importance of the Minsk Agreement to Zelensky. Yet, Zelendsky has outlawed speaking Russian and outlawed the Russian Orthodox religion, directing them to be subservient to the Patriarch he set up in Kyiv.
Then, to further demoralize all Russians living in Ukraine, he declared that Christmas would be December 25th, not January, as the Orthodox have celebrated since 400AD. What’s next? Throwing Russian Orthodox Christians to the lions for refusing his decrees?
The West negotiated in bad faith, intended from the outset to create this war. I cannot imagine a head of state signing a peace agreement and then admitting that they never intended to honor it.
On December 31, 2022, French President Emmanuel Macron, during his New Year’s address, chastised the French workers with a lengthy discussion on pensions and the need for the French to work more. Then he brought up the climate crisis, declaring that the “energy transition is a battle that we must win.” All of a sudden, Macron has advocated sending NATO troops to Ukraine, which would be the start of World War III. Britain has come out rejecting that scheme. I suppose Macron wants Putin to nuke Paris so he can create jobs for his unions to rebuild the city.
I cannot stress more that the Neocons are advocating war and the total destruction of Russia, swearing that. they will NEVER use nuclear weapons because they know they will. These Neocons are traitors to the countries they are from, just as Kaganovich was to Ukraine. The GREAT LIE is they make people think war is a video game and only soldiers will die. That is far from the truth.
When we look at World War I, the total number of military and civilian casualties was about 40 million. The number killed ranged between 15 to 22 million, but this broke down to 9 to 11 million military personnel, with civilian deaths of about 6 to 13 million. In addition, there were about 23 million wounded military personnel.
World War II was by far the deadliest military conflict in human history, with a total estimated death total of 70–85 million people. The breakdown shows the real cost of war that our governments seem to cheer on. There were 50–56 million who were killed directly in the war. Because you cannot grow food in such events, there were an additional estimated 19–28 million deaths from famine. The civilian deaths totaled 50–55 million. Today, the world leaders seem to be cheering for war. The mainstream media is constantly advocating for war because they are bought and paid for by the establishment – obedience to authority.
Even if there were no nuclear weapons, just keeping with World War II, 3% of the world population was killed. Today, that will be about 250 million – almost the equivalent of the entire United States. These people are freaking out over the population, and they want a good pruning of the herd. In 1900, the world population was 1.7 billion. That became 6 billion by 2000, and now 8 billion by 2024. This is why these people want war – they want to reduce the population, end all sovereign debts and unfunded entitlements, and usher in a new postwar boom to rebuild the cities they have destroyed.
NATO may be planning to invade Russia, but China and North Korea will join the action. Based on our computer’s forecasts, this will NOT end nicely for the West. I wish I were wrong, and Socrates is wrong. But it seems to be inevitable at this point. NOBODY is interested in peace. Honor the Minsk Agreement, and this war is over in 24 hours. This is what Victoris Nuland is saying – war will stimulate the economy.
Thank you, Macron, for showing the world the real agenda. When will you be satisfied? Killing off 50%, 4 billion people with World War III? Or shall we take it back to 1900 with just 1.7 billion?

COMMENT: I have been considering the issues of whether the affirmative defense of qualified and other immunity defenses are or are not available to employees of states and cities if the complaint seeks only equitable relief and not money damages, and whether such defendants can avail themselves of the immunity defenses if they are sued in their official capacities and not their personal capacities. The basic rule of most Circuits, including the Fifth, is that if you sue a public employee their official capacity, and the complaint seeks only equitable relief and not monetary damages, the public employee defendant cannot assert immunity defenses.
I once followed the Third Circuit case of Bakara v. McGreevey481 F.3d 187 (3rd Cir 2007) that involved those issues, and I obtained a copy of the Petition for Writ of Certiorari filed in SCOTUS. See attached. That petition talks about the split in the Circuits at the time and addresses said issues. I concluded that decisions of the Second, Third, and Eleventh Circuits are very confusing on the said issues, and I was glad I was in the Fifth Circuit. The discussion in the said Petition for Writ of Certiorari in Bakara v. McGreeveymust, of course, be brought to date on the issues, but assuming there is still a split in the Circuits that could “open a door,” the following moves made by the defendants in New York v. Trump, et alcould shut down the Hochul, Engoron and James fiasco, specifically any proceedings to execute on the judgment based on the verdict:
FILE A COMPLAINT against Hochul, Engoron and James IN THEIR OFFICIAL CAPACITIES, NOT IN THEIR PERSONAL CAPACITIES. The complaint would allege that the 8th Amendment was violated in New York v. Trump, et al. The complaint would seek ONLY EQUITABLE RELIEF as follows:
(1) A declaratory judgment stating
(a) the definition of “restitution” and “damages” as set forth in New York Executive Law § 63(12), (b) the formula the court used, or should use, to calculate the amount of the verdict/judgment, and (c) whether what is called “damages and restitution” in the statute is really a fine, penalty or some hybrid form of damages;
(2) prospective injunctive relief, i.e., a TRO [Temporary Restraining Order], a preliminary injunction, and a permanent injunction against Hochul, Engoron, and James in their official capacities prohibiting them from taking any action in the future to enforce the judgment. Seeking only equitable relief and not damages may mean that Hochul, Engoron and James cannot plead the defense of qualified and other immunities. Lawyers always want to include a deep pocket defendant to get a money judgment, so they shoot themselves in the foot by seeking personal money judgments against employees of a municipality or a state. There are many cases on this type of complaint, but I am familiar with two where the plaintiff’s lawyers sought ONLY equitable relief and not damages against public employees in their official capacities. See Gorby v. Davis and Center for Biological Diversity v. Ken Sakazar
{Plaintiffs in Gorby v. Davis filed action against Interior and FWS to set aside FWS’s finding that the desert bald eagle does not qualify as a distinct population segment (“DPS”) entitled to protection under the Endangered Species Act (“ESA”). Plaintiff’s motions for summary judgment was granted. The Court found that FWS’ 12–month finding was based on the 2007 delisting rule, which failed to comport with the notice, comment, and consultation requirements of the ESA. The Court set aside the 12–month finding as an abuse of discretion.}
THE VENUE WOULD BE the U.S. District Court for the Northern District of New York located in the James T. Foley U.S. Courthouse, Suite 509, 445 Broadway, Albany, NY 12207. Hochul is domiciled in the New York State Executive Mansion, the official residence of the governor of New York. The Executive Mansion is located at 138 Eagle Street in Albany, New York, near the state capital. The Executive Mansion has housed governors and their families since 1875. This avoids filing in the U.S. District Court for the Southern District of New York.

REPLY: I think your analysis speaks to this very issue of the perversion of law. Given that the 8th Amendment prohibits cruel and unusual punishment, I fail to see how courts can create immunity to violate the Constitution they swear to uphold. In that case, the Third Circuit’s decision extended legislative immunity far beyond the bounds of the Constitution, effectively conferring absolute legislative immunity on any activity by executive officials with even a slight connection to the legislative process.
The Supreme Court just heard an oral argument in SEC v Jaresy (22-859) on November 29th, 2023, which could also impact the Trump Case. The Dodd-Frank Act passed in the aftermath of the 2007 Crash vested the SEC with the authority to sue “any person” for violations of the securities acts, including anti-fraud claims, in its own internal administrative tribunals. That was, in my opinion, unconstitutional. This Act circumvented the Seventh Amendment and the right to a jury trial.
The Seventh Amendment guarantees the right to trial by jury in “suits at common law,” encompassing legal, as opposed to equitable, claims for penalties. The Supreme Court had long held that the touchstone for the applicability of Seventh Amendment rights was the practice of the courts of England in 1791 when the Seventh Amendment was ratified. Therefore, that history establishes that eighteenth-century English courts afforded jury trial rights that included civil enforcement actions prosecuted by the Crown whenever the right of private property was at stake, as in suits for penalties.
We all may know that the Magna Carta established rights that were forced on King John (1166–1216) to sign on June 15, 1215, at the demands of the elite barons. The reason for that was rather important – the common man was not taxed, only the rich. A tax revolt over government abuse was at the core of this entire issue. The abuse was so profound that part of the demand included the right to trial by jury because the King would fine you whatever he pleased to really raise money.
At the time, it was said that there was hardly an Englishman who had not been amerced at least once a year. An amercement is a financial penalty in English law. It was an abuse where the king made revenue from fines during the Middle Ages. The noun “amercement” is derived from the verb “amerce,” which means the king amerces his subject, who offended some law that goes back to Anglo-Norman origin, literally meaning “being at the mercy of” your sovereign.
Therefore, in forming this nation, there was a contest between the Federalists of Hamilton, who wanted immense power for the government, and the Anti-Federalists. It may surprise many, but Patrick Henry, who every school child was taught in his memorable 1775 declaration, “Give me liberty or give me death,” refused to sign the Constitution because there was no Bill of Rights.
The king was circumventing your right to a jury trial after the Magna Carta by charging you in vice-admiralty courts where there was no right to a jury. The draft constitution’s omission of a common law jury trial right was the primary objection that nearly scuttled ratification. The Anti-Federalists carried the day in pushing through the Seventh Amendment, in large part to assure that the government could not put citizens to trial for penalties without the intervention of a jury.
That is precisely what NYC did to Trump, and they did that to me as well. It is a vile place where nobody in their right mind should do business. Will they have to go after anyone with a loan and argue they overvalued their property even after repaying it to prove this was not a political hit on only Trump? Even the New York Times explained that this statute has never before been used in a case that was not criminal fraud.
Here, we have a statute where the penalty was in the judge’s hands — there was no jury — and it gave him wide discretion to do precisely what the Eighth Amendment was to prevent. This is intended to bankrupt Trump to interfere in the 2024 election. The last time states did this to ban a candidate from the ballot was in 1860 and the ban against Abraham Lincoln. That led to civil war. Democrats in Washington are already saying if Trump is elected, they will REFUSE to comply with any of his orders. This is the end of the United States, and the Civil Unrest coming post-2024, as forecasted by our computer, is now becoming more understandable.

I revealed how Democrats planned the deliberate invasion of America to secure votes for socialistic policies. There is a second motive that is not largely understood, but it becomes apparent when you follow the money. In particular, follow the dollar.
The dollar’s purchasing power is significantly less than it was a few short years ago. Americans understand that inflation is here to stay, and the cost of living far outpaces what they earn. Americans mourned the American dream and are living in survival mode. During private waves, when the public turns away from the government, people hoard their money. The American people no longer revere the USD and are turning away from all government investments. They see the value of their dollar declining every time they go to the store, pay their mortgage, or glimpse at their bank account. Tax season highlights the misuse of government funds as we are taxed every time we look at the dollar.
You know who does revere the dollar? Everyone living outside of America, especially the people in third world countries who still place the dollar on a pedestal because its purchasing power far outweighs their own national currency. Migrants are not following the American dream to build a new life; rather, they are following the dollar.
Now, our fiat currency could easily be exposed for being worth less than the public perception. “Money” is merely worth its associated cost. There is not some magical bank within the Federal Reserve where they actually store trillions of dollars to use for every outlandish spending package. The Federal Reserve simply prints more money when demanded by monetary and fiscal policies. The dollar remains the strongest currency in circulation, for now, but it does not have the same strength as it once did.
The migrants provide the illusion of a stronger dollar and a reason to print in continuation to meet the monetary policies enacted under Biden. Furthermore, the migrants are provided with free housing, health care, food, and all other living expenses in order to perpetuate the concept of a strong dollar. If they were permitted to work, they would see that their wages would not take them far. They have no concept of American taxation. Therefore, the second motive behind the deliberate invasion of America lies within the declining purchasing power of the USD.
Russian assets frozen by the West have been sitting idle for three years. US Treasury Secretary Janet Yellen is urging the G20 to liquidate nearly $300 billion in stolen assets and send it to Ukraine.
This amount is more than Ukraine’s entire GDP. They could never recover on their own, hence JPMorgan Chase and BlackRock stepping in for when it comes crashing down. This, yet again, brings NATO members one step closer to fully entering the war. Two-thirds of the frozen/stolen assets are located in the European Union, which recently enacted legislation that corners windfall profits from the frozen assets, marking one major step toward directly funding Ukraine with these funds.
For all intents and purposes, the people who lost their life savings are mostly private citizens who have been victims of circumstance. They did not fund Russia’s invasion or have a say in their government’s decisions. Russia may view this complete violation of international law as an act of war. Using assets seized by private citizens to fund a war opens the door to a new form of economic warfare that will only cause people to refrain from investing in countries that allow this to go on. Welcome to the total collapse of globalization.
The Kremlin announced in December that it would not hesitate to seize assets from Western nations if they were to use their own central bank’s assets against them in war. China and other countries with large Western holdings could use any new international legislation against their opponents in the future. Despite Yellen’s claims that this move would not hurt the dollar, it would certainly deter foreign investment. Why invest in a nation that could potentially seize everything depending on your government’s policies? China sees the new funding packages the US is sending to Taiwan and will respond accordingly.
Yellen falsely claims that sending off these assets to Ukraine would “incentivize [Russia] to come to the table to negotiate a just peace with Ukraine.” Putin could not be more vocal about wanting to come to an agreement. He has attempted to reach a peace agreement countless times but has been blocked by the neocons at every opportunity. There can be no peace with this amount of money on the line.
Others are so confident that Russia will lose that they believe these assets should remain frozen as a bargaining chip or for future reparation payments. No one knows where the money sent to Ukraine goes or how it is spent. This reeks of a massive international corruption scheme that will propel us one big step closer to World War III.
