HHS Amends PREP Act Liability Waiver To Cover Only NIH Approved Treatments for COVID-19

There have been some recent reports about hospitals, doctors and health officials now refusing to treat U.S. patients with vitamin D, ivermectin, hydroxychloroquine and another effective therapeutics.  A recent notation about HHS changing liability waivers under the PREP Act, might provide some insight.

“Enacted in December 2005, the PREP Act authorizes the Secretary of HHS (Secretary) to issue a declaration (called a PREP Act declaration) that provides immunity from tort liability (except for willful misconduct) for claims of loss caused, arising out of, relating to, or resulting from administration or use of countermeasures to diseases, threats and conditions determined by the Secretary to constitute a present, or credible risk of a future public health emergency to entities and individuals involved in the development, manufacture, testing, distribution, administration, and use of such countermeasures.” (link)

A PREP Act declaration is specifically for the purpose of providing immunity from tort liability, and is different from, and not dependent on, other emergency declarations.

A COVID watchdog group recently noted: “It appears that the Prep Act had been amended such that private hospitals and entities were covered in their actions taken with Covid-19  patients and relieved of all liability as long as they were prescribing ‘Covered Countermeasures’. ie. NIH approved medications. This may be why hospitals are refusing to use effective COVID treatments like vitamin D, ivermectin, hydroxychloroquine, etc” (link)

Under the HHS Notification, the PREP Act has been modified: “The amended Section VII adds that PREP Act liability protections also extend to Covered Persons for Recommended Activities that are related to any Covered Countermeasure that is:

  1. licensed, approved, cleared, or authorized by the Food and Drug Administration (FDA) (or that is permitted to be used under an Investigational New Drug Application or an Investigational Device Exemption) under the Federal Food, Drug, and Cosmetic (FD&C) Act or Public Health Service (PHS) Act to treat, diagnose, cure, prevent, mitigate or limit the harm from COVID–19, or the transmission of SARS–CoV–2 or a virus mutating therefrom; (link)

The attachment of a liability or tort waiver to only cover FDA approved therapeutics likely explains a shift amid the medical community to stop patients treatment due to coverage restrictions on their malpractice insurance.  Additionally, Big Pharma -the group who controls NIH- wouldn’t make as much money if their mandatory vaccines had a less costly alternative.  So there’s that.

Psaki Says No One “Anywhere in The World” Could Foresee Afghan Government Falling So Quickly, Except They Did

During the White House press briefing today, the White House Press Secretary Jen Psaki once again made the claim that no one could foresee the rapid collapse of the Afghan government.  That claim is the White House narrative, and despite the evidence to the contrary they are sticking to it… because a stunningly incurious media is allowing them to.

When questioned about the incompetence of the Biden administration not seeing the Afghan government collapse, Jen Psaki said today: “I don’t think anyone assessed that they would collapse as quickly as they did. Anyone — anyone in this room, anyone anywhere in the world,” Psaki responded, “If you have anyone who did I would be surprised.”

This continued White House claim is disputed by evidence provided by both the intelligence community and internal cables from the U.S.  State Department. Let’s review; first ABC:

ABC NEWS – […]  U.S. officials tell ABC News that the opposite was true, insisting that key intelligence assessments had consistently informed policymakers that the Taliban could overwhelm the country and take the capital within weeks. […] “[U.S.] leaders were told by the military it would take no time at all for the Taliban to take everything,” an anonymous U.S. intelligence official told ABC News. “No one listened.” (read more)

Then there was the internal State Department cables from the U.S. Embassy in Kabul, dated July 13th:

WSJ – […]  The classified cable represents the clearest evidence yet that the administration had been warned by its own officials on the ground that the Taliban’s advance was imminent and Afghanistan’s military may be unable to stop it. […] In all, 23 U.S. Embassy staffers, all Americans, signed the July 13 cable, the two people said. The U.S. official said there was a rush to deliver it, given circumstances on the ground in Kabul.  The cable was sent to Secretary of State Anthony Blinken and Director of Policy Planning Salman Ahmed. Mr. Blinken received the cable and reviewed it shortly after receipt, according to the person familiar with the exchange. (read more)

Despite the media trying to cover for it, obfuscate it and deny it, there is tremendous anger in this nation toward Joe Biden and his conduct in office.  When contrast against the lost American service members in Afghanistan, the aforementioned “cold anger” is quickly becoming a rage.  I have not seen this level of focused anger before.

Earlier today, the family of Lance Corporal Rylee McCollum appeared on Fox News to discuss their meeting with Biden and why some of them chose to decline meeting with the installed occupant of the White House.   Their grief is heartbreaking, understandable, but also very reflective of a current sense in our nation right now.

JoeBamaNomics – Consumer Confidence Plummets, Spending on Durable Goods Drops, Inflation Dominant Factor

The latest measure of consumer confidence [Data Here] reflects a continued trend, and the index drops well below expectations.  The Consumer Confidence Survey is a monthly report detailing “consumer attitude, buying intentions, vacation plans and consumer expectation for inflation, stock prices and interest rates.”

The index now stands at 113, a drop from last month when it was 125.  The decline in confidence is an outcome of workers and consumers feeling the impact of massive inflation from Joe Biden economic and monetary policies.   With gas and food prices climbing rapidly, it should not be a shock to see consumer confidence begin dropping; however, the financial analysts were caught off guard by the unexpected size of the drop.

According to Marketwatch, “Economists polled by The Wall Street Journal had forecast a reading of 123.1”, a drop to 113 is a much more severe change in consumer confidence than expected.   The economists who get this stuff wrong repeatedly are inside the echo-chamber of Wall Street and the financial class.  There is a disconnect between those analysts and the real economy on Main Street; that’s why they are always surprised.

Inflation is eating at the middle-class on serious checkbook issues.  All of the COVID stimulus and relief funds targeting the working class are being eaten up by the inflation those policies create.  It is a self-fulfilling prophecy.   As we have noted in prior data, consumer spending for durable goods has completely dropped.

“Spending intentions for homes, autos, and major appliances all cooled somewhat; however, the percentage of consumers intending to take a vacation in the next six months continued to climb.” (link)

Unfortunately, this trend will likely continue as ‘real wages‘ (wage growth minus inflation) continue to drop.

Energy costs are high and climbing; food costs are high and climbing; gasoline costs are high and climbing… as this continues it has a negative impact on all types of consumer spending, including durable goods and housing.   This is Obamanomics all over again, only now it is JoeBamanomics.

The British report on side effects has confirmed well over 100,000 people have been impacted by the vaccines and confirmed that they might cause birth defects as well as blindness. Many young women have serious trouble with menstrual disorders. Indeed, locally, I am aware of one such case in a girl of just 25-years-old.

Meanwhile, in New Zealand, doctors have confirmed the first death due to the Pfizer vaccine. A woman died following complications with myocarditis that experts believe was prompted by Pfizer’s COVID-19 vaccine.

I am not anti-vax. But this one seriously bothers me because Gates has rigged the game, and he controls the complete narrative. Because the government is involved, there is no protection or independent studies. Politicians will NEVER back off, and even if 25% of the population died, they would probably blame Trump.

The joke on the Hill is the failure in Afghanistan has kept Pelosi up at night, trying to figure a way she can retroactively impeach Trump. This is our REAL problem with these vaccines. They skipped the animal trials and moved directly to testing the public. That means there is NO WAY these politicians will ever admit a mistake. Just not going to happen! Granted, considering all the people who have been vaccinated, the death rate is low. But that does not excuse the fact that testing should have been carried out, and under no circumstances should a vaccine of this nature ever be MANDATORY. This is not smallpox confined to only humans.

This example of Big Tech censorship shows just how weak and pathetic the Biden administration and their Big Tech sycophants really are.  As the mother of fallen marine hero Kareem Kikoui, killed in the terrorist attack at Kabul airport, shares her opinion of Joe Biden and the administration, the social media platforms suspend her accounts.

Mrs. Shana Chappell is furious at the Biden administration, and now that we know the military was aware of the pending attack before it took place – the horrific event is even worse.  Mrs. Chappell’s voice cries out in anger and grief.   The incompetence and failed leadership in the Afghan withdrawal led to the death of her son, Kareem Nikoui.  Her Facebook and Instagram accounts have now been suspended.  Screengrab Below:

Based on what we know about the objectives and intents of those who are attempting to control opposition (DOJ, FBI and Big Tech), it looks like the next segment is what they fear… and the reason her voice was silenced.  The White House fears Shana Chappell will start a grassroots movement and spotlight the illegitimacy of the Biden regime.

The DC operatives have been working on every angle possible to paint their political opposition as terrorists.  They cannot allow Mrs. Chappell to organize massive numbers of people heading to Washington DC.   She must be shut down… so they did.

Fox News host Tucker Carlson opened his show tonight asking some very serious questions about Afghanistan while contrast against a very incurious U.S. media.   The entire opening segment is well worth watching.
