Panda Games – China Files WTO Complaint Against U.S. Tariffs…


After benefiting from ridiculous preferential treatment by the World Trade Organization under “emerging nation” status for the past two decades, Beijing now turns to the WTO and files a complaint against the U.S. over recent tariffs and countervailing duties.

The substance to Beijing’s complaint is silly.  China claims there was a “leadership agreement” during the Osaka G20 summit not to apply additional tariffs.  However, the latest round of U.S. tariffs on China were in response to Chinese tariffs applied after Osaka.  Bottom line, Beijing is playing political games.

China, once again playing the wounded panda routine, is trying to set up a narrative that President Trump has broken his word.  That’s the cornerstone of their position, and they know such a complaint won’t go anywhere at the WTO; the complaint is really for the use, exploitation, and consumption by President Trump’s political opposition, domestic and international.  (emphasis mine)

HONG KONG/GENEVA (Reuters) – China has lodged a complaint against the United States at the World Trade Organization over U.S. import duties, the Chinese Commerce Ministry said on Monday.

The United States began imposing 15% tariffs on a variety of Chinese goods on Sunday and China began imposing new duties on U.S. crude oil, the latest escalation in their trade war.

China did not release details of its legal case but said the U.S. tariffs affected $300 billion of Chinese exports.  The latest tariff actions violated the consensus reached by leaders of China and the United States in a meeting in Osaka, the Commerce Ministry said in the statement. (more)

China did not release details of the legal case because there is no legal case.  You cannot go to the WTO and say: ‘but, he promised to buy my pickles‘…. because the WTO will ask you to prove the contract.  There isn’t a contract.  The whole claim is silly.

Notice how the claim comes from the “China Commerce Ministry”.

Those who are following closely will note the dragon face behind the panda mask of Vice-Premier Liu He is Chinese Commerce Minister Zhong Shan.

This political scheme, to complain to the WTO, is specifically from Zhong Shan and Beijing counts on Americans being to stupid to understand what is going on.

The aggregate U.S. position on tariffs relates to countervailing duties being used as sanctions against the practice of: (A) intellectual property theft; and, (B) forced transfer of technology.  The U.S. position is that the tariffs are countervailing payments due to both issues.

The U.S. position on all enhanced tariffs against China, as explained to the WTO, falls under the category of “measures necessary to protect public morals.”  China is stealing the intellectual property of the U.S, another WTO member, and therefore violating WTO rules.

There is clear evidence of these illegal practices, and the U.S. has already outlined the case.

Within international trade agreements each nation can protect their interests by using the clause “public morals” and “cultural industries.”  This is the same way Canada keeps media competition out of their country in the technology sector of the USMCA.

In the U.S. example the theft of intellectual property and forced tech transfer in order to do business with China, are clear examples of China violating international trade rules and “public morals”, stealing is not allowed; and the U.S. tariffs are applied and upheld based on that obvious -and internationally accepted- authority.

Beijing is just playing a political panda game with their ‘complaint’ to the WTO about the latest tariffs.  They are looking for allies to join them in their Orange-Man-Bad narrative.

Ridiculous.

The Surrender of Liberty in the Name of Security


QUESTION: It seems that as we get closer to a change-over of economic systems that as a society we are more willing to give up our rights to the State. Is that part of a pattern during these types of events? Was it seen as Britain, Rome, and other countries lost power after their peaks?

ANSWER: Unfortunately, the trend first materializes when people need the government to protect them usually from an external force. The British used this tactic against both the French and the American colonists. That prompted Ben Franklin to comment on this trend.

After the 3rd Century Monetary Crisis bottomed in the Roman Empire in 268 AD, there was a surge to build a wall around Rome by Emperor Aurelian following the same pattern. Aurelian saw the corruption that led to the debasement of the currency because those minting the coins were robbing the treasury. Aurelian moved to DRAIN THE SWAMP in Rome. When Aurelian returned to Rome in 271 AD after fighting off barbarians, he had to pacify a terrified city. He immediately halted the rioting and restored order to the capital. The controller of the mint in Rome began a rebellion over the monetary reforms laid out by Aurelian. He ordered that all the debased currency be purchased back and replaced with a new currency of higher content in silver. The rebellion was led by Felicissimus.

It appears that those who had been running the mint were embezzling the intended silver and issuing the debased coinage at least in part on their own authority. Obviously, any reform to the monetary system that called for an increase in silver content would have been unprofitable for those running the mint for personal gain. In the rebellion, as many as 7,000 soldiers died when Aurelian was forced to trap and execute them and their allies, some of the senatorial rank, in a terrible battle on the Caelian Hills.

Aurelian then constructed a wall around Rome — the first of its kind. Clearly, there was both a DRAINING OF THE SWAMP and a sense of security that people surrendered in the name of safety. The final phase comes when the suppression of liberty continues to become oppressive and therefore the people eventually wake up and see that the government is using this as a tactic to sustain or grab more power usually in self-defense.

Why Japan Lost So Big Post-1989


QUESTION: Hi Marty, I come from a golfing family and remember very well the shock when a Japanese investment group bought the Pebble Beach Golf Links, in 1990, for $850 million. The previous October Japanese investors bought the Rockefeller Center, triggering a flurry of Japanese purchases of signature U.S. properties such as Pebble Beach.

Was all this investment caused by The Plaza Accord in 1985, which devalued the USD by 40 percent? Which, as you’ve pointed out, also devalued American assets held by Japanese, igniting a sell-off of American investments and the 1987 crash. With cash repatriated back to Japan, the capital inflows into Japan ran the Nikkei up to its peak, in 1989. Within this late-80s early-90s timeframe, this is when the Japanese made their global malinvestments such as Pebble Beach, which they sold just two years later, in 1992, for $500 million, taking a 42 percent loss. Do I have the correlations and causations correct?

ANSWER: Yes. The Japanese bought US assets at the peak of their markets in 1989. As you can see, the dollar against the yen kept falling into April 1995. Not only did the Japanese lose money on US assets, but they also lost, even more, when they sold them and converted it back to yen on the decline in the dollar.

Currency is EVERYTHING. It dramatically alters the capital flows and can destroy economies because people remain clueless about how foreign exchange markets even function. That should be no surprise since they still teach all the economic theories of the Bretton Woods fixed exchange rate era including Keynesianism.

That is why everyone in the field is self-taught. You cannot get a degree in hedge fund management. Christine Lagarde of the IMF and soon to be head of the European Central Bank is a lawyer with no experience in funds management. People run for president spouting economic promises without the slightest background even in economics. What they teach in school has become ever more irrelevant in the real world. Other than a doctor or lawyer, it is hard to find someone who is working in the field in which they obtained a degree

Gold in Currencies

I have a question about Gold & Silver in other currencies – namely GBP.
Accepting your rational, with evidence I must say, that precious metals are a reflection of the confidence people have in their countries currency, you can see from the price of gold & silver in GBP and EURO that leading up to the Brexit referendum until now confirms this. When you look at the ECM for this period – 2015.75 up to 2020.05 – you can see that there are three main waves to it. One wave down from 2015.75 to 2016.825, then three shorter wave from 2016.825 to 2018.89 – single consolidation wave?, then a third wave down from 2018.89 to 2020.05. Gold & Silver rallied, consolidated, then rallied again within this ECM period. Does Gold & Silver have their own internal cycle? Will your upcoming report include content on Gold & Silver in other currencies? The trade in Gold:GBP since the ECM turning point of 2015.75 has been very lucrative

ANSWER: When you plot gold in dollars and pounds, you can see the steepness in the pound. This has been the strength in gold in dollars. It has been the hedge, not against fears of inflation in the USA, but it has risen in the face of the fear of a recession OPPOSITE of its previous relationships. This is all because we are approaching a Monetary Crisis Cycle.

Forecasting gold in dollars is pointless for that will be irrelevant to those in different countries. So yes, our report will be in terms of all the major currencies so people can make the appropriate decision in their own currency.

Hurricane Dorian 11:00pm Update – Expanded Warnings and Watches on FL East Coast, A Few Miles Can Make a Big Difference…


Major category-5 hurricane Dorian continues to pummel the Bahamas as it slowly tracks west toward the Florida coast.  The storm is anticipated to turn North, but the timing of that right turn will make all the difference.  A few miles further West could mean full hurricane force winds against the Florida east coast. All residents in the watch and warning areas should heed the evacuation notices of local officials.  With winds of 180+ MPH Dorian is a very serious threat.

[Hurricane Center] At 1100 PM EDT (0300 UTC), the center of Hurricane Dorian was located near latitude 26.6 North, longitude 77.9 West. Dorian is moving toward the west near 6 mph (9 km/h). A slower westward to west-northwestward motion is forecast during the next day or so, followed by a gradual turn toward the northwest.

On this track, the core of extremely dangerous Hurricane Dorian will continue to pound Great Abaco and Grand Bahama islands overnight and through much of Monday. The hurricane will move dangerously close to the Florida east coast late Monday through Tuesday night.

Maximum sustained winds are near 180 mph (285 km/h) with higher gusts. Dorian is a category 5 hurricane on the Saffir-Simpson  Hurricane Wind Scale. Slow weakening is forecast, but fluctuations in intensity could occur couple of days. Regardless, Dorian is expected to remain a powerful hurricane during the next few days.

Hurricane-force winds extend outward up to 45 miles (75 km) from the center and tropical-storm-force winds extend outward up to 140 miles (220 km). (read more)

The Daytona 3,000 – Power Crews from All Over U.S. Stage at Daytona International Speedway…


Warning, Toxic Masculinity Alert! LOL

After a hurricane, lunch-buckets are the second-best ‘buckets’… believe me.

So far over 3,000 power crews have arrived at the Daytona Intl Speedway staging area, with more en route.  That’s a not-so-small army of over 16,000 lineman and electrical utility personnel staged and prepared to jump into action depending on the impact zone of Hurricane Dorian.

The power crews are from all over the United States and Canada, with more on the way to alternate staging areas. The logistics of assembling an army of hardhats is intense, but these calloused and determined hands are some of the true-grit heroes in the aftermath of any hurricane event.

The Daytona International Speedway works great and holds almost perfect facility structure to support the scale of food, fuel and logistics.  Daytona is one of twenty-four staging areas throughout the Southeast where crews are assembling.

[Florida Plunder and Loot] (FP&L) Company President Eric Silagy welcomed crews to Florida.

“So we’re here at Daytona Beach today at the raceway where we’re onboarding crews are coming in from across the country,” Silagy said. “Today we’re processing about 750 crews. Close to 3,000 will be processed here within the next 24 hours.”

He said FPL has nearly 16,000 personnel committed to power restoration around the state.  The company is also planning to have 24 staging sites.

”We’re preparing for the worst, we’re hoping for the best, but we’re going to be ready,” Silagy said. (link)

As many long-time readers will know, we do have a little bit more than average experience dealing with the aftermath of hurricanes. I ain’t no expert in the before part; you need to heed the local, very local, professionals who will guide you through any preparation, and neighborhood specific guidelines, for your immediate area.

But when it comes to the ‘after part‘, well, as a long-time CERT recovery member perhaps I can guide you through the expectation and you might find some value. Consider this little word-salad a buffet, absorb what might be of value pass over anything else.

When the winds reach around 40mph, the utility company will likely, proactively, shut down the power. This makes things a heck of a lot safer in the aftermath; and much easier and safer during the rebuild. Don’t expect the power to be turned back on until it is safe.

Hurricanes can be frightening; downright scary. There’s nothing quite like going through a few to reset your outlook on just how Mother Nature can deliver a cleansing cycle to an entire geographic region.

Telephone and power poles, yes, even the concrete ones, can, and likely will, snap like toothpicks. There’s a sound when you are inside a hurricane that you can never forget. It ain’t a howl, it’s a roar. A damn scary roar that just won’t quit…. it will… eventually, but at the time you are hearing it, it doesn’t seem like it will ever end.

A constant, and pure rage of scary wind that doesn’t ebb and flow like normal wind and storms… hurricane wind just starts and then stays, sometimes for hours. Relentless and damn scary…. it just won’t let up. And then, depending on her irrelevant opinion toward your insignificant presence, she stops.

Then silence.

No birds. No frogs. No crickets. No sound.

Nature goes mute. It’s weird.

We have no idea how much ambient noise is around us, until it stops.

Oh, if she wants, she’ll keep dumping buckets on you as she wanders away. Buckets. Not pails, garbage can sized buckets. After the scour, yup, nature too has a rinse cycle.

If your town, city or hamlet is not underwater, there will be convoys coming to construct a pre-planned electricity grid recovery process. Convoys from every city, town and state from the east-coast to the mid-west. A glorious melding of dirty fingernails all arriving for the meet-up. Depending on your proximity to the bigger picture objectives at hand, you will cherish their arrival.

But first, there will be an assessment. The convoys will stage at pre-determined locations using radios for communication. Street-by-street everything needs to be evaluated prior to thinking about beginning to rebuild a grid. Your patience within this process is needed; heck, it ain’t like you’ve got a choice in the matter…. so just stay positive.

Meanwhile, you might walk outside and find yourself a stranger in your neighborhood.

It will all be cattywampus.

Trees gone, crap everywhere, if you don’t need to travel, DON’T.

I mean CRAP e.v.e.r.y.w.h.e.r.e.

Stay away from power-lines.

Be entirely prepared to be lost in your own neighborhood and town for days, weeks, and even months. Unknown to you – your subconscious mind is like a human GPS mapping system. If that raging Dorian takes away the subconscious landmarks I guarantee you – you are gonna get lost, make wrong turns, miss the exit etc.

It’s kinda funny and weird at the same time.

Your brain is wired to turn left at the big oak next to the Church, and the road to your house is likely two streets past the 7-11 or Circle-k. You don’t even notice that’s how you travel around town; that’s just your brain working – it is what it is.

Well, now the big oak is gone; so too is the Circle-K and 7-11 signs. Like I said, everything is cattywampus. Your brain will need to reboot and rewire. In the interim, you’re gonna get lost… don’t get frustrated.

No street signs. Likely no stop signs. No traffic lights.

Remember, when it is safe to drive, every single intersection must be treated like a four-way stop…. and YOU ARE GOING TO HAVE TO PAY ATTENTION. Even the major intersections.

You’ll need to override your brain tendency to use memory in transit. You’ll need to pay close attention and watch for those who ain’t paying close attention. Travel sparingly, it’s just safer.

Check on your-self first, then your neighbors. It don’t matter if you’ve never said a word to the guy in the blue house before. It ain’t normalville now.

Break out of your box and check on the blue house down the street too. In the aftermath, there’s no class structure. Without power, the big fancy house on the corner with a pool is just a bigger mess. Everyone is equally a mess.

The first responders in your neighborhood are YOU.

You, the wife, your family, Mrs. Wilson next door; Joe down the street; Bob’s twin boys and the gal with the red car are all in this together. If you don’t ordinarily cotton to toxic masculinity you will worship it in the aftermath of a hurricane. Git-r-done lives there.

Don’t stand around griping with a 40′ tree blocking the main road to your neighborhood. Figure out who’s got chainsaws, who is trained on how to use them, and then set about clearing the road.  If every neighborhood starts clearing their own roadways, the recovery crews can then move in for the details.

Stage one focuses on major arteries… then secondary… then neighborhood etc. It’s a process. Oh, and don’t get mad if your fancy mailbox is ploughed-over by a focused front end loader who is on a priority mission to clear a path. Just deal with it.

Phase-1 recovery is necessarily, well, scruffy…. everyone is just moving and managing the mess; not trying to clean it up yet. It’ll be ok.

Keep a joyous heart filled with thankfulness; and if you can’t muster it, then just pretend.

Don’t be a jerk. You will be surrounded by jerks…. elevate yourself.

If you need to do a few minutes of cussing, take a walk. Keep your wits about you and stay calm.

Now, when the recovery teams arrive…. If you pass a line-man, pole-digger or crew say thanks. Just simple “thanks”. Wave at them and give them a thumbs-up. No need to get all unnecessarily familiar, a simple “thank you for your help” will generally suffice. You know, ordinary people skills.

Many of these smaller crews will be sleeping in cots, or in their trucks while they are working never-ending shifts. If you eventually start getting power back, and see a crew in a restaurant, same thing applies… “thanks guys”. If you can pay their tab, do it. If you can pay their tab without them knowing, even better.

Same goes for the tanker truckers. The convenience stores with gas pumps are part of the priority network. Those will get power before other locales without power. Fuel outlets are a priority. Hospitals, first responders, emergency facilities, fuel outlets, then comes commercial and residential.

Remember, you are the first responder for your neighborhood. Don’t quit.

Recovery is a process. Depending on the scale of the impact zone, the process can take days, weeks and even months. Take care of your family, friends and neighborhood, and generally make a conscious decision to be a part of any needed solution.

It’ll be ok.

It might be a massive pain in the a**, but in the end, it’ll be ok.
