Solution – Legal Battle Against Socialism

We are in need of a qualified lawyer prepared to file a lawsuit against Progressive Taxation as a denial of Due Process and Equal Protection of the law. For centuries, people have debated whether the wealthy should pay more taxes than everyone else and what even constitutes the wealthy. The definition of the rich has constantly changed. It has now fallen to not just an individual, but to household income. that can easily be expanded to your children if they still live at home because they cannot afford rent or to buy a house thanks to non-dischargeable school loans for worthless degrees. We have unsettled questions as to who is the rich a person or a family, and then just how much more they should pay on a percentage basis compared to everyone else.

These issues have never been resolved despite the fact that the government has been shifting the definitions and presidential elections constantly push class warfare. This notion of “progressive” taxation has escalated into demand to end all freedoms and even confiscate the wealth of the so-called rich which comes down to the top income tax bracket which was $250,000 was expanded to 37% for $518,401 or more. This issue even sparked one of the early battles over tax distribution. Supporters of progressive taxation favored a graduated tax structure, where the tax rate
would increase with the taxpayer’s income. Opponents of progressive taxation believed that a person should not pay a higher tax rate just because he or she earned a higher income for this denies equal protection of the law and creates class warfare which began with Karl Marx.

Thanks to Marx, the debate over progressive taxation began to intensify at the turn of the 20th century with the passage of the Sixteenth Amendment, which permitted a federal income tax whereby the founders prohibited any direct form of taxation. During the colonial days, a tax they created was a “faculty tax” which did not tax income, but your ability to earn income. Then in 1913, Congress passed its first “lawful” income tax which was progressive because this was the attitude that even dominated the Supreme Court at that time.

Before the creation of the United States, taxes were paid to the United Kingdom by the Colonies who also imposed local taxes. The Articles of Confederation did not give the federal government any power to tax leaving that to the States. In England, the king needed the consent of the people to be taxed which is why he would call Parliament who represented the people. To this day, it is Congress that pretends to have the “consent” of the people to be taxed. Then in 1787, the US Constitution became law and it did give the federal government that power to tax indirectly which was primarily tariffs, and a portion of those taxes had to be given back to the states based on population. The Supreme Court ruled in 1797 what was meant by Direct Taxation (see Hylton v. United States, 3 U.S. (3 Dall.) 171 (1797))

Interestingly, it took one 51.6-year wave of the Economic Confidence Model where the fiscal mismanagement of the states began to put pressure on further taxation. From 1837, some states began to add income and property taxes. The Civil War led to the Revenue Act of 1861 which allowed a federal income tax which was to expire with the Civil War. This was direct taxation which was then found unconstitutional later in Pollock v. Farmers’ Loan & Trust Co., 157 U.S. 429 (1895). It was finally in 1911 when Wisconsin became the first state to adopt an individual and corporate tax. This was upheld with respect to corporations in Flint v. Stone Tracy Company, 220 U.S. 107 (1911).

It wasn’t until the 16th Amendment in 1913, that the federal government was granted the power to levy income tax on both property and labor and included corporate and individual income tax. This went to the Supreme Court which held that the income tax was then constitution under the 16th Amendment (see: BRUSHABER v. UNION PACIFIC R. CO., 240 U.S. 1 (1916)). The income tax debate did not begin until it was no longer the rich being taxed, but it was applied under socialism and Roosevelt with the birth of the payroll tax to affect the pocketbooks of an entire nation with World, people began to pay more attention.

There is no question that many scholars expressed deep concerns about progressive taxations. They criticized progressive taxation on the basis that it was “unfair” to pay greater than one’s proportionate share. Any such proposition that one’s ability to pay is discrimination indistinguishable from race, gender, or religion. The courts just held that it is unconstitutional to draft into the military only boys and not girls. Under these same principles, it is unconstitutional to tax one person at a higher percentage because of his ability to pay. This is the very essence of Marxism which not only violates the Ten Commandments, but it clear divides society creating class warfare.

In 1952, the publishing of “The Uneasy Case for Progressive Taxation,” by Professors Blum and Kalven, did we come to a systematic and very scholarly analysis of progressive taxation. They criticized progressive taxation primarily on economic grounds but conceded its constitutionality. Later in 1985, another book was published: “Takings: Private Property and the Power of Eminent
Domain” authored by Professor Richard Epstein. Here Epstein argued that progressive taxation was not constitutional suggesting that the Fifth Amendment Takings Clause prohibited such progressive taxation.

No person shall be … deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

The Supreme Court has never definitively upheld progressive taxation. You cannot have liberty and your right to property which turns on your class any more than on your race, gender, religion, or your sexual preference. The Supreme Court should, in fact, find progressive taxation totally unconstitutional. We may need to challenge this now in order to block the Socialist Agenda about to destroy the very freedoms of the United States.

What we need is a real law firm ready and willing to bring a class action lawsuit to start the only effort we have to prevent Socialism destroying our nation like Venezuela or the old Communist Regimes. You do not create prosperity by stealing from one person and handing it to another. If it is illegal to do so if an individual robs another, then the same principle applies if politicians exonerate themselves for committing the very same act. Equal Protection means we must all be equal under the eyes of the law.

Good Grief, Goodyear is Run By Idiots…

Get woke – Go broke, strikes again.  When you consider the scale of the company and the resources available to them on branding and marketing…. one can only come to the reasonable conclusion that Goodyear is run by idiots.

On the positive side, the boycott response -which I fully support, not because of the originating stupid, but rather because I do not want tires from amplified corporate stupid on my vehicles- just shows the scale of economic backlash from average Americans.

There are more of us than them; they just control the mechanisms that allow us to communicate with each other – nothing more.  Remember that !

Defunding the Police Movement

QUESTION: Marty; How can people actually support defunding the police? I don’t understand how any rational person can support that even when there have been incidents of police brutality.

DT

ANSWER: You have to really pick up the rug to see all the dirt and connections. This is part of this entire movement to force the elimination of all paper money and compel everyone into the digital world. There is Gate’s agenda linking his vaccines and digital IDs and then there will be passports required to even leave your home proving you are vaccinated. Then there are chips to be inserted for birth control which somehow I suspect will be subject to control by the state and a permit will be required to even have a child since Gate and his crew is obsessed with the population reduction.

There has been an ongoing drive to create robots for the military. They have been experimenting with Nanotechnology to create the next soldier. I have warned that this technology has been highly sought after. I have been asked if I would be interested in an AI project for a private contractor for the government. I politely declined. Beware the real political threat always comes from within. The future of the military and eventually police is to replace the boots on the ground with robots.

Duke Robotics has come out now with drones that carry machine-guns years ago. This video shows really the future of war and police domestically. It has been reported that China is selling its killer robots to the Middle East. These things will simply kill every human on the battlefield. This is clearly changing the face of warfare and the serious concern is that these things will one day be deployed in civil unrest situations.

If we have machines that enforce laws or replace soldiers in battle, this is actually the greatest wish-list governments have had for centuries. The power of any government rests upon its military to back it. Make no mistake about this, the United States has also staged exercises using the military to launch an assault on American cities. Even the EU has been conducting military/police exercises in case of civil war breaks out inside Europe.

Theordora-Ravena

I have written many times that the playbook on using the military against civilians to protect the government goes back to the Nika Riots of 532 ADThere were two rival political factions in the empire, the Blues and the Greens, who started a riot in January 532AD during a chariot race in the hippodrome. The riots stemmed from many grievances, and the people set fire to many public buildings. They even proclaimed a new emperor, Hypatius. Unable to control the mob, Emperor Justinian and his officials prepared to flee. His wife, Theodora, spoke out against fleeing the capital. She took charge and ordered the loyal troops led by two reliable foreign officers outside of Constantinople, Belisarius and Mundus, to attack the demonstrators in the hippodrome located in the city. Troops inside Constantinople refused to attack their own people. The key was to use troops who were not local for they would defend the government and kill people they did not know. The lesson is you cannot use local troops who may not kill people they know, are family, or personal friends.

Yeltsin-081991-Coup

The Russian Revolution in 1991 where the Soviet Union collapsed took place all because the troops refused to fire on their own people. Boris Yeltsin (1931–2007) was a Russian politician who stood on the tank during the civil unrest insisting the army not fire upon Russians. This has been the lesson from the Nika Revolt of 562AD. Therefore, the government is VULNERABLE if the military refuses to kill the people on the orders of the politicians.

In the case of 1932, President Herbert Hoover authorized the military to clear out the Bonus Army composed of World War I veterans and their families. They even called in the tanks to use against the veterans. While this incident above all probably pushed the independents to Roosevelt and Hoover lost the election, once again, we see the risks of using the military against the people domestically. We see that Venezuela has held on because the military will kill its own people. The uprising in Ukraine succeeded only because the Ukrainian police turned against the imported Eastern European Russian ethnic police and soldiers supporting Yanukovich.

Therefore, to understand the true movement behind the defund police, you must understand that they are already planning to replace local police to a large extent with robots that have no conscience and will kill on command. If the government can replace the police and military with robots, they will achieve their ultimate security against public uprisings. Merged with digital IDs and tracking as Gates has done in India, this will create the solution for the perfect totalitarian state that is not dependent upon the loyalty of the police or military. We are not there yet, but they certainly intend to be there within the years ahead.

You dod not even need AI for this goal. They can, of course, have simple tools like heat detectors to identify humans. They can add facial recognition to target specific people. They do not want an AI system that would actually allow it to override some central command directive. All of this is certainly possible right now with present technology. It does not even require futuristic fantasy to conclude where this leads decades from now. It is the ultimate power for the ultimate tyranny which they see as then invincible.

Dr. Sebastian Gorka: How the Far-Left Radicalized America’s Institutions | American Thought Leaders

How is the ideological basis of the far-left fundamentally at odds with traditional values? What is the war for America’s soul, as told in Dr. Sebastian Gorka’s new book? And in the eyes of Dr. Gorka, how did we get to this point? How were American institutions radicalized and America’s youth indoctrinated into sympathizing with socialist …

I Strongly Urge Readers to Leave California, New Jersey, Illinois, Connecticut, & New York

California is looking to impose a Wealth Tax as Elizabeth Waren had proposed which is Piketty’s idea which is supported by Schwab’s World Economic Forum in Davos. This will be on worldwide property – not income. The tax rate annually will be 0.4%. Even if you lose the money you will be taxed every year in addition to income taxes which are already the highest in the United States.

The problem here is not just worldwide income, California went after people who retired and left the state. They argued that their retirement income was previously earned in California so you had to pay California income taxes on your retirement funds even if you left California. This is the ultimate tyranny. You are paying taxes as a slave owned by California. You are NOT paying your fair share because you are not using the state’s resources or benefits. This is once again – taxation without representation. You will have no right to vote in California because you are not a resident. Nevertheless, this is the TRUE view of socialists – you are the property of the state. Socialists do not tolerate classes. Their core belief is everything belongs to them. My family fought in even the American Revolution. This is precisely what they fought against.

They are looking at the very same scheme to continue to tax you on the worldwide property even if you leave. I strongly advise you to move to a Red State ASAP. Florida has a lot of retired people so the politicians are more constrained. It may be your last chance. California Dreaming is now all about them and how they dream of new ways to exploit you even more.

States have lost income because of their stupid COVID lockdowns. Of course, they never reduce their expenses and after wiping out people’s jobs, they are looking to make up their losses in revenue with new creative ideas. As I warned, people simply began walking away from their property in Rome because of such corruption. Those in power only see their own power and self-interest. This is why we need so desperately to eliminate career politicians. Until that happens, there will never be a government of “We the People” no matter what.

Let’s be honest here. There is NO way any state government will ever STOP raising taxes. They are incapable of ever seeing themselves as the source of the problem. The audacity to try to continue to tax people forever because they once worked in California is the ultimate tyranny. They reduce everyone to just their economic slaves to be exploited with no connection to paying for common infrastructure or expenses since you use nothing when you leave.

The Justice Fish is dying from the head

If the Justice Fish dies, so will the Constitutional Republic of America – until the Second American Revolution brings freedom again

The Justice Fish is dying from the head

Credit the Turkish poet Rumi (1207-1273) as the origin for an expression in one of his poems: “Fish begin to stink at the head, not the tail.”

The pinnacle of American jurisprudence is the United States Department of Justice. The Supreme Court of the United States adjudicates when, where and how justice should, and has been, exercised.

The Department of Justice in America is dying from the head.  Essentially, it may already be dead. It appears so on the streets of Portland and Seattle, and in the political halls of Washington, D.C. and the Big Blue State governments.

Today, a handful of noteworthy voices is delivering this message in necessarily even-tempered tones. Here are three.

The President

Here is a summary of a FOX Business News reporter’s recent interview with President Trump, whose comments concerned both US Attorney Durham and Attorney General Barr. Maria Bartiromo asked about the Durham probe which Barr claimed could [the operative word] yield some results by next month. Quoting from her interview with the President, Trump said:

“‘I hope he’s doing a great job, and I hope they’re not going to be politically correct,’ Trump said. ‘Obama knew everything. Vice President Biden, as dumb as he may be, knew everything, and everybody else knew. And [former FBI Director James] Comey, and [former CIA Director John] Brennan, and [former Director of National Intelligence James] Clapper, they were all terrible, they lied to Congress,’ the president added.

‘They spied on my campaign, which is treason,’ he continued. ‘They spied, both before and after I won, using the intelligence apparatus of the United States to take down a president, a legally elected president, a duly elected president of the United States. It is the single biggest political crime in the history of our country.’”

Continuing, Trump added that he “hopes Durham is ‘doing a job,” and that his team “is not going to be politically correct and just get a couple of the lower guys. Bill Barr can go down as the greatest attorney general in the history of our country, or he can go down as an average guy. We’ll see what happens.”

Sidney Powell, General Flynn’s Lead Defense Attorney

In an interview posted on YouTube, Sidney Powell, who took over the defense of General Flynn after his deep state lawyers bled him dry of funds with bad results, said this, beginning at 53:05:

“It’s absolutely imperative that the Department of Justice return to the time when it would self-correct. It’s huge. When I was an assistant U.S. attorney, I was raised to tell the judge the truth, whatever it was. The good, the bad, the ugly. Somewhere in the last twenty years we came to this time when these people think the end justifies the means. They’re using the law as a weapon to destroy people, innocent people, to destroy peoples’ lives and that’s not what the system is about. So, the Department of Justice has got to start standing up for the right thing. The only politics in this prosecution [of Flynn] was from the very beginning. On the side of prosecuting General Flynn at all… It[righting the ship that’s the Department of Justice] has to be done if we’re to survive as a constitutional republic built on the rule of law.”

Sidney Powell: Inside the Michael Flynn Case and DOJ Reform

Tom Fitton, President of Judicial Watch

Beginning with the Russiagate Hoax, through the Kavanaugh Hearing, into the Impeachment ordeal, and continuing today, Judicial Watch (JD) has been led by Tom Fitton in its intrepid search for the truth.  Throughout that process, JD has been blocked, to the point of being stonewalled, by the Department of Justice (DoJ), its Federal Bureau of Investigation (FBI), and the Department of State (DoS).

On August 14, Fitton was interviewed by the host of FOX’s Lou Dobbs Tonight show after a three-judge panel of the D.C. Court of Appeals ruled against JD and overturned a lower court order requiring Hillary Clinton to sit for a deposition concerning her use of a personal server while at the Department of State, and events surrounding Benghazi. Two of the judges were appointed by Obama, the third by Bush, Jr.

Into the interview (2:58), Fitton explains how resistance to JW continues to come both from the DoJ, FBI and the DoS:

Tom Fitton reacts to appeals court overturning Hillary Clinton deposition order

Tom Fitton

It’s still happening. The attorneys at the State Department are colluding with the Clinton attorneys. They’re fighting us together. It’s incredible, and it’s a betrayal of everyone who expected law and order from this new Justice Department. [Dobbs asks] ‘What is William Barr doing?’ [Fitton silently holds up both arms, then says…] Nothin’.”

Late last week the DoJ announced that FBI Attorney Kevin Clinesmith – hardly a household name in the Russiagate Hoax – pled guilty to illegally altering a FISA document. While it may evolve into an important development, he could become merely one of a very few low-level persons held accountable for a multi-year lie.

Kevin Clinesmith

Sacrificial lambs.

One thing is certain.  If Biden becomes the next POTUS, any and all efforts to surface the truth of a litany of corruption from the highest level of the Federal Government, through the Big Blue State Governors’ mansions, down to the Mayors and City Councils of the Big Blue Cities that aim to defund their Police Departments, will vanish.

Should that happen, many Americans will have been as Estragon and Vladimir who waited for Godot to come on a country road. Pozzo and his slave “Lucky” come by, and Lucky delivers a speech about God and hell.

Then comes a goatherder who delivers the message that Godot has promised to come soon. Later, the goatherder comes again to say that Godot will come the next day. Then, on a different day, the goatherder brings a message of Godot’s imminent arrival. After multiple false starts, Estragon and Vladimir decide they’ll hang themselves if Godot doesn’t come.

There the play, “Waiting for Godot,” ends.

If the Justice Fish dies, so will the Constitutional Republic of America – until the Second American Revolution brings freedom again.

Katarina Jovanović Video From Romania

Katarina Jovanović has done a very good job at research. What she explains here is the very essence of the difference between Socialism & Capitalism. The former cannot tolerate class and must always eliminate all oppressors. She even goes into the correct analysis that Hitler eliminated the Jews based upon the ideas of Karl Marx. While it is true that Marx was a distant cousin of the Rothschilds, he was not supported by them and remain very hateful of such capitalists. All one needs to do is actually read his Communist Manifesto to gain understand of that Marx’s ideas even fueled Hitler and World War II. Katarina lived the horrors of Socialism.

The Biden Harris Malarkey Bus!

“It’s not about your rights, it’s about your responsibilities.”

Biden actually said this as he appeared with his VP pick, Kamala Harris. They were pushing a nationwide mask mandate. If elected, Biden said he “would do everything possible” to ensure Americans wear masks in public. He claims the masks make a “gigantic difference,” and under his presidency he will make wearing masks the law of the land.

The masks are not making a gigantic difference. Not against the coronavirus, anyway. Cloth masks do not stop the virus at all and in fact, the constant mask fidgeting ensures viruses and bacteria will be transferred to the masks via dirty fingers. Constant mask wearing is very bad for one’s health. It’s not good to breathe in one’s own CO2 all day.

Both Biden and Trump said mask wearing is ‘patriotic.’ Anytime a politician tells citizens that an annoying mandate that compromises freedom is ‘patriotic,’ it’s always a huge red flag. Wearing a mask is neither patriotic nor protective. It’s a sign of compliance. Government gets to see what it can get away with and what we will tolerate. So far, most Americans are doing what they’re told in lockstep. They seem almost eager to exchange freedom for safety. They will get neither.

Our rights, once abandoned, are very difficult to retrieve without blood being spilled. If you don’t want to live in a country where you must PERMANENTLY wear a mask as you step out your door, the time to protest is now.

As for Joe and Kamala, their Malarkey Bus is just waiting to be run over by Trump. The current Democratic presidential ticket is the weakest in history. If the mass media thinks black and brown people will vote for Biden because of Harris, they may be in for a surprise. She’s hated by many minorities after she did her best to lock them up for minor transgressions such as marijuana possession or when their kids were truant. Harris herself admitted she inhaled her Jamaican pot deeply. Now we’re forced to breathe in her bad hypocrisy breath as she exhales. Maybe in this instance, a mask is desirable.
