Supreme Court Hears Oral Arguments on DACA Case Tomorrow…


Tomorrow the Supreme Court will hear oral arguments on the case: “DHS -vs- Regents of University of California“, also known as the DACA case: Deferred Action for Childhood Arrivals.  DACA was instituted by a President Obama ‘executive action’, not an ‘executive order’.

The Obama Office of Legal Counsel (OLC) did not fully support the constitutional framework around the effort to protect a sub-set of illegal aliens; and therefore the originating presidential action was not an official ‘executive order’, a technicality that could end up as part of the argument(s).  The same issue existed within DAPA (Deferred Action for Parents of Arrivals), and was ruled unconstitutional by a divided SCOTUS.

In 2012, the Obama administration established a program known as Deferred Action for Childhood Arrivals (DACA), which allows undocumented young adults who came to the United States as children to apply for protection from deportation.

Applicants who meet a variety of criteria – for example, who have graduated from high school or served in the military and do not have a serious criminal record – must pay a fee of nearly $500 in total, submit (among other things) their fingerprints and home address and undergo a background check.

In the past seven years, nearly 800,000 people have obtained protection from deportation under DACA, which permits them to work legally in this country and gives them access to other benefits like health insurance and driver’s licenses. In 2017, the Trump administration announced that it would end the DACA program; in November, the Supreme Court will hear oral argument in a challenge to that decision. (read more)

In September of 2017 President Trump released a statement outlining how the administration would work with congress on immigration legislation toward a final disposition for those who fall under the DACA construct.

Unfortunately, Pelosi and House Democrats ultimately rebuked an immigration reform package they viewed was too heavy on enforcement and too much of an impediment to their preferred open-border platform.  By January 2018 the negotiations collapsed.

While the oral arguments are tomorrow, it is unlikely there will be a SCOTUS ruling on the current DACA case until sometime later in 2020 (summer).  Which will likely put DACA at the center of the 2020 election.

President Trump has previously been open to affording immigration protection for those who fall under DACA as part of a package for structural immigration reform.   However, it is very likely Speaker Pelosi and the DNC will rebuke any legislative effort in their continued push to politicize the “dreamers”, and trick young voters into supporting democrat candidates.

Turning to the legality of the government’s decision to end DACA, the government explains that it had several different reasons to shut the program down, all of which were entirely reasonable. First, it reiterates, it believed that the program was illegal, so that keeping it in place would be “sanctioning an ongoing violation of federal immigration law by nearly 700,000 aliens.” And not only did the government believe that DACA violates federal law, but the 5th Circuit had in fact struck down the two related policies.

Particularly in light of the program’s “legally questionable” provenance and the announcement by Texas and other states that they would challenge DACA, the government believed that the best course was to go forward with an “orderly wind-down” on its own terms rather than taking its chances defending the program in court and risking the possibility that the program could be abruptly shut down.

It was also, the government observes, “entirely sensible” for it to determine that, even if it could have continued DACA, it would be better to do so “only with congressional approval and the political legitimacy and stability that such approval entails.” After all, even then-President Barack Obama, when announcing DACA, had indicated that the program was only intended as a “temporary stopgap measure.”

Instead, the government concluded, it opted to return to the pre-DACA system of reviewing requests for protection from deportation on a case-by-case basis. “One can agree or disagree with that judgment,” the government suggests, “but it is not remotely specious.” (more)

Warren’s Wealth Tax


Warren’s Wealth Tax is so destructive to the economy and demonstrates that she listens to Thomas Piketty, the French communist pretend economist. She wants to impose a 6% tax on billionaires per year. That means if you lost 20%, you still have to pay 6% of your assets every year to the government to fund her Medicare for All. This is similar to death taxes or inheritance taxes which destroyed the small farmers. When the founder died, the government claimed the land was worth a pile of money and then demanded 20% to 40% in taxes. To pay the tax, they were forced to sell the land. This is also how small businesses are destroyed.

Nowhere in her proposal is there any reform of the system. The doctors do not work for the government as in the VA or in countries like Britain. You cannot keep allowing hospitals and drug companies to charge outrageous prices when there is no competition and this forces insurance costs dramatically higher not to mention the lawyers suing doctors. When my mother was in the hospital, they refused to release her and kept her in bed for weeks which weakened her. They would release her only to rehab. The previous time they sent her to rehab, the doctor changed all her medicine and nearly killed her 2 years before. When my sister looked in the eyes of the hospital administrator trying to sell rehab again, she asked her if this was your mother, would you do that? She did not verbally respond but shook her head no ever so slightly. It was her job to keep the money flowing. This is the corruption in hospitals – it’s all about the money. Warren simply wants to destroy the economy rather than address corruption in healthcare.

If I were president, I would convert all hospitals to a public institution like utilities. They would have to go under strict review and seek permission to raise the price of anything right down to toilet paper. There should be public hospitals created where private industry bids for a license since the government is incapable of managing anything as the VA Scandal demonstrated. They must be privately operated and foreign doctors who want citizenship should be granted that privilege in return for a work contract there at a reasonable rate for 5 to 10 years. ONLY when there is competition will prices ever come down.

I will state for the record right now – if Warren becomes president, our operation will leave the United States and I will have to seriously consider resigning my American citizenship. There would be no point in remaining in the United States for she would really lead to massive civil unrest and guarantee the decline and fall of the United States

Nine American Women and Children Massacred by Mexican Drug Cartel, President Trump Offers U.S. Military Assistance to Mexican Government….


Last month the Mexican government backed-down from a drug cartel in Culiacan, releasing the two sons of drug lord El Chappo after the cartel overwhelmed the Mexican military during an attempted arrest.  The cartel defeated the Mexican military.

Today, three American mothers and six children (4 boys, 2 girls) were brutally murdered in northern Mexico by drug cartels prompting President Trump to offer military assistance to Mexican President Lopez-Obrador in the ongoing struggle against cartel violence.

MEXICO CITY (Reuters) – Gunmen killed nine women and children in the bloodiest attack on Americans in Mexico for years, prompting U.S. President Donald Trump to offer to help the neighboring country wipe out drug cartels believed to be behind the ambush.

All nine people killed in Monday’s daytime attack at the border of Chihuahua and Sonora belonged to the Mexican-American LeBaron family, members of a breakaway Mormon community that settled in northern Mexico’s hills and plains decades ago.

A video posted on social media showed the charred and smoking remains of a vehicle riddled with bullet holes that was apparently carrying the victims on a dirt road when the attack occurred.

In a text message to Reuters he wrote that four boys, two girls and three women were killed. Several children who fled the attack were lost for hours in the countryside before being found, he said. He said it was unclear who carried out the attack.

Lopez Obrador said he would call Trump on Tuesday about ways to cooperate on security but rejected what he called any foreign government intervention.

“I’ll speak with President Trump to thank him for his support, and to see if in cooperation agreements there’s the possibility of getting help,” he told a news conference. “I don’t think we need the intervention of a foreign government to deal with these cases,” he added.

BREXIT – Live Decline & Fall of Western Society


Prime Minister Boris Johnson apologized on Sunday to Conservatives for failing to take the U.K. out of the European Union by Oct. 31st. Nigel Farage said he won’t personally run for a seat in Parliament. The plan to leave by Oct. 31st was blocked by the Remain crowd who refuse to accept any democratic process because they lost the vote. This is what is behind the decline and fall of western civilization. The losing crowd to any election is unwilling to ever accept a loss and move on. We have entered the second half of the Economic Confidence Model wave where governments simply lose all-purpose. The Remain crowd prevented a BREXIT without a divorce deal. They required Johnson to seek a BREXIT extension. The EU has granted a three-month Brexit extension until Jan. 31st, 2020.

Johnson has pushed for an early national election on Dec. 12th in which he hopes to get a more BREXIT-friendly Parliament. Nigel Farage has, in turn, pushed for his BREXIT Party to team up in a coalition with Johnson’s Conservatives for the December election. However, Johnson has so far refused the offer. That seems to be a wrong decision on Johnson’s part. This has resulted in Farage vowing that his party will contest every seat in England, Scotland and Wales against the Conservatives unless Johnson drops his BREXIT agreement, which Farage and his party believe is far worse than a no-deal BREXIT. Nigel told the BBC he will travel within Britain to support some 600 BREXIT Party candidates rather than by seeking a seat for himself. It is ironic that probably the best-qualified person to lead BREXIT is Farage, but he told the BBC: “I don’t want to be in politics for the rest of my life.”
